The thing is we will never know the exact ticket sales for Tuesday’s canceled concert. Promoters will often release that information to brag after a sold out show, but are not legally required to release it and obviously would have incentive not to release that info if the sales were low.
So, let’s pretend for a moment that ticket sales were low…as a thought exercise. (It was on a weeknight in a notoriously difficult to sell out stadium. I really think this is possible.)
Running a huge stadium show with low sales would result in a massive deficit and huge financial loss from venue staffing, security, production coasts, as well as the pr hit to the artist and promoter.
Promoters rarely admit to canceling a show due to low sales, especially this close to showtime. It would open them up to massive corporate contract penalties.
The solution is to cite a vague illness. This would trigger Force Majeure, and tour insurance would cover the cost of the cancellation.
Also, promoters will often include a non-disparagement clause in their global touring agreements. This means Harry and his representation could be legally forbidden from saying anything that publicly damages the promoters brand.
Harry would either have to lie, which would open him up personally to be held liable for damages, as well as being morally wrong, or he could keep silent. Notice that his reps only comment is to point people to the LN statement. If you know anything about the current DOJ lawsuit then you know how complicated and evil these companies can be. I’m begging people to do some research.
This becomes even more interesting when you consider things like Harry’s personal situation, which is more complicated than most. It is also worth noting that his manager has financial ties to the promoter. (Possible conflict of interest)
Currently, even if fans brought a lawsuit. The information would not be made public. Anytime you buy a ticket you automatically waive your right to a public trial. You are forced into a mandatory arbitration clause that protects the companies and prevents incriminating evidence from being released to the public. (Monopolies are bad folks.)
There is also something called a corporate indemnity clause. This is a legal shield for the artist that states if the promoter forces a cancellation or issues a public statement that results in a consumer lawsuit, the promoter would have to cover 100% of the artists legal fees and cover any damages. However, it is so much more complicated than this because current law also would not protect Harry if it could be proved he knew the cancellation was not for illness, even if he is not legally allowed to contradict the promoter. It’s a catch 22. Harry has none of the power. Current law gives all the power to these big evil corporations.
Side note: this is also a thought experiment … but even if the concert was cancelled for another reason that we don’t know and understand, a general statement of tour illness is exactly how I would expect these companies to operate. Remember this is the only way to trigger tour insurance. (For LEGAL PURPOSES REMEMBER THIS IS ALL CONJECTURE.)
I can’t tell anyone how to feel. I personally trust Harry and hate that he is put in this situation. There is a whole lot more I could say, but this is all conjecture. We will never know what happened.
The only hope is that in the future the DOJ lawsuit is successful and the laws change.
