Sa mga nagdaang araw ay sumikat sa lahat ng anggulo ng media ang kaniyang anak na si Lowell “Boyet” Menorca II nang mag-eskandalo silang mag-asawa sa media at pahirapan ang mga pulis maynila na nagserve ng warrant of arrest sa kaniya sa kasong libel.

Ano ang Libel?

Art. 353. Definition of libel. — A libel is public and malicious imputation of a crime, or of a vice or defect, real or imaginary, or any act, omission, condition, status, or circumstance tending to cause the dishonor, discredit, or contempt of a natural or juridical person, or to blacken the memory of one who is dead. (Revised Penal Code of the Philippines)

Ang libel ay paninirang puri sa paraan ng pagsulat o paglilimbag. At ang kasong ito ay may kaparusahan na pagkakakulong na ang pinamabigat ay aabot nang anim na taon.

Sinasabi ng LP Senatorial Candidate na si De Lima  na:

“If the basis is the video taken by Menorca’s party, which shows Menorca being dragged by a man in civilian clothes and slippers who was claiming to be a police officer, then that arrest is highly irregular,” she said, referring to the video of the arrest taken by Menorca’s wife, Jinky Otsuka.

Pagbigyan na si Madam, kailangan niya kasi magpapansin sa tao para madaling ma-recall ang name niya, good or bad, para manalo sa eleksiyon. Tama nga naman na kung ang batayan lang ay iyong selective shot ni Jinky Menorca ay tila baga wala sa ayos ang pagkakahuli kay Boyet. Pero tandaan natin na sinabi ng PNP na justified ang paghuli ng ununiformed arresting officers dahil evading o umiiwas si Boyet na magpahuli.

Sabi pa ni De Lima:

She also cited the force used to get hold of Menorca, who was being arrested for a nonviolent crime.

“This was an arrest for libel. It was not as if Menorca was wanted for a heinous crime, like illegal detention or kidnapping. It was plain hooliganism on the streets,” said De Lima, a Liberal Party senatorial candidate in May’s general elections.

Sa pagsasabi niyang ito ay hindi heinous crime ay nais niyang ipahiwatig na magaan na paglabag lamang ang kaso ni Boyet Menorca.

Ano ba ang pinagbatayan ng SCAN members na nag-file ng kaso laban kay Boyet Menorca?

Ito ay ang ipinahayag ni Boyet Menorca sa Media noong Oktubre 28, 2015 at nalathala sa mga pahayagan na mayroong “hit squad” sa grupo ng SCAN International. Panoorin ang video:  INC Hit Squad

Alin ba ang mas mabigat na libel? “Nagtago sa ilalim ng kama” o ituro ang isang grupo “na nagsasagawa ng extra-judicial killings”?

Noong Oktubre 1992 ay hinatulan ng korte ng dalawang taong pagkabilanggo at pagbabayad ng ₱2M for moral damages ang kolumnistang si Louie Beltran dahil sa isinulat niya sa Philippine Star na si Presidente Cory Aquino ay nagtago sa ilalim ng kaniyang kama sa kasagsagan ng coup d’ tat noong Disyembre 1989.

Sa tinamaan ng magaling na si De Lima: Mali ba yung ‘nanay ng boss mo’ nang kasuhan si Louie Beltran ng libel? 

Ang pagsasabi sa publiko na sa SCAN International ay may nagagamit upang rumesbak, magsagawa ng extra-judicial killings o umakto bilang hit squad ay isang paglabag sa kalayaan ng malayang pagsasalita. Ang pagbibigay ng mga malisyosong pahayag sa publiko ay itinuturing na isang krimen sa batas ng ating bansa at ito ay lalong pinatindi sa kasong “online libel” na isinasaad ng Republic Act 10175 “Cybercrime Prevention Act of 2012”. Sapagkat kung sa libelo na nakapaloob sa Revised Penal Code ay hanggang 6 na taon ang maaaring ikabilanggo, sa kasong “online libel” ay maaaring umabot sa 12 taon.

Matalino si Boyet Menorca na malusutan ang mga libel cases na iyan. Kung tig-₱10,000 per kaso ay magaan sa kaniya sa dami ng kaniyang resources. Hindi na lingid sa inyo kung bakit – sa ngalan ng ama at sa ngalan ng Iglesia.

Subalit huwag nating kalimutan na may mas mabigat pa na kaso kaysa sa libelo. Ang kasong libelo na ikinaso sa kaniya ay panglupa lamang. Ngunit ang kasong ikinatiwalag niya ay mas mabigat na parusa ang katapat.

