I havenât talked about what has been happening in Romania lately, but itâs not okay. The current ruling political alliance (a central-left coalition) has just adopted some amendments to the Criminal Code (in the evening of June 18th 2018), that makes it much, much harder for prosecutors to actually do their jobs. Itâs basically, an attack on the judiciary wing of the state. These are some of the amendments that have been approved last night:
* if evidence from a recording is obtained illegally, the prosecutor has to destroy it and attach the confirmation of this move in the court file. In addition, the preventive arrest measure can be ordered only that there are solid evidence or clues. The âreasonable suspicionsâ notion for issuing a preventive arrest warrant has been removed. * same goes for witness protection - reasonable suspicion isnât enough anymore, there has to be clear proof in order to issue witness protection * suspects and accused will be allowed to attend witness testimonies * prosecutors will need to bring charges against someone under investigation within a year for the case to go to trial. * suspects that are wiretapped will be informed by prosecutors about this measure up to 10 days after it was completed. * the package of changes also makes it harder to hold a suspect in custody. * authorities will be forbidden from making public any kind of information about persons or charges included in criminal cases during the prosecution and trial stages; journalists are banned to report on ongoing criminal cases, which is a hindrance on freedom of speech. * the final court decisions can be challenged on the criminal side. MP Stelian Ion, a member of the Union to Save Romania (USR), claimed that this amendment will allow PSD head Liviu Dragnea to ask for a retrial in the file in which he got a 2-years suspended jail sentence. * the only way to appeal a sentence is if new evidence has been uncovered - this goes against the principle of an appeal
* long story short: these amendments will restrict prosecutorsâ scope to investigate suspected wrongdoing and benefit convicts and felons
So⌠yeah. Iâm expecting protests to take place in the next few weeks. Theoretically, these changes can be attacked at the Constitutional Court, but, seeing that theyâve been trying to pass them for a long time, I donât see anything changing for the better. Weâre effectively screwed and, very soon, we may see a president who has had an indictment for charges of incitement to abuse of office and forgery.

* if someone is sexually assaulted/abused, they will be forced to produce a testimony in the presence of their abuser * if someone breaks into your house, and you have surveillance cameras, the video capturing the robbery may not be used at trial * if a judge grants a verdict, thereâs no appeal possible without new proof

i think some context is necessary for people who arenât familiar with romaniaâs current political scene: romania has major, major problems with high-level corruption. i cannot stress enough how severe these problems are. politicians who have committed some type of fraud and have been convicted/(currently) under investigation include: the president of the chamber of deputies and leader of the current ruling party, the president of the senate, one of romaniaâs former prime ministers, who was also allowed to run for president in 2014 while in office and effectively in control of the electoral process, and so many mpâs and local politicians that iâve honestly stopped keeping count.Â
like, i want to make this as clear as possible: these politicians have been investigated, tried and frequently convicted for fraud, perjury, embezzlement and misuse of public funds - weâre talking hundreds of millions of euros that were supposed to go into infrastructure, education, healthcare and rural development - and they are still allowed to keep their offices. the social democratic party is chock full of these people. the partyâs leader, liviu dragnea, de facto the most powerful politician in romania right now, was convicted to 2 years in prison for electoral fraud. the sentence was commuted so that the sentence stayed in place, but he doesnât have to actually serve those 2 years. all the while, he was allowed to hold high public offices and now effectively controls both the parliament and the government.Â
liviu dragnea and his cronies are pushing self-serving laws through the parliament and crying about being victims of human rights abuses the moment they are threatened with legal consequences. lately a common theme in their public discourse has been to compare romaniaâs judicial system, and especially the national anti-corruption directorate, with the communist secret police. they also openly attack news outlets and journalists who donât serve their interests.
so this isnât some inconsequential thing. this is about convicted criminals passing laws that allow them to commit more crimes. this affects romaniaâs economic development, judiciary independence and our credibility with the european union and other external partners.
@books-and-cookiesâ is right - we need visibility, because we are doing our best to fight them. weâve been protesting political corruption in the street for years now, with very little international exposure. we deserve the same public indignation, support and sympathy americans get every time something goes wrong.
