"Iâm very concerned about my clientâs right to a fair trial in this case. Heâs being prejudiced by some statements that are being made by government officials. Like every other defendant, heâs entitled to a presumption of innocence. But unfortunately the way this has been handled so far his rights are being violated. And as you know, Your Honor, thereâs a wealth of case law guaranteeing his rights to a fair trial, but none of the safeguards have been put in place yet here â in fact itâs just the opposite of whatâs been happening.Â
Heâs a young man, and he is being treated like a human pingpong ball between two warring jurisdictions here.
These federal and state prosecutors are coordinating with one another at the expense of him. They have conflicting theories in their indictment, and they are literally treating him like he is some sort of political fodder, like some sort of spectacle.Â
He was on display for everyone to see in the biggest staged perp walk Iâve ever seen in my career. It was absolutely unnecessary. Heâs been cooperative with law enforcement. Heâd been in custody for over a week. He waived extradition. He was cooperative at all accounts. There was no reason for the NYPD and everybody to have these big assault rifles â that frankly I had no idea it was in their arsenal â and to have all the press there the media there. It was perfectly choreographed.Â
And what was the New York City Mayor doing at this press conference, Your Honor? That just made it utterly political. And as your honor knows under Loro v. Charles, the Court of Appeals for the 2nd Circuit has held it to be clearly established that these staged perp walks to the media unrelated to a legitimate law enforcement objective is unconstitutional. And I submit that there was zero law enforcement objective to do that sort of perp walk. Thereâs absolutely no need for that whatsoever.Â
And frankly, Your Honor, the mayor should know more than anyone about the presumption of innocence that he, too, is afforded dealing with his own issues. And, frankly, I submit that he was just trying to detract from those issues by making a spectacle of Mr. Mangione.Â
And there are consequences to this.Â
He has a right to a fair trial. And I just want to put on the record statements that the mayor made publicly about my client. Nothing saying âallegedâ for example. And he said âI wanted to send a strong message with the police commissioner that weâre leading from the front. Iâm not just going to allow him to come into our city. I wanted to look him in the eye and state âYou carried out this terrorist act in my city, the city of New York that I love.ââ And he wanted to show symbolism.Â
Your Honor, heâs not a symbol. Heâs somebody who is afforded the right to a fair trial. Heâs innocent until proven guilty. And the mayor was talking to jurors â future potential jurors that elected him. Those are the people that elected him that he is talking to and calling this man a terrorist.
So, Your Honor, I just want to make a record of this and put everyone on notice that this has to stop, and my client is entitled to a fair trial and the presumption of innocence."
Not only would this work on me this is the best thing you could ever do

Carol (2015) dir. Todd Haynes
babe. I know weâre all going thru a lot rn but I just wanna give u the heads up that sesame streets future is in jeopardy. hbo has chosen not to renew it for new episodes (a series that has been going since 1969) and the residents of 123 Sesame Street no longer have a home :(
n all seriousness sesame street is such an important piece of living media. it has been around for DECADES and from day 1 highlighted the importance of diversity empathy and education for children in a fun way. their mission statement is âHelping Kids Everywhere Grow Smarter, Stronger, and Kinderâ. itâs been such an influence for so many people at a formative age. itâs creators made it w the intention that it could be a resource for underprivileged kids and help them prepare for kindergarten. thousands of people have learned english from our friends on sesame. pls (at media corporations) donât let a beloved cultural phenomenon die
Would be lovely if people could spread this link to their donations page around the internet
Individual donors and partners can have a major impact. Join Sesame Workshopâs Mission to Help Kids Everywhere Grow Smarter, Stronger, and K
Letâs be clear that the issue NOT that they donât have a âhome.â
SESAME STREET NEVER LEFT PBS!!!!
I realize that most of the coverage of the HBO deal ignored this fact, and so people online all freaked out thinking it would only be on HBO, but this was never true.
The deal was for HBO to get to air new episodes a few months before those episodes aired on PBS. And in return, Sesame Workshop - a nonprofit that does a lot of educational research and development beyond just the one TV show - got a huge influx of funding.
Which means that yes, they are losing this funding source, which is definitely bad! They will need more support! They get money from the government and from grants, but the HBO cash was a lot more.
But also, they are generally a very well-run nonprofit, and Iâm guessing they knew the HBO money wouldnât be forever. So I doubt theyâre going to go under soon or anything.
