One of the most important things I learned in my Language and the Law class is that law enforcement will intentionally misinterpret every type of statement asking for a lawyer as not asking for a lawyer. Even directly saying it like this “I will not speak to you without a lawyer” can be taken as a simple statement of fact rather than a request for a lawyer. You literally have to state “I am now invoking my right to a lawyer” and every time they try to proceed with an interrogation you have to answer every question with “I am invoking my right to have a lawyer present”. You can’t just tell them you won’t talk without a lawyer or that you want a lawyer. You have to state that you are invoking your rights. Otherwise they could just say “well they just said they wouldn’t speak without a lawyer present. That’s not invoking their rights to a lawyer. It’s just stating a fact.” even just stating your right to a lawyer doesn’t count!
PLEASE share this addition. I am a lawyer who works in criminal defense, and this is one of the most avoidable things that people consistently get wrong about the Miranda rights.
Here are some more “ambiguous” phrases which courts have found DO NOT invoke your right to a lawyer:
“Maybe I should speak to my lawyer first.”
“I might like a lawyer.”
“I think I should have a lawyer present for this.”
“Could I speak to my lawyer first?”
“How long until my lawyer gets here?”
And perhaps most egregiously – “Get me a lawyer, dawg – ‘cause this is not what’s up.”
Here are the magic phrases which you need to know if you want to invoke your Miranda rights:
1) “Am I free to leave?”
It’s worth asking this even if the answer is obvious. Even if the officer does not let you leave, by forcing them to admit that you are not free to leave, you are creating a record which your attorney can use to prove that you were in custody. Miranda rights only apply if the interrogation is custodial, meaning that police officers will frequently claim that their suspects were “not in custody” to get around their Miranda rights.
2) “I am invoking my right to remain silent.”
Simply staying silent will not invoke your right to remain silent. As absurd as this is, you must explicitly say that you are invoking your right to remain silent in order to invoke that right.
3) “I am invoking my right to an attorney.”
As stated above, you must be not only clear and unambiguous, but clear and legally unambiguous. Don’t get cute. Don’t get sassy. And on the flip side, don’t get intimidated and use verbal ticks to minimize your request. Say the line with those words exactly – say it clearly, and say it once, and then say nothing else.
Because even after you’ve done all this, the police can still try to get you to talk. They’re not supposed to interrogate you, but they’re allowed to make casual conversation, and if that conversation just happens to circle back around to the thing they wanted to question you about, well, that’s really your fault for talking after you said you wouldn’t, isn’t it? Can’t possibly fault the poor officers when you initiated – if you really wanted to have your rights respected, you wouldn’t have talked to them in the first place.
The police know this, and they will mercilessly exploit this loophole. So, once you’ve successfully invoked your Miranda rights, any and all conversation you have with police officers will put those rights back into jeopardy.
Putting it all together:
Ask: “Am I free to leave?”
If they say no, say: “I am invoking my right to remain silent and I am invoking my right to an attorney.”
And then shut up and do not say a single thing to them for any reason whatsoever until you have actually spoken to an attorney. Yes, even if it takes hours. Yes, even if they start talking to you about something else.
Finally, a very important disclaimer:
I may be a lawyer, but I’m not your lawyer, and I cannot guarantee that what I’ve just laid out here will always work for every situation. We didn’t get to this bizarre and absurd place overnight – we built this ridiculous system piecemeal, by deciding on a case-by-case basis that certain phrases were “too ambiguous” or certain types of questioning weren’t actually questioning at all. The law is still in flux, and is still fundamentally out to get you, and willing to bend plain meaning beyond all recognition to do it. Even if you invoke your rights perfectly, exactly as I have specified above, there’s a chance that your invocation of rights will be disqualified on some new technicality that no one’s even thought of yet – and that’s precisely the problem.

I am begging my followers to please watch this video from start to finish. I know it’s long, but it is incredibly valuable information that everyone needs to know, especially if you’re involved in any form of activism.
Every single cop lies. Every single cop lies and manipulates and twists the situation around to get a confession. Even when they know that the person is innocent, even when they know that what they have isn’t enough to convict someone, even when they know that that confession has been made under duress or manipulation. All they care about is getting anything to put someone behind bars.
It doesn’t matter how eloquent or innocent or experienced you are. Do not talk to cops.
The video is a doozy. Aside from all the good advice, the racist dog whistling from the officer really jumps out. In fact, his whole segment was pretty effective to drive home the point that officers are literally trained to manipulate you and fuck you over. He does say he doesn’t “try” to put innocent people in prison, but he never says he tries to keep them out either. He also explicitly states that he destroys material that could be helpful to you.
In short, DO NOT TALK TO COPS.
Cops are only your friends if you have money to back you and maybe not even then. They work for a system that has been bent and twisted to serve that only betters themselves than aid those most in need. Then question why so much distrust to thrown around when they just further sow seeds in the next generation. There are good cops drowning and pushed aside cause connections mean more actual moral ethics. Lawyers are hardly any better, but in order to survive you have to use the system against itself.

