German abortion law
So, like probably a lot of you people I acknowledge american abortion law problems but I tend to distance myself from them because it's not my law. It's not my problem. In Germany (or your country), I told myself, it's different.
I just stumbled upon a court sentence where a gynecologist failed to diagnose a pregnancy in the 6th week. The patient sued the doctor for injury award and aliments. http://www.rechtsindex.de/…/4667-olg-oldenburg-frauenaerzti…
The case was dismissed.
Reason for that is that you don't have a claim to an abortion. In fact §218 StGB says that abortion is illegal. That means every abortion! But §218a StGB declares impunity if the doctor gives his consent within the first 12 weeks of pregnancy.
To make it clear: The abortion is still illegal. The government just chooses not to punish the crime.
I find that horrendous and I am still very shocked for I thought my country was different (better).