But as far as ânot having a home,â Sesame Street always has, and unless public television in the US goes away entirely likely always will, have a home on PBS.
it's extremely critical that you see the photo of the perp walk for luigi mangione as being propaganda. i've seen so many people wave it off and instead fawn over his looks. and trust me, i know it ended up being kind of pathetic and weird - but please don't brush it off as a "modelling opportunity" for him. it's a fucking terrifying message the police are sending.
i want to make a few comparisons here, in case you're not from the US or familiar with why the perp walk thing is something to pay attention to. just to set the groundwork for why this is a purposeful, unusual, and cruel act by the nyc police - for why this is not a common occurrence and for why that matters.
the prosecution alleges the show of force is due to the charge of "terrorism." for comparison, in june 2015, tsarnaev was found guilty for the boston marathon bombing, which killed 3 people and injured hundreds. his actions are considered to be an act of domestic terrorism. i have spent the last hour looking through google for pictures of similar to mangione's perp walk - and so far, i have found zero. i also just do not personally remember a moment like that, despite living in boston at the time.
they allege that luigi is a stone-cold killer who carried out a longterm plan, making him particularly dangerous. again for comparison: in nyc, recently cory martin was found guilty of the killing of brandy odom. the murder was planned and premeditated to steal insurance money. and yet no staged perp walk. why didn't her life matter enough for a "show of force"?
but mangione gets paraded by a veritable army of police officers as if he is a rabid animal. for a single citizen who allegedly killed one other single citizen, the "largest perp walk ever" occurs.
so what is the "strong message" that the mayor and the police were trying to send here? the mayor speaks as if mangione is already convicted of terrorism. there is a very thin number of people who feel threatened by the CEO's death. none of us felt like mangione needs to be under massive armed guard.
the message is that you shouldn't resist. they are trying to "make an example" of him - that if you behave badly and kill a single rich person, you'll be treated as if you killed hundreds of people. you will be treated worse than a man who was found guilty of terrorism. you will be considered guilty without trial. the message is that the rich are a protected class, and you cannot touch them without massive punishment. they are trying to prevent a revolution by showing dominance and force against you.
the message is that the police are a puppet of the wealthy and that the law is not equally applied across class disparity. it is "some are more equal than others." it is "one life is more precious than another."
the show of force wasn't for luigi. it was for us. it was a warning. they are trying to remind us who is really in control.
Dec 4: Remember that time we learned Clark Kent totally peeked at all his Christmas presents with his X-Ray vision? (Justice League, âComfort and Joyâ)
Because Clark is awesome and loves christmas.
remember that time we learned clark kent is a grown man who still believes santa exists
Heâs an alien and a superhero who knows other superheros in a world with a talking telepathic Gorilla, ofc he believes, anything is game.
Thats because Father Christmas/Santa Claus totally DOES exist in the DC universe, and  every year, without fail, Santa fights through Apokolipsâ defenses just to give a lump of coal to Darkseid.
He W H A T
The latest addition to the DC Holiday Mythos is that Batman trained under Santa Claus.
And Clark is noticeably hurt that Bruce never told him.
God, I love comic books.
And this means Santa is real to the Ninja Turtles, who crossed over with Batman.
(Okay but was anybody going to tell me that now Santa Claus trained Batman or was I just supposed to read that in this specific Tumblr thread myself?)

I think sometimes people think eugenics is bad but its still true, like thinking that if people with certain traits have children it will change society for better or worse based upon what traits are promoted. I think its important to emphasize that eugenics is not only wrong morally it's also fake and stupid bullshit
Like eugenics was supposed to be based on the idea that "If it works with animals to select only the best ones to breed, why wouldn't it work with humans?"
well it doesn't work with animals, that's the thing. applying the eugenics ideas to domestic breeds of animals hasn't made better animals it's just made animals with more extreme expression of certain traits. turns out that when you decide which traits are the "best" and become obsessed with the genetic purity of the animals that have the "best" traits, you might well end up with some sad suffering creature like a Pug, or the Persian cats with the smashed faces that are in constant pain because their teeth and airways and brains are getting crushed by their skulls, or those meat chickens that grow so fast they can hardly even stand up after a few weeks old, or inbred race horses with tiny feet and fragile toothpick legs
like almost all traits are neither "good" or "bad" they're way more complex than that. a long tail or a long snout or a stubborn, independent personality can be good or bad depending on the situation. Who gets to decide what is a "good" trait or a "bad" trait? It's arbitrary and selecting for traits that are "good" in your opinion will often have both "good" and "bad" outcomes because the "good" and "bad" are part of each other and not separate its just part of being alive
Obviously oversimplifying everything but you get it. we did eugenics with dogs and how did that go? not very well
Here is an Internet Archive link to a compilation of eugenicist writings, which was published in 1934. I recommend going to page 193 (approx 40% of the way through) to read the short essay, "Is the Abnormal to become Normal?" by Lena K. Sadler
Read this essay carefully taking note of her reasoning and the types of support she uses for her argument.
