The following was submitted by a reader in response to this blog:
i strongly urge you to submit the request in writing with proper documentation to at&t INCLUDING your intention of filing a small claims action - neither party is allowed to be represented by an attorney and at&t does not like having to spend the time & money for an employee to sit at the courthouse. if you need to - the court fees can be included in the amount being requested AND can also be waived based on income. too, if you can document the time & effort spent on these calls attempting resolution, etc. - i would add that to the small claims amount. google it up - i am pretty sure even 'the consumerist' site had a section on people suing such companies in small claims and how to proceed. i would also suggest for the more couch inclined that any local tv channels usually have a consumer reporter that enjoys such stories - remember - have your documentation showing your previous attempts and document why they owe you money (your service agreement saying 30 day period is valid to begin with).

How to deal with AT&T no matter how “nice” they act…
AT&T FAILs to give credit where it is due
AT&T owes me $348 and they have repeatedly denied issuing the credit, for over 3 months now. My wife returned her iPhone 4 several days after purchasing it, due to the nearly complete lack of service in Berkeley (see the rest of this blog for more on that). She was assured by the AT&T store representative that we would not be charged an early termination fee. Lo and behold, our next bill had a $348 fee assessed for early termination. Upon calling AT&T, they indicated the store had not made the proper notations that the termination fee should be waived. They called the store to verify the situation and told us we would be credited the amount.
Fast forward to the next billing cycle, and no credit. I called AT&T, and went through the same process described above, and was assured this should take care of it.
Called back today, just 2 days after the last assurance, to ask about another issue, and was informed that our credit was denied due to a lack of verification from the AT&T store that the phone was returned. WTF? We called the store yet again, verified the information, and created a new case for this credit. Think it will fly this time? I have little hope.
AT&T's record is irredeemable in my eyes at this point. There have been too many FAILs, too little customer service, and I have completely had it. I plan to defect to Verizon as soon as possible.
Crazy Overbill FAIL
Symptom: $466 Cell Phone Bill Service: Still Crap. Date/Time: 9/26/2011 Location: N/A
My bank account was debited $466 for my AT&T Bill this month. WTF? Is this some kind of ridiculous retribution for the fact that my wife pulled her account last month to switch to a provider that actually has cell reception in our town? Not to mention, she already spent several hours on this issue previously and was assured AT&T would credit our account for the erroneous charge. Looks like we'll be spending several more hours trying to straighten this out. Thanks AT&T. UGH.
Birthday Call FAIL

Domain Purchase FAIL
Symptom: Could not push out a text to a colleague Service: No Bars. Date/Time: 9/27/2011 2:16PM Location: Downtown Oakland, CA
Trying to purchase a domain name and need to consult with my colleague on the details of the purchase. He is not reachable any way but text right now, but my phone has 0 bars, so no texting for me. While trying to do this I notice that my text app on the iPhone is littered with little red exclamation points for all the attempted texts I have been unable to send recently. Thanks AT&T!

Extra Grocery FAIL
Symptom: Could not reach my wife to find out if she had already gone food shopping today. Service: No Service. Date/Time: 9/26/2011Â 4:30PM Location: Downtown Oakland, CA
Tried calling home, just to check and make sure my wife had not already picked up the groceries on our list before I stopped at the store on my way home. Could not call out. Got home, she had also purchased groceries. Thanks AT&T!

Dear AT&T Today, Wednesday September 14, is the fourth day I have been without a telephone service of any description. It appears that the service began to fail intermittently from about Friday 9th until the morning of Monday 12th, when it became permanently inoperable. Have any of your organization’s administrators attempted to navigate the AT&T website to lodge a repair request for a land-line telephone service? I suspect not.

I have not made many posts recently, and the primary reason for this is that I was out of Berkeley. Turns out AT&T has pretty solid service in Dallas, TX. Who knew? Immediately upon arriving home, my AT&T iPhone FAILED when I could get no service while on BART all the way from SFO to West Oakland. This included many outside areas, and the SF tunnel which is wired for service. WTF?
Today I left home to run an errand and could not call out all along Sab Pablo Ave When I finally got service, she had called me and left a voicemail. Then I got through to her and the reception was too spotty to carry on a conversation. Thanks so much, AT&T.