Napakabigat na kaso ang pagsasalita laban sa mga inilagay ng Diyos na mangasiwa sa Iglesia:

Nagningas ang galit ng Diyos kay Miriam at Aaron nang sila’y nagsalita laban kay Moises (Blg. 12:9, 1-2). Sila’y pinarusahan (12:3-10).

Hindi minabuti ng Diyos ang pagpupulong nina Core, Datan at Abiram laban kay Moises (Blg. 16:1-3, 8-11). Ang pasiya (Blg. 16:20-27). Ang parusa (Blg. 16:28-35).

Hindi rin pinagpaumanhinan ng Diyos ang “pamamahiya” ng 42 na bata kay Propeta Eliseo. Niluray ng 2 osong babae ang mga bata (II Hari 2:23-24).

Sa Panahong Cristiano ay pinatutunayan na ang hindi nagpapasakop at walang takot na magsialipusta sa mga pangulo o nangangasiwa ay walang pagsalang lilipulin batay sa II Pedro 2:10, 12.

10 Datapuwa’t lalong – lalo na ng mga nagsisilakad ng ayon sa laman sa masamang pita ng karumihan, at nangapopoot sa pagkasakop.  Mga pangahas, mapagsariling kalooban, sila’y hindi natatakot na magsialipusta sa mga pangulo: … 12 Datapuwa’t ang mga ito, na gaya ng mga KINAPAL NA WALANG BAIT, na ipinanganak na talagang mga hayop upang hulihin at lipulin, na nagsisialipusta sa mga bagay na hindi nila nalalaman ay walang pagsalang lilipulin sa kanila ring pagkalipol.

Wala tayong karapatan na siyasatin ang Pamamahalang inilagay ng Diyos sapagkat maliit lamang ang pagsisiyasat ng tao batay sa I Cor. 4:3 at 5. Ang kanilang karapatan ay hindi tinanggap ni sumangguni sa tao (Gal. 1:11, 15-16).

Ang Diyos lamang ang may karapatan sumiyasat sa Pamamahala (I Cor. 4:4).

Buhay ang Diyos ng Iglesia! Kahit malusutan ng walang utang na loob na aroganteng Boyet Menorca ang mga kaso sa kaniya ay hindi siya paliligtasin ng Diyos pati ang mga kasabwat niya sa Araw ng Paghuhukom. Sapagkat ang pag-alipusta, pagpintas, paninirang-puri at pagapastangan sa Pamamahala ay napakabigat na kaso laban sa Diyos na siyang naglagay sa Kaniyang Pamamahala.

A more serious offense than libel

If Brother Lowell C. Menorca, former Administrative Secretary during Ka Erdy’s time were still alive, he would clearly never allow the actuations today of his son. I knew Ka LCM from the time when he was Pastor of the Locale of Balut (Now H. Lopez, Metro Manila West), to the time he was entrusted with great responsibility in the Church, as Instructor for ministerial students, until he finished his race as Pastor of Ususan, Metro Manila South.

He loved the Church so well where he raised his family. His loyalty to Ka Erdy is the same recognition he gave to Ka Eduardo V. Manalo.

In recent months and days, his son Boyet Menorca became so popular after  he and his wife caused a commotion and scandal in the media when the arrest warrant was about to be served by Manila Policemen.

What is libel?

Art. 353. Definition of libel. — A libel is public and malicious imputation of a crime, or of a vice or defect, real or imaginary, or any act, omission, condition, status, or circumstance tending to cause the dishonor, discredit, or contempt of a natural or juridical person, or to blacken the memory of one who is dead. (Revised Penal Code of the Philippines)

Libel is defamation in the form of letter or print. And this case has a maximum punishment of imprisonment that will take about six years.

The LP Senatorial Candidate of De Lima stated that:

“If the basis is the video taken by Menorca’s party, which shows Menorca being dragged by a man in civilian clothes and slippers who was claiming to be a police officer, then that arrest is highly irregular,” she said, referring to the video of the arrest taken by Menorca’s wife, Jinky Otsuka.

Given the indulgence, for this Madam needs this opportunity for media exposure so that voters could easily recall her name, whether good or bad, just to win the election. She was right when she said that if the only basis of our judgment is selective video shot by Jinky Menorca it appears that there was something wrong in the arrest of Boyet. But remember that the police justified the use of non-uniformed officers because Boyet was evading arrest or running away from police authorities.

De Lima also stated:

By saying that libel case is not a heinous crime she may want to imply that Boyet’s offense is not a serious case.