Then see if you can think of examples of similar arguments and reasoning in the world today.
Man it really, really fucking sucks being nonbinary right now.
Thanks for illustrating exactly what I'm talking about. There's this massive fucking wave of hate coming from every fucking direction at the moment. Regular ass cis people who haven't ever met anyone nonbinary are cracking these infantilizing snowflake-ass jokes like you just busted out. Shit about "sock" not being able to do the dishes. Painting nonbinary folks as weak, immature, hysterical whelps. Other trans people memetically degendering nonbinary folks left and right, straight up insulting people to their faces and insisting there isn't anything derogatory about it at all. Right wingers spreading incredibly violent rhetoric of a tone unique to targeting the very idea of "nonbinary" and it just flies under the radar because nobody cares but nonbinary folks. It's fucking exhausting. Our civilization is descending into a period of fascistic darkness, and even those in our community are turning against us without consideration.
nonbinary needs a better word, i think you can attribute a solid 25% of problems to the word just being terrible
like i think most of the time, the purpose of the word should be to get out of the way, but rn itâs louder than the common gendersâthe main tool for opting out involves getting the most involved
and if you want to opt in to being conceptually loud, itâs also bad at that (well, itâs good at it in a bad way, instead of good at it in a good way)
Yea I think I feel what you mean. "Man" and "`woman" are very linguistically-entrenched and thus integrated into our environment. "Nonbinary" is less a noun and more an adjective. Hard to linguistically integrate and thus becomes difficult for the average person to conceptualize without being taught to. Would certainly benefit from a more short-hand term that sounds more linguistically organic. I'm sure there's an appropriate root to be found in old English or something. The term as it exists is more a social tool than it is an identity, but I guess that sort of reflects the nature of the situation as well.
The problem is, whenever people DO propose new nonbinary terminology, it gets nitpicked to death and people aren't willing to try and use it. Everything is too infantilizing, too obscure, too Germanic, too Romance, uses the letter X, and god forbid if you propose a word that sounds the slightest bit like a word that already exists. Folks go "why not just use person?" as if genderless language fills the same role as specifically nonbinary language. Like we should just accept that nonbinarity can only be discussed in vague, generic terms and adjectives.
Because they aren't actually invested in changing language and culture for the sake of nonbinary people. And thus we return to Being Nonbinary Sucks Right Now
Love seeing something from TikTok and going âgirlie that is literally what led to the downfall of the Papal Statesâ
Jewish baby named Edgardo Mortara is seemingly about to die in Bologna, 1851
Catholic nanny secretly baptises him to save his soul, which sheâs not exactly the kind of authority who can do that, but w/e, itâs interpreted by the church as valid later
Kid survives
1857 her secret gets out, a baptising makes a kid a Catholic according to the Church and a Catholic canât be raised in a non-Catholic household in the Papal States, so the church authorises the police to kidnap Edgardo from his family
Raised personally by Pope Pius IX, Jewish family not allowed to take him back due to Church doctrine, this action destroys the family with grief and despair
This case gets international infamy with the Pope not understanding why everyoneâs shiting on him for doing this, including allies
Emperor Napoleon III shifts from opposing Italian unification to supporting it as a direct consequence
Bologna falls the next year, 1859
Kingdom of Italy forms 1861
By 1870 Rome is lost to the Italians and the Papal States are no more
(Edgardo Mortara goes on to become Father Mortara)
(He dies in Belgium in 1940 three months before the Nazis occupied the nation, which if heâd have lived he wouldâve been persecuted as a Jew)
Wikipedia confirms
Fun fact: the Catholic Church did not stop doing this after Edgaro Mortara. During WW2, many Jewish children were put in convents or catholic-run orphanages for their own safety. Sounds nice right? Except after the war ended, when parents or surviving relative went back to claim their children, the church went, âuhhh, actually theyâre catholic now, no take backs!â
The most infamous of these cases was the Finaly affair. Two Jewish children in France, Robert and Gerald Finaly, were placed in a Catholic nursery in 1944 in anticipation of their parents being deported to Auschwitz, where they were both murdered. Their aunt, Marguerite Fischel, survived the war and went to find the boys so she could take them to live with her. However, the nun who had custody of the boys, Antoinette Brun, adamantly refused to give them up, reportedly saying that âThe Jews are not gratefulâ
What followed was a years long custody battle where despite being repeatedly ordered by courts all over Europe to return the boys, Brun took them to many different countries and hid them, with the support and help of other nuns and priests. It was suspected at the time, and later confirmed by documents released in 2020, that Pope Pius XII had supported the effort to keep the boys away from their surviving family and have them be raised Catholic.
