One: The initiative knows jack squat about demons. The only way they can tell a humanoid demon apart from a human is to see some demonic feature, or thermal scanners to recognize vampires. Otherwise they just grab anyone that looks funny. They certainly don't have any tech to recognize human vs nonhuman that's small enough to fit on a computer chip in the brain. That means, the only way the chip knows the difference, is if SPIKE knows the difference (which makes it all kinds of faliable. And calls into question it not working on post resurrection Buffy. Does he consider her an angel, lol?)

2: it's not connected to any sort of power source other than Spike's brain itself, which means ( to my layman mind) the only way it works is if it's taking the very specific electrical impulses from spike's brain, only triggered when he thinks he's hurting specifically a human, and making his brain think its electrocuting itself.

3: it would be hella easy to fry it.
