Austin, Texas – Over the weekend, Texas Governor Greg Abbott effectively ended the Texas operations of Redflex Traffic Systems, whose U.S. headquarters are in Arizona. In the aftermath of Abbott signing the bill, which was architected by Campaign for Liberty activists, many cities like Austin, Ft. Worth, Plano, Frisco, Garland and Sugarland have publicly announced that their red-light cameras are shut off and tickets will no longer be issued.

Campaign for Liberty of Texas Director Byron Schirmbeck spent all day Monday and Tuesday on the phone getting confirmation from the cities and the vendors about whose cameras are shut off and who has yet to comply with the law. “From my phone calls and speaking to an agent of Redflex, I can tell you that all of their cameras in Texas are now shut off,” said Schirmbeck. “Redflex no longer has any business here,” he continued.  Schirmbeck worked tirelessly during the current legislative session with bill sponsor Rep. Jonathan Stickland (Bedford, TX) to maneuver House Bill 1631 through both chambers and land it on the governor’s desk.

Last week, in a shareholder announcement, Redflex lamented that the loss of their Texas business would cost the company 13% of their of revenue and that “the enactment of Bill 1631 will have a material impact on the company’s financial performance.” Texas becomes the 17th state in the U.S. to place a ban on forms of photo ticketing, including red light cameras and photo radar. Also prohibited by the new law in Texas will be photo radar cameras attached to school busses. That news comes in the wake of the former CEO of a school bus camera operator in Dallas being sentenced to 7 years in prison and a $125 Million fine for his central role in a bribery scandal involving his company’s camera scheme.

Arizona Campaign for Liberty Director Shawn Dow says that the ban in Texas is a precursor for what he expects to see in Arizona. “What we are witnessing in Texas is a great victory for liberty and the Constitution,” said Dow. “Texas’s legislature has done what we have been asking of our representatives in Arizona for multiple sessions. I think the message has just been delivered to them that the people are fed up with these cities and towns snatching their hard-earned dollars and it’s time to put a stop to it here too,” Dow continued.

Anti-SCAMera activists got wind of an attempt by Glendale City Council member Lauren Tolmachoff to revive the city’s red light camera system which has been defunct for years.

Each member of city council, Mayor Weiers and their assistants were all sent an extensive packet of information ahead of last night’s council meeting where a revival of the previous red light camera system was being considered. This packet describes all the scandals, increased accidents, lawsuits and court cases that have been suffered by the major photo ticketing vendors in the U.S. The members then proceeded to vote it down.

12 News in Phoenix reported on the meeting and the fact that Glendale rejected the camera revival proposal after more information about the fatal flaws in the system came to light.

The 12 News report also reminded Arizonans that photo tickets are essentially just trash that they can throw out when sent in the mail but aren’t served in person:

"If you happen to get a red light ticket in the mail, you can actually ignore it," said legal expert Monica Lindstrom.

Lindstrom says you can essentially throw your red light ticket in the trash if it just shows up in your mailbox. Cities have to go one step further in order to make the ticket stick.

Scottsdale has shut down fixed speed cameras at 120th Street and Shea without any notice to the public. Eyewitness accounts from area motorists claim that the cameras are no longer flashing.

A quick check of Scottsdale’s city government website shows that they no longer list these cameras as part of their fixed photo radar locations. 

But why would they shut down these revenue generating machines without giving notice and without a plan to replace them?

In 2010, the cameras at Indian School and Hayden were "relocated” to another intersection to keep drivers guessing, at least according to Scottsdale Public Information Officer Mark Clark. However, at the time, other city officials disagreed about that statement from Clark.

Our source inside Scottsdale Mayor Jim Lane’s office told us that the reason that those cameras were removed is because an acquaintance of his had veered off the road and smashed his vehicle into one of the camera poles with so much force that the entire unit was left inoperable. The accident, caused by the camera, had taken it completely out of commission and left it on the ground. He told us that moving all of the cameras at that intersection was just a way to avoid calling the safety of the Scottsdale PD’s red light camera scheme into question.

