Dueling Obamacare subsidy rulings could send case to Supreme Court

A U.S. federal appeals court delivered a potentially crippling blow to President Barack Obama's health care law Tuesday by limiting insurance subsidies, but a second court issued a contradictory ruling on the issue. The opposing verdicts, just hours apart, brought what one U.S. senator described as "chaos and confusion" to the status of Obamacare, with likelihood growing that the Supreme Court will need to weigh in.

We believe that this decision is incorrect, inconsistent with congressional intent, different from previous rulings, and at odds with the goal of the law: to make health care affordable no matter where people live.

The Supreme Court has already ruled in favor of the constitutionality of another part of the law in 2012. But the conflicting verdicts show that "there continues to be chaos and confusion around the president's health care law," Republican Senator John Barrasso told reporters, adding that he was calling on the Supreme Court to settle the matter. The White House argued there was no confusion about Obamacare's intent when it came to subsidies.

Today’s ruling is also further proof that President Obama’s health care law is completely unworkable. It cannot be fixed.
