Pretti was conceal carrying without ID, and that was unlawful. There is also a subject of duty to inform. And that begs the question if his intent was to obstruct with illegally possesed firearm, and if the officers could reasonably assume that he was in the process of firing a gun or potentially reaching another one he could have. Which is something that the investigation should look into. This isn't a detail, it is a core subject that will determine whatever the shooting was justified or not, which is why people should wait for the result.

Also, looking it up, according to https://www.usconcealedcarry.com/resources/terminology/general-terms/duty-to-inform/, Minnesota only has a Duty to Inform insofar as you're supposed to answer a cop when they ask you, not to proactively tell them before they do anything - though it's not like he really had time to tell them anything while he was struggling slipping on the ice and getting tackled.

It's not like a traffic stop where the officer pulled them over and sauntered up and said "hi how are you today, just noticed you had a broken tail light, mind handing over your drivers license? Any guns in the car?" - Everyone involved was too focused on not falling over on the slippy ice!

And every conceal carry training in existence will tell you one thing: you do not ever fight cops with a gun on you. The moment cops discover you are hiding a gun from them while resisting arrest is the moment they can reasonably assume that any sudden movement toward your own body is an attempt to pull another hidden weapon.

As I said, it's possible that the investigation could turn out that an evil wizard cast a magic spell to conjure an illusion of the events that we saw and actually the 3+ video angles were fake, but discounting arcane intervention - really?

He wasn't really fighting cops, the extent of his action was walking between a cop and another protester a cop was shoving over. He didn't really have any time to do anything else before getting pepper sprayed several times and falling over on the slippy ice.

Again, Minnesota does not have Duty to Inform unless asked. Surely it's the whole point of a concealed carry permit that you are permitted to carry a weapon in a concealed way. Any police operating in Minnesota ought to know that!

It is not a reasonable assumption that anyone with a conceal carry will have multiple teeny tiny handguns hidden all over their body, and that even if you've disarmed them of one handgun, then any following wiggle (likely brought about by the slippery ice, pepper spray, and five different dudes jostling him about) should be intepreted as deadly intent that you must react to by magdumping into their back.

Lots of americans conceal-carry; it's really not THAT suspicious of a behaviour! You can't shoot them all, they're like 8% of the country apparently!

He wasn't really making sudden movements, mostly just slipping on the ice with his arms on the ground and being jostled by the ~5 different men all simultaneously either grabbing him or hitting him.

He made *one* sudden movement, at the end, after he gets shot in the back and all the people grabbing him get startled and jump back in surprise and let him go.

are you kidding yourself if you think anybody buys that you don't want chaos and bloodshed.

Until then, there is an official investigation procedure of us mortals to rely on, no matter the amount of snark vomited by you. And even after then, given that you are incapable of admitting that it is scandalous for the police chief to outright say that it's irrelevant that even if the investigation proves justified shooting, especially when said police chief has blood on his hand due to chaos he permits by refusing to cooperate, I don't think your level of bias makes you exactly trustworthy. Personally, I don't find you deserving of trust, blame that on your love of acting like a nasty smartass first and foremost.

It appears the the all-knowing god doesn't realize that sanctuary cities that refuse to cooperate with ICE are 590 more likely to have violent confrontation with ICE. Or maybe that god simply doesn't care.

Anyway, regarding the gun, I already told the OP the difference between this case and Rittenhouse. The court/investigation won't see this as a detail but as a core issue, one that is in favor of ICE. It won't matter whatever you liked or not liked what Petti did, only what could be reasonably perceived by ICE agents. Though his lack of ID does make his gun possession unlawful, which will add credentials to any testimony from the agents that will paint him as a provocateur or troublemaker.

Maybe Petti really didn't want to do anything bad and he was just ignorant about laws. But that does not rule out that agents could reasonably perceive otherwise.

Until that it cleared out, I'll maintain my position that people should wait and case with such idiocy:

It's funny how much you go on about that off-handed comment where the police chief says some vague politician-speak line about "damage already been done" next to scandal of the ICE spokesperson saying firmly and clearly that he 'violently resisted' and they were 'Fearing for his life and the lives of fellow officers' and 'fired defensive shots' and 'an individual wanted to do maximum damage and massacre law enforcement'. That's pretty scandalous! Much stronger claims then! Both vastly stronger claims and also vastly falser!

Has the local police chief made a public statement where he holds against ICE using justified lethal force? Yes or not.

Is the situation where you can answer "yes" to both above fucked up? Yes or not.

Anyway, now we have learned more information and it turns out that Pretti was an armed lunatic who was repeatedly attacking Federal Law Enforcement.

So we have a case of a violent man who should have been charged with felony 11 days prior and be disarmed, but was allowed to further endanger the streets, just because the local police chief thinks that he's Mao Zedong and armed felons he enables are his Red Guards.

This further will solidify any account from the agents that they have perceived Pretti as a threat. Either way, Federal Law Enforcement shouldn't be deployed to hostile zones where corrupted police chief wants them to be repeatedly attacked by lunatics with guns.

You realise you can't kill people for that, right?

I'd almost understand if he had a history of killing police officers and was on the run for a random murder spree(but even then, you shouldn't even shoot that guy if you literally already have them disarmed and on the floor) but he shouted at a protest and kicked a car. That's just pathetic.
