For the record, I absolutely did block his number. He got a new phone this week so his abusive soon to be ex wife couldn't contact him, and I didn't have his new number to block yet, so I was expecting this kind of shit.

You'd think that because he's currently trying to get out of a situation with someone abusive and go no contact he'd understand why I'd go no contact, but he has the emotional capacity of a 12 year old. It's amazing that he calls me emotionally stunted and selfish because that's pretty much just projection.

You can't shake the Devil's hand and then say you were only kidding.

It was ruled that PepsiCo had plainly not made a valid offer of contract, therefore they did not have any obligation to follow through. Their offer was clearly made with humorous intent, and it was found that no reasonable person would seriously believe that they intended to follow through on it. That's what makes this case distinct from the Bethesda one. Bethesda made a serious proffer that any reasonable person would expect them to follow through on.

And, I disagreed with the reasoning of the case. (I think the judge should have ruled on impossibility rather than offer/acceptance: a civilian company couldn't offer for sale a military fighter jet. The "this was a joke" argument, I think, was a little convoluted.) Although we didn't study this case specifically, I distinctly remember my first cases in law school were "joke" contract cases. I think one involved a free car or something seemingly equally ridiculous, and the case did come out that the person was owed a free car. It was the same facts: "joke" advertisement offer, and then someone fulfilled the terms. The lesson was: don't make an offer to enter into a contract unless you're prepared for someone to accept. Advertisements count as offers.

And then tell me how many Jewish people in the last week you've interrogated about Israel, and how many Americans in the last week you've interrogated about bombing Iran, stealing Venezuela for some fucking reason, federal courts' continuing tyranny over tribal lands, ICE's concentration camps, police violence, the rampant horrifying abuse of children detained and in psychiatric facilities, and the President's ongoing crypto scams and pardons that have earned him billions from foreign government officials.

Now remember: Americans are actually citizens of America. Jewish people are citizens of wherever they're citizens of, which is only sometimes Israel.

Did you also know that these misdemeanors can sometimes be predicate crimes, meaning: they're misdemeanors the first or maybe second time, but after that they become felonies that carry much more jail time and are prosecuted in federal court?

Did you know that prosecutors federal court can use uncounseled (didn't have an attorney) prior crimes as reasons to enhance charges, elevate misdemeanors to felonies, and worsen sentencing guidelines?

Did you know a challenge to this practice went to the Supreme Court? That every single justice thought it was okay? That Ruth Bader Ginsberg wrote the court opinion for it? (Weirdly, that only Clarence fucking Thomas's concurrence even challenged the reasoning?)

Why don't we care about this? Why isn't this news? Why do tribal lands get federal court and federal jail time and not roads and schools and god damn electricity?
