Robert Eads was a transgender man who transitioned later in life and as such it was deemed inadvisable for him to seek sex reassignment surgery. He was diagnosed with ovarian cancer in 1996 but was refused treatment by more than a dozen doctors, some for personal reasons and others on the grounds that taking him on as a patient might harm their practice. When he finally found a doctor to treat him in 1997, the cancer had already metastasized to other parts of his body, rendering any further treatments futile. He passed away in 1999. His life and death was the subject of the award-winning documentary Southern Comfort (2001).
As iām sure many of you have heard, the Trump administration just passed a ruling that would remove LGBT+ anti-discrimination protections in health care and health insurance. I immediately thought of this manās story when I heard about the ruling. Stories like this are the reason why those protections are necessary.
Itās easy to feel hopeless with all the bad news our community has been bombarded with recently. But we have to keep fighting, and one way we can fight is through legal means.

Today, Breonna's law was passed. This is a step in the right direction. Next one is to hold people responsible for her death and arrest her murderers and everyone involved in the attempt at cover-up.
I had legitimate tears in my eyes reading what Kenneth, her boyfriend, had to to through after Breonna's murder. That man was being framed for something he didn't do, all after losing his most important person.
It was that easy to jail and charge him on false claims. Why are her murderers still walking free and an innocent man spent time in jail because of a false testimony?
That's time in his life he will never get back, but you know what he'll also never get back and that's also directly on the police? Breonna. And most importantly, Breonna had her life taken from her over a police "mistake". It's time to see the culprits punished.
Breonna Taylor deserves justice.

While the officerās charges have moved up to second degree and the other three officers are being charged, donāt let the movement die. Our work is far from over. Black people are still far from safe and we are still far from free. However, donāt ever let people tell you that protesting doesnāt work. Donāt ever let people tell you that making noise does nothing in the end. This is history being made right in front of our eyes, but we canāt let it go now. Keep talking, keep donating, keep petitioning, keep protesting, keep sharing links, keep working. Black lives still matter!

Personally, I think these kind of ādealing with police at protestsā guides tend to get a little academic. Hereās a simplified guide...not trying to talk down by cutting down on the academic nuance of case law, but Iāve yet to see one with an emphasis on practical stuff you can memorize and remember on the spot...all informational and not legal advice etc.
1. āam I free to leave?ā or āare you detaining me?ā You all know this one. But what to do next? If they say āno youāre not free to leaveā or āyes Iām arresting/detaining youā apply #2 below. if they say you are free to leave: you can retreat. If your organizers have made the strategic decision and asked you to stand your ground...thatās a risk-assessment that is up to you and them. All I can say is: if they tell you that youāre free to go but you keep protesting and they approach you again later and try to engage, then ask the question again. Repeat every time a cop approaches you and tries to engage with you. Do not say more words. Do not explain yourself or talk back. Be polite and calm.
2. If you are detained/not free to leave, youāre arrested as far as the constitution is concerned even if they donāt say āIām arresting you and reading you Miranda rights.ā Now you say: āI am now invoking my right to have an attorney present.ā That is all you ever need to say to a police officer if they ask you a question. This does not mean you get an attorney. It means they cannot ask you any question unless and until they provide you with an attorney. You do not need to say anything else. I know this is insane but you get more rights if you ask for an attorney than if you say āi am invoking my right to remain silent.ā I guess you can say both for a marginal benefit. Canāt stress how important it is to say the attorney thing. (You do not legally need to say it more than once until they get you an attorney, except try to say it again in front of new people/officers so they canāt deny you said it...if/when you get an attorney, ask that advise you on any police attempts to question you again outside of the attorneyās presence. Youāre likely to be released from jail without getting an attorney because questioning you is not worth the price of an attorney).
3. āNo, I do not consent to you searching my bag/phone/whatever.ā Doesnāt matter whether this question is posed to you before or after they say you are āno longer free to leave.ā The answer to ācan I look at your phone/pockets/whatever?ā is always āno.ā Never resist the officer if they start to search anyway but assert repeatedly, calmly, and loudly that you do not consent to their search (depending on the context, your consent may or may not be irrelevant to the legality of their search but itās important to assert this and leave that analysis for later....)
4. Bonus: if you are filming the police, stand at a safe distance so they canāt accuse you of interfering with police work and apply #1 and #3 as needed. If youāre an experienced protestor you can try āIām standing far away from you. I am filming publicly visible events that are unfolding in a public space.ā Do not engage if they talk back, keep applying the tools above.
Unlike the categories above, which are all attempts to invoke constitutional protections stemming from the 4th and 5th amendment, your legal rights under #4 depend in part on state recording laws. State laws banning one-sided recording may or may not violate the First Amendment when applied to filming police activity, but by saying the above you (a) remind the police (in states with no recording ban) that you are not doing anything illegal or (b) creataing a good record to argue the recording ban (if any) in your state doesnāt apply where thereās no privacy (usually) or is unconstitutional. No matter what the law in your state, the police cannot delete stuff from your phone btw
