This is so funny to me, not only because Mark Bankston is probably unmatched at this point in taking on arrogant idiot dickheads who commit or facilitate defamation (seriously, both Alex Jones AND Elon Musk??) but because Alex Shapiro is NOT a nobody lawyer.
He is a partner at one of the largest firms in the U.S., almost certainly gets paid a four-digit number per hour, and is known as a heavy hitter. He's represented Jay-Z, Alec Baldwin, and Mr. Beast. He has a Wikipedia page.
And he is absolutely wrong on the law here. Mark Bankston is correct: When you come to a deposition, your job is to answer questions; you are not allowed to just talk about whatever else you want. You aren't supposed to talk at all unless there's a question posed to you, and then you are supposed to answer the question and then stop talking. Otherwise someone could just filibuster the whole deposition and use up everyone's time talking about nonsense.
Plus, any good attorney should know you want your client to speak as little as possible in a deposition! What is Shapiro doing encouraging Musk to talk!
Also the fact that Shapiro didn't get admitted pro hac vice (essentially getting temporarily admitted to practice law for a specific case in a state/jurisdiction where you aren't actually licensed) before representing Musk at this deposition is hilarious.