Thankfully, after negotiations between a sympathetic cardinal in France and the chief Rabbi of Paris, the boys were finally recovered and reunited with their aunt.
Documents reveal the private discussions behind both Pope Pius XIIâs silence about the Nazi deportation of Romeâs Jews in 1943 and the Vatic
I wish I could say that the phenomenon of the Catholic Church kidnapping children and keeping them away from their families for the purposes of forcefully raising them Catholic is unique to Jews, but itâs not. From the mid nineteenth century to the mid twentieth century, the Church ran hundreds of residential schools in the US and Canada where indigenous children were kidnapped from their homes and forced into these cruel and inhumane âschoolsâ. The children were forbidden from speaking their own languages or practicing their own cultures and religions, their hair was cut, and they were subject to emotional, verbal, spiritual, physical, and sexual abuse. Many of the children died due to malnutrition or medical neglect, their bodies buried like dogs beside the schools. The Catholic Church was not the only Church to participate in this, but theyâve been the most reluctant to fully acknowledge and apologize for it. It was only in 2022 that Pope Francis apologized on behalf of the Catholic Church for their part, but some people found the apology inadequate.
Idk what my point is here, just that thereâs such a clean link between evangelizing, cultural/religious imperialism, and how damaging and horrifying a religion can be when it is thoroughly convinced of its own superiority. And that unless an institution is forced to change, it probably wonât change on its own.
now yall know what time it is

#sometimes people express the sentiment in op's first paragraph but call it ''evolution'' instead of eugenic#this is based on a misunderstanding of what evolution is and how it works that has been heavily pushed BY eugenicists#scala naturae my fucking beLOATHED#natural selection is not a force that makes things ''better'' it is just a directional pressure on the process of evolution#that arises as a consequence of environmental stressors acting on a population#and in the long term it's not even necessarily directional#it's transiently directional for as long as the stressor lasts#there is no end there is no final form there is no perfect organism that's not how it WORKS

Most people donât understand how easy and common it is to develop psychotic symptoms or that everyone literally everyone has the capacity to experience psychosis
In fact if youâve ever been sleep deprived including being able to sleep in shorter bursts but unable to get several REM cycles or you use substances to cause sedation rather than sleep youâve likely experienced mild hallucinations already
Theyâre called disturbances. The things like thinking you heard someone call your name, feeling crawling sensation on your skin briefly, seeing things move in your peripheral but nothings there when you look.
This is (one of the reasons) why I really hate the âIâm [anxious/ADHD/depressed/etc.] not crazy!â The divide you draw between yourself and people with psychosis and psychotic symptoms only serves to harm. Not only those you alienate but also yourself. Because you have no guarantee that you will not join us one day.
We are all several nights of poor or no sleep and several bad things away from psychosis. It serves no one to be ignorant of it.
"Around 27% of those with disorders of anxiety and depression displayed one or more psychotic symptoms, vs 14% in those without these disorders (OR 2.23, 95% CI 1.89â2.66, P < .001)." Schizophrenia Bulletin. 2012 Jan 18;38(2):247â257
This is just one study but it implies that if you have anxiety or depression you may have a 1 in 4 chance of experiencing psychosis.
It also implies that if you don't have anxiety or depression you may have a 1 in 7 chance of experiencing psychosis.
People act like anti-masculinity isn't a problem in queer spaces, as if I'm not instantly perceived as bigger, angrier, and meaner than everyone else in the room just because I'm butch.
As if I'm not constantly relegated to being everyone's Big Angry Protector.
As if queer spaces haven't habitually treated me more like a snarling dog on my partners' leash than as a human being.
As if I'm not constantly told my "job" is to protect every other queer person with my physical body, even though I'm disabled.
As if I'm not assumed to be the aggressor in every dispute, even though I value de-escalation and mediation as vital skills.
As if I exist only to hurt others or to sacrifice my body for them, never being protected and comforted in kind.
Find someone else to defend pride against bigots. The butches are on strike until you treat us better and stop volunteering us for the firing line.
I'm tired of being told I'm supposed to take a bullet for people who would throw me under the fucking bus. Where's OUR defense squad? When do the butches get to be lovingly defended and treated to some kindness and care?
Butches deserve better. And that goes double for trans butches, of any gender.
Talking to my butch friends, especially my butch friends of color, constantly reveals how badly butches are treated in supposed "community spaces." It gets worse the more intersecting marginalizations you have, but "other queer people act afraid of me" is an experience my butch friends and I all seem to have to some degree.
And it fucking sucks, y'all! It sucks!
