The definition of gender he used,   “…how you identify yourself and your experience…”,  was not a product of even the social sciences, but the navel gazing you’ll find in gender studies. Not that the social sciences can do more than study how society deals with it.

He also claimed “sex was a spectrum”, not just gender, citing the existence of intersex conditions…

1. Being asked those questions is not “being victimised" or “demeaned”, and they are not intended to be “accusatory” in nature. They are necessary to collecting as much information as possible so that the case can be properly assessed. Everyone in this girl’s situation will be asked questions like this, regardless of what their gender is or their circumstances.

2. The accused person has the right to be considered innocent until proven guilty, regardless of what crime they have been accused of and who has accused them of it. Bare in mind that as far as the university is concerned, this woman may be lying, and he may be proven innocent. In which case, it would be unfair to ruin his life before this case has concluded. Having this attitude of “I claimed that he did something bad. I know we haven’t confirmed that this is true, but why isn’t his entire life fucked up yet?? Why didn’t you just immediately listen and believe??” is actually pretty fucked up and entitled.

3. The accused is just “accused” at this point. The authorities cannot assume someone to be definitely guilty based just upon an accusation. (see point 2) It would be unfair for them to immediately treat him like shit when no evidence had yet been brought forward and no judgement had been made in court. Notice how she says “instead of accusing him of anything…”. It is not the authorities job to accuse people. It is not their job to immediately side with the supposed victim. It is their job to remain impartial and unbiased, and treat both the accused and the accuser as innocent until proven guilty, as is both of their rights.

4. Those authorities were not speaking calmly/gently to him because they favoured him, or because they think what he has been accused of doing is somehow okay. They are speaking to him like that because that is what they are supposed to do. It would be unprofessional of them to view him as a rapist upon an accusation alone, and it would, again, be against his human right to be considered innocent until proven guilty.

5. “This man raped me and the police told him not to sweat it”. No, this man was accused of raping you. There is a very important difference between someone being convicted of a crime and being accused of a crime. Anyone can accuse someone of raping them. If the police jailed everyone who was simply accused of doing something, not only would we be living in a nightmare world where no-one has any kind of human rights, but I’m pretty sure 90% of the population of the earth would be in prison over some accusation or another.

Let’s propose a hypothetical situation here. What if you were a completely innocent person, an upstanding member of society, and then out of nowhere someone accused you of rape and your life was immediately ruined?

How would you like it if you tried to speak to the authorities but they wouldn’t listen? Or if they treated you like absolute shit and assumed you were guilty, even without any evidence at all? And to top it all off, your university immediately kicks you from your course and destroys your hopes and dreams, all before a smidge of evidence is brought forward against you?

This would be hellish. It would be completely and utterly unfair, and you damn well know it.

Unfortunately, this situation is the reality for many boys and men accused of rape, even when (and after) they are ultimately proven to be innocent.

these are the standard punishments for rape in most countries.

All it takes is a “stop”, or a “stop I’m not feeling this anymore.”

You missed the part where the fucker needs to have some way of knowing that the fuckee has changed her mind. Saying no, using the “safe word” (or “safe sign” if gagged), pushing them away, would all be sufficient. 

If the fucker has no way of knowing that consent is withdrawn then the fucker does not have any moral responsibility. The fucker in this hypothetical situation has already received positive consent, we are not talking about the old situation in which it was “not rape because she didn’t say no”.

Doesn’t address the issue of it being considered rape if she makes no effort to ensure the other person knows she is revoking her consent.

Conflation of discomfort and revoking consent.

I do lack “basic human empathy skills“. An advantage as far as bitching at people goes.

Whether someone would have a mature reaction is irrelevant to whether it can be considered rape if no effort has been made to communicate the revoke of consent.  Do we need to go into mens rea?

Their issue is not with such a hypothetical scenario, their issue is calling the outcome of that scenario rape.

We aren’t talking about a positive consent standard. We are talking about consent being revoked without it being in any way communicated, and these feminists saying that it is rape. With the usual fall back to “it’s the victim who decides it was rape”, which leads to the obvious reductio of post facto revoking of consent.

They have not missed the point. They have given an example of why you cannot have criminal liability applied to such intuition. Essentially it is a reductio ad absurdum. 

No one mentioned “women setting traps “ or “false accusations”. The succinctly described why such a standard for rape would be manifestly unjust. You simply have no real reply to that situation.

And for the record the shift to a positive consent model has been used for the purposes of malicious false accusations and malicious prosecution. Kevin Ibbs is the example from my neck of the woods. And that was without there being an expectation of telepathy.

You are supporting the position that such a situation would be rape. It is not unreasonable to assume that you would thus support prosecution in such a situation. And if you do believe that it is rape and should be prosecuted as such, then you are supporting the prosecution and imprisonment of people who have had consent withdrawn without it being communicated.

Normal men don’t think its their “birth right” to rape women. The normal, average man in a first-world country doesn’t think rape is okay, and doesn’t think he is entitled to it.

Rapists don’t rape because they think it’s okay to do so. They know it’s wrong and they do it anyway.

And honestly, what the shit - what woman in the first world genuinely thinks they have no rights?! I’ve got good news for you oblivious lot, women have all the legal rights men have, and then some. What more do you selfish people want?
