Ruling: Thumbprint scan is like a "blood draw or fingerprint taken at booking."
The US Constitution's Fifth Amendment protection against self-incrimination does not prohibit police officers from forcing a suspect to unlock a phone with a thumbprint scan, a federal appeals court ruled yesterday. The ruling does not apply to all cases in which biometrics are used to unlock an electronic device but is a significant decision in an unsettled area of the law.
The US Court of Appeals for the 9th Circuit had to grapple with the question of "whether the compelled use of Payne's thumb to unlock his phone was testimonial," the ruling in United States v. Jeremy Travis Payne said. "To date, neither the Supreme Court nor any of our sister circuits have addressed whether the compelled use of a biometric to unlock an electronic device is testimonial."
A three-judge panel at the 9th Circuit ruled unanimously against Payne, affirming a US District Court's denial of Payne's motion to suppress evidence. Payne was a California parolee who was arrested by California Highway Patrol (CHP) after a 2021 traffic stop and charged with possession with intent to distribute fentanyl, fluorofentanyl, and cocaine.
There was a dispute in District Court over whether a CHP officer "forcibly used Payne's thumb to unlock the phone." But for the purposes of Payne's appeal, the government "accepted the defendant's version of the facts, i.e., 'that defendant's thumbprint was compelled.'"
Payne's Fifth Amendment claim "rests entirely on whether the use of his thumb implicitly related certain facts to officers such that he can avail himself of the privilege against self-incrimination," the ruling said. Judges rejected his claim, holding "that the compelled use of Payne's thumb to unlock his phone (which he had already identified for the officers) required no cognitive exertion, placing it firmly in the same category as a blood draw or fingerprint taken at booking."
"When Officer Coddington used Payne's thumb to unlock his phone—which he could have accomplished even if Payne had been unconscious—he did not intrude on the contents of Payne's mind," the court also said.

Why aren't we talking about the real reason male college enrollment is dropping? (Celeste Davis, Oct 6 2024)
"White flight is a term that describes how white people move out of neighborhoods when more people of color move in.
White flight is especially common when minority populations become the majority. That neighborhood then declines in value.
Male flight describes a similar phenomenon when large numbers of females enter a profession, group, hobby or industry—the men leave. That industry is then devalued.
Take veterinary school for example:
In 1969 almost all veterinary students were male at 89%.
By 1987, male enrollment was equal to female at 50%.
By 2009, male enrollment in veterinary schools had plummeted to 22.4%
A sociologist studying gender in veterinary schools, Dr. Anne Lincoln says that in an attempt to describe this drastic drop in male enrollment, many keep pointing to financial reasons like the debt-to-income ratio or the high cost of schooling.
But Lincoln’s research found that “men and women are equally affected by tuition and salaries.”
Her research shows that the reason fewer men are enrolling in veterinary school boils down to one factor: the number of women in the classroom.
For every 1% increase in the proportion of women in the student body, 1.7 fewer men applied.
One more woman applying was a greater deterrent than $1000 in extra tuition! (…)
Since males had dominated these professions for centuries, you would think they would leave slowly, hesitantly or maybe linger at 40%, 35%, 30%, but that’s not what happens.
Once the tipping point reaches majority female- the men flee. And boy do they flee!
It’s a slippery slope. When the number of women hits 60% the men who are there make a swift exit and other men stop joining.
Morty Schapiro, economist and former president of Northwestern University has noticed this trend when studying college enrollment numbers across universities:
“There’s a cliff you fall off once you become 60/40 female/male. It then becomes exponentially more difficult to recruit men.”
Now we’ve reached that 60% point of no return for colleges.
As we’ve seen with teachers, nurses and interior design, once an institution is majority female, the public perception of its value plummets.
Scanning through Reddit and Quora threads, many men seem to be in agreement - college is stupid and unnecessary.
A waste of time and money. You’re much better off going into the trades, a tech boot camp or becoming an entrepreneur. No need for college. (…)

It's also interesting to look at the way the gender-shift in roles changes how the roles are perceived.
Secretaries are a perfect example. Back in the day, secretary was a prestigious position, usually the right hand of a figure of authority. The term comes from the 1400s, or thereabout, and the fact that high political offices are still referred to as Secretary of Defence and Secretary of State show how important the position was.
There were, of course, women doing the secretarial tasks - for example Marie Maitland transcribed the family folio in the 16th century though skeptical Victorians insisted a woman couldn't have so fair a hand and Dido Belle wrote her uncle's correspondence in the 18th century, which was noted to be unusual for a woman to do such a task - but secretarial duties primarily fell to men.
However, outside governmental roles, as more and more women entered the workforce, especially during and after the World Wars, and were very good at secretarial work, the gender dynamic shifted.
The number of male secretaries diminished rapidly and with it, the respect due. Misogyny coloured how secretaries were treated, no matter how skilled or professional the women in question were, and even now, there are still the stereotypes of the sexy bimbo secretary.

I really just want to talk about this particular moment where Orochimaru (who w/ Kabuto has been studying and stalking Sasuke as his next coveted vessel) realizes like most predators do, who the greatest threat is, so they can isolate their target. Orochimaru wants Sasuke most notably for his sharingan and his looks but he's an ideal victim (12 year old young child, no family, deeply traumatized) so he shouldn't be hard to lure away with the promise of the power needed to take down his powerful elder brother. However, in doing this research of Sasuke he sees the chess pieces moving. Naruto is becoming Sasuke's best friend. Naruto and his light, his pure spirit and ninja way is creating new motivations in Sasuke and not just his goals but his heart too. Sasuke feels like a child again,
That alone is so, so significant for a character like Sasuke, who sees himself as an avenger with no space for frivolous things like love and fun and being goofy - in short, he disallows himself to be a child. It was robbed from him and he has cast it aside. Then comes Naruto who challenges him, pushes his buttons and shows him what it's like to have someone in his life again that makes him feel like a kid, you see a new side to him.

That is why when Sasuke does leave and Naruto is looking up at him and cries out "so all of it was for nothing?" Sasuke says "no it wasn't for nothing, you became my closest friend." Naruto being his best friend, changing his heart meant Sasuke would also refuse Itachi and the massive amount of power he could have gotten by killing Naruto. It was never on a whim he spared his life. It was because he loved Naruto. To Sasuke, Naruto was more precious than his goal. Which he also showed in the land of waves arc with his self sacrifice.

Water as a molecule has SO many absolutely bonkers properties that no other substance has and it's that combo that makes life as we know it possible in this universe. that shit IS crazy.
Solid water floats in liquid water. that's not normal. It expands and arranges a repeating lattice structure that creates a crystal which isn't super strange but it drops in density by 11% which is. It's polarized. It dissolves EVERYTHING. The latent heat properties are insane. the emergent properties are also insane. the nitrogen cycle takes a whole bunch of effort and enzymatic processing, but the water cycle runs off the sun and the chill of space.
Just because you are a bunch of squishy bags of complicated water, doesn't make that a normal thing to be. the vast majority of the universe does not have that. water is very VERY special.