antiracism is a constant process. i was raised in a racist village and it's not easy to get rid of it. i moved away over 10 years ago but those ideas are still haunting me.
also keep in mind that shame + guilt are not conducive to growing as a person. when it comes to "checking yourself" it should be a non-judgemental process. it's not about flagellating yourself for every bad thought or trying to purify your mind of all corruption. it's only when acknowledging your own racist thoughts doesn't fill you with dread that you can really progress past the white guilt of it all.
radical self-acceptance & genuine self-critique are not opposites. they need each other. do not let obsessive-compulsive behaviors colonize your desire to grow as a person.

The reason I call myself a tomboy now, despite it being seen as a childish word and having had someone swear at me over it because ‘tHeRe’S nO suCh thInG as BoY thInGs anD giRL thIngS sHut uP’ is because I couldn’t call myself that or be like that when I was a kid. It was seen as a negative thing and I was already bullied enough. “Looking like a boy” was the worst thing that could happen to a girl.
And I’m not even 26 yet. We aren’t talking 30+ years ago, we are talking 2000s and even 2010s. It’s only since trans people have become more accepted in the past few years that gender nonconformity has too.
And the people who helped me accept my gender nonconformity more than anyone else? Were trans people. They taught me, “there’s nothing wrong with how you feel. You’re still a valid woman no matter what you wear, how you have your hair or what you’re into ❤️”
And don’t even get me started on how people treat gender nonconforming men. JK Rowling has a lot of nerve to be like “uwu boys can wear dresses and only us gendercrits accept that!” when she has, even in recent works, made femininity in men a negative trait, as well as making masculinity in women a negative trait also.
A lot of people still don’t accept gnc people even now. Just last year I had someone tell me they’d never let their daughter “dress like a boy”, and I’m always terrified to walk into a bathroom in case the next JK Rowling is in there, sees my gender expression and pepper sprays me or worse.
“There’s no such thing as boy things and girl things.” I don’t need to be told that and I’m sure 99% of trans people also don’t need to be told that. Tell that to the society that hates us both instead of actively encouraging that hate.
Gonna point out the og tweet thread is now full of terfs saying that life was better for gay people in the fucking 80s, that it was super easy for them to be a tomboy in the 70s and 80s and therefore it must have been that way for everyone, and that it was totally acceptable to be a gnc gay person in the 80s! 🤪
They’re rewriting history as we speak to try to argue trans acceptance is making it harder to be gay and gnc for youth than it was to be gay in the 80s. This is a blatant lie.

Hell I remember back in 2016 I was going to stand in a quince (last minute addition) and during practice (idk how that convo came to be, everyone talks to my mother about anything) the father to one of the other girls were starting making comments. How he's glad his daughter is doing something feminine cause she wears hoodies and jerseys so he's worried that she's a lesbian. How he wants grandkids and doesn't think anyone would want her for being who she is. My mother (blunt no filter and likes to drag me into convos) said I'm the same way but that I at least dress how I'm told for certain occasions (it was just easier to go along than argue). Reassured that man that it might just be phase, and it doesn't mean she's a lesbian it's just as my daughter says, guy clothes are just comfy. Me and that girl just look at each other and said yeah cause it's comfy. (Not that I had to actually bargain or beg or have hand-me-downs from my uncle for guy clothes and only allowed to wear around the house otherwise I'll get endless side comments from family)
The guy still looked uneasy but was comforted he wasn't alone in this struggle with daughters and guy clothes. My mother than went on and said how I was one of the best in martial arts class and even at tournaments. He had that gall to ask if the genders were separated and if the guys ever took it easy on me. (I'm hella short and everyone said unassuming in appearance to be an actual threat) My mother was annoyed, she was a black belt when she was younger, and showed him a video of me at a tournament and pictures of my trophies and asked if that guy I was fighting had won easily. There was no guy in the video other than the judge, it was me but everyone says I fight like a guy. They say that's a compliment but I personally never liked that. I've fought guys and not all were good, some of the girls fought way harder and left me bruised ribs through the padding. I fight to win regardless of gender facing.
Still that man was making comments up until he left and next time I recall seeing him was that the actual quince and how he's happy to see his daughter in a dress. Idk how she's doing now, but I hope she can dress without anymore comments. As for me I still feel self conscious at what I wear sometimes, but at least it's not limited to just one style and color palette.
So no there's never been a good era, only people that are willing to accept and not make a big deal out of it. Unless to tell you that's not your shade of color or that may not actually be your size and try other options.
