The last couple Sherlock Holmes stories are still under copyright in the US. 10 short stories were published between 1923 and 1927. In the US, for works published before 1978, the term of copyright is 95 years from the date of first publication (you can blame the Mouse). The entirety of the ACD canon won’t be public domain until January 1st 2023. In the UK, copyright lasts until 70 years after the author’s death, regardless of how close to their death they wrote their works. The entire ACD canon went into public domain in the UK in 2000. Japan uses this same system.

The Doyle Estate is run by greedy bastard(s). When the Enola Holmes Netflix movie was announced, they claimed that the experience of ACD loosing his son in WW1 led him to write Sherlock Holmes as showing more emotions than he had before. They sued Netflix, as well as the author of the Enola Holmes’ books, which they had ignored for 15 years. While any reader of the original books will tell you that Holmes has never been an emotionless person and has always been a tad more progressive than his setting’s status quo, the defense used by Netflix was that such generic traits as kindness are not protected. While there is no concrete evidence of this, it has been theorized that such a threat of lawsuit regarding the American distribution of shows like BBC Sherlock is why Sherlock Holmes has been depicted as such as asshole in recent years.

The case against Enola Holmes was dismissed with prejudice, but all that means is this specific case has been dismissed permantly by the judge. Unfornately for Capcom, this means that the idea of Sherlock Holmes being emotional being something protected by the last 10 stories isn’t something that has been struck down by the court. It is not immunity for them, and even if the estate’s case is once more dismissed, Capcom will still have to pay to bring themselves to that point. Those already familiar with Sherlock’s characterization in DGS will know that the Doyle Estate can make the same claims as they did against Enola Holmes.