What is the basis of SCAN members who filed a lawsuit against Boyet Menorca?

It was when Boyet Menorca declared on his interviews with members of the media on October 28, 2015 and was also published in the newspaper that there were element of the “hit squad” among members of the SCAN International. Watch the video: INC Hit Squad.

Which is the more serious offense? ” Hid under the bed” or accusing a group “that exercises extra-judicial killings “?

In October 1992, the court sentenced two years’ imprisonment and payment of 2M for moral damages columnist Louie Beltran simply because he wrote in the Philippine Star that President Cory Aquino hid under her bed during the coup d’ tat in December 1989.

To the amazingly talented De Lima: Wasn’t your boss’s Mom wrong when she charged Louie Beltran with libel?

Telling the public that the SCAN International has been used to avenge aggrieved brethren, conduct extra-judicial killings or act as a hit squad is a clear violation of the freedom of speech. Giving malicious public statements is considered a crime in the laws of our country and is intensified in “online libel” cases provided by Republic Act 10175 “Cybercrime Prevention Act of 2012”. Because if the libel contained in the Revised Penal Code is may take up to 6 years’ imprisonment, in “online libel” it can reach up to 12 years.

Clever Boyet Menorca can easily elude all the libel cases against him.₱10,000 per case is just easy for him considering the vastness of his resources. Obviously – in the name of the father and in the name the Church.

But we should not forget that there is an offense more serious than libel. The libel suit he was charged with is only an earthly matter. But the offense for which he was expelled from the Church corresponds a heavier penalty.

Speaking evil against the Administration placed by God is a very serious offense.

The anger of the Lord was kindled against Miriam and Aaron when they spoke against Moses (Num. 12: 9, 1-2). They were  punished (12: 3-10).

God was displeased with the assembly of Korah, Dathan and Abiram against Moses (Num. 16: 1-3, 8-11). The decision (Num. 16:20-27). The punishment (Num. 16: 28-35 ) .

God did not even pardon the 42 children when they humiliated Prophet Elisha. Two bears savaged the children (II Kings 2 : 23-24).

In the Christian Era, those who slander and despise the authority will be destroyed based on II Peter 2:10-12.

10 especially those who walk after the flesh in pursuit of unclean desires, and despise authority.

They are presumptuous and arrogant, and are not afraid to slander the angelic beings. 11 Whereas angels, who are greater in power and might, do not bring slanderous accusations against them before the Lord. 12 But these people are like irrational animals, born to be captured and destroyed. They speak evil of the things that they do not understand, and in their corruption they will be destroyed.

We are not in authority to scrutinize the Administration placed by God for the very little or limited things we know based on I Cor. 4:3 and 5. For the Church Administration’s authority is not received from man (Gal. 1:11,15-16 ) . 

Only the Lord Himself will examine and decide for His appointed Administration. (I Cor. 4 :4). 

Our God is a living God! Even if the ungrateful arrogant Boyet Menorca evades cases against him, God will never spare him and his companions on the Day of Judgment. Because contempt, criticism, slander, disrespect and mockery against the Church Administration is an enormous offense against God Who placed His Administration.

Been going to school pretty early before the actual class hours because our thesis is still incomplete. Yesterday's supposed to be another deadline and we didn't make it. One, our adviser is out of town and no hopes for him to edit our study and two, he already said we are still not ready to pass the full thesis.

Yesterday, I was in school for almost the whole day for thesis tallying in the morning and 6 p.m. Marriage and Family exams (which was a breeze, thank God.)

Mom's in Zamboanga until Saturday for work and I have to deal with three boys in the house. Ang pinaka-ayaw ko talaga yung di nashu-shoot yung wiwi nila sa toilet. Kabanas. Mahirap ba isakto yon? I wouldn't know.

So you guys prolly saw the pictures we had today! Super crazy! :) We were doing our thesis work inside the Varsi office for two days now tapos kanina, nilapastangan ni Jan B yung Tab ko. Sobrang vain!

Thesismates I've been with for more than a year. <3

I wrote our acknowledgement awhile ago and it's addictive. Can't help but to reminisce (ganun ba katagal?) the moments ng kalokohan, ka-siraan ng buhay at lahat lahat. Nakakaloka pala, di ako aware masyado.

Nagdecide na akong picture-an mga ginagawa namin ngayong malapit lapit na kami sa pasahan. Di ko na rin kasi mababalikan tong paggawa ng thesis and all (unless mag-aral ako ulit) so might as well. :)

Konting konti na lang, thesis. 

Today was a great day. I made it count.
