i believe that in its standard form, a jaffa cake, in spite of its name, can be counted as a biscuit (we're talking the british definition of a biscuit, not the American, because those are scones)

however, were the jaffa cake to be a different shape, proportion or size, i believe the jaffa cake would be a cake, within reason. of course, smaller, it would not be, but rectangular, for example, it could be.

the jaffa cake bar would be a cake. it is shaped like a small loaf cake and i feel there's more of its sponegy layer to the orange and chocolate topping than in the original biscuit form. also, the jaffa cake bar is on much packaging, referred to as a cake bar from under the branding of jaffa cake

also, were the jaffa cake to be bigger, it would be a cake. ideally, to be a perfect cake, it would need a reasonably thicker sponge layer to chocolate and orange layer compared to the original biscuit. howerver, if the proportions remained the same and the jaffa cake big form, being a cake, is just a scaled up version of its biscuit form, it would still be a cake, but perhaps less of an ideal one

in summary, a jaffa cake is a biscuit, unless it is not in its original form (with the exception of being smaller)
