So, a hate crime is any crime that is done to a person where the perpetrator/s was/were biased against the victim for some reason (race gender sexuality etc etc etc).
Technically, drawing a swastika on someoneâs face isnât a legal crime, I donât think(?), but there are things that fit into the broader category of hate crime without technically being crimes. For a relevant anecdote, a couple years ago when I was in high school I found that someone had carved a swastika into the wall of one of our only gender-neutral bathrooms. (For those of you wondering, yes I reported it, no the admin didnât do shit even with photographic proof.) Was any crime committed there? No, technically, but I donât think anyone can argue with a straight face that whoever did that to the bathroom wall wasnât committing a hate crime. You get it, hate crimes donât necessarily have to include a prosecutable offense.
I feel like this was a hate crime done to him, for a couple reasons.
1. He was, to my knowledge, the only POC in the area
2. I have heard (take this with the knowledge that I am not Canadian or from the area, this knowledge is exclusively from people who are and is not firsthand) that it is a pretty conservative area. Thus, especially as of a decade ago, filled with shitheads and monsters who think itâs âedgyâ (not an excuse) or what the fuck ever to draw swastikas on peopleâs foreheads.
3. It was in the middle of the woods and he was drunk, aka not in a proper state of mind. I have been drunk before (only once) and will tell you that if my friends started drawing symbols on my forehead in permanent marker I would not be able to identify them in time. Even if he did know what was happening (highly unlikely), what the fuck is he going to do, go against the crowd of white people with way more social capital than him who likely all agree with each other or are at least willing to go along with each other WHILE IN THE MIDDLE OF THE WOODS WITH (as far as I can see) NO ADULTS OR ANYONE ELSE HE COULD TRUST TO HELP HIM? Hell no.
Obviously, a swastika is motivated by hate. I donât need to tell anyone that. But doing it as a âprankâ to the only kid of color feels very very intentional.
To sum it up: doing this to the only kid of color, when he had no idea it was happening, wasnât in a proper state of mind, and didnât have a ton of power to safely say no even if he did = hate crime
But honestly, everything I just said is icing on the cake. My main concern with this regarding hate crimes is the sharing of the image at all.
I believe the sharing of the image itself was racially motivated and not done in good faith, and by taking it as though it was we are playing right into their hands.
Let me start this part off with agreeing with you. I was freaked out when I first saw the image. I can imagine you were too, and frankly I hope everyone was. We can all agree here that, on its own, with no context, this is an incredibly shit look and iffy to say the very very least.
But, let me add in some context. Youâre in the fandom, which (presumably) means you have seen how Hudson and Connor have been treated prior to this incident. You (presumably) were not blind to the rampant racism that was taking place. And I will also assume you know what itâs like to have your lifeâs work picked apart for the slightest flaw, to have people desperately look for anything to discredit you, simply because you were darker than them and they couldnât stand to see you doing better than them, to see you respected, to see you treated as an equal. I am sure you have noticed the comparable lack of scrutiny towards Connorâs personal life history.
This was only the latest part in a long series of racially motivated attacks against Hudson. Itâs just just this, they were trying to start other shit on Twitter (which I do not have) and also are potentially planning / were planning to pay someone to falsely accuse him of rape if this photo doesnât do what they want it to (drive him off the face of the earth). Thereâs a really long post somewhere that details all of this with ample proof. Itâs very disturbing, but also spells it out very clearly. This is clearly, while not a legal crime (probablyâ it might cross the bridge into harassment, I donât know Canadian law) a series of attacks committed against Hudson Williams because they are biased against him due to his race.
To sum it up: harassment + done due to a racial bias = hate crime