Given that embarrassing situation from 2010, will The City of Scottsdale make a statement about why they are shutting down more cameras in 2017?

And more importantly will they tell the truth this time?

Regular folks have a reason to celebrate today. On Monday February 6th, 2017 a despicable criminal had to report to the women’s prison in Victorville, CA.

Of course, we knew all along she was stealing our money with the help of government cronies. But now in a stroke of real justice she’s being locked up.

Former CEO of Redflex Traffic Systems and Arizona resident, Karen Finley is going to be behind bars in a minimum security prison for 30 months.

Amen.

Her company stole from millions of motorists.

She instructed her henchmen to lie and bribe to get their way in Chicago and other cities like Columbus, OH.

Finley and those same henchmen were investigated by major newspapers and the FBI. Then they were exposed and indicted - Finley herself on 16 counts. 

And now they have to pay.

We have to relish real justice when it comes around, because things don’t always work out this way. Sure Finley and Redflex have stolen untold amounts of money through fraud that will never be recovered, but at least she and a few others now know what the inside of a prison cell looks like.

When Arizona’s Attorney General ruled that photo radar and red light camera systems had been operating illegally for 28 years, the stage was set for two scenarios. 

Scenario 1: The cities and towns still using SCAMeras give up the ghost and black bag their cameras before tearing them down to thunderous rounds of applause from motorists.

Scenario 2: (Reality) Cities and Towns do their best to hide the wrongs that so called “photo enforcement” has subjected their motorists to. Then they become exposed in ways they never imagined possible.

Since Paradise Valley has chosen #2, they have been subject to a whole new level of scrutiny for not only their SCAMeras, but also a system called HALO, which they tout as a brand new way for Redflex to tinker with signal timing and save people from themselves.

HALO is supposed to:

Extend the all-red phase for cross-traffic when it detects a vehicle could run a red light, according to a press release (from November 2015).

Well that sounds great on paper, but the problem is that Redflex, according to emails obtained by WarOnDriving, cannot prove that HALO actually works. In their words, to Paradise Valley Police Chief Peter Wingert - “this is a completely new concept that’s taking some time to get ironed out.” 

These emails were exchanged in March of 2016, a full 4 months after Paradise Valley announced that the HALO technology had been deployed at Tatum blvd. and Lincoln Dr.. That intersection is the largest in the town and is also equipped with combination speed and red light SCAMeras.

So those driving through that intersection, every day since mid November of last year have been a part of a technological experiment which affects red and green signal timing.

Don’t bother asking for an audit of how many times that HALO was activated by a so-called “red light runner.” According to the same email exchange with Chief Wingert, Redflex can’t provide those either.

So has Paradise Valley discontinued the use of this unproven technology (HALO) since March? Or are they still experimenting on live traffic and live intersection signals?

One week ago today, Arizona’s Attorney General ruled that photo radar has been running illegally since its inception, which spans 28 years.

Since that time, the 7 municipalities in Arizona that still use photo radar schemes to issue civil traffic tickets have been scrambling for answers.

News about lawsuits are forthcoming, but for now, all eyes are on the cities and what their plans are for shutting down photo radar.

Monday March 21st, PHOENIX, AZ:

Multiple cities in Arizona have been telling people making inquiries that they are no longer issuing photo tickets, also known as “notices of violations.”

Arizona Campaign for Liberty has asked that each city using Photo Radar immediately halt their programs in accordance with Attorney General Brnovich’s ruling on March 16th, 2016. According to the Brnovich ruling, each employee would need PI licensing. Below are the responses each city has given when asked:

Phoenix – City officials have said that their cameras are shut off, with the exception of those in school zones, but declined to explain which cameras they considered to be in that category

Scottsdale – On Friday March 18th, the mayor’s office stated that the city had stopped issuing tickets as of March 16th even though their cameras are still active

Paradise Valley – Town officials have not responded to any inquiries about their photo radar program through Redflex and eyewitness accounts on Monday March 21st have confirmed that the cameras are still flashing motorists

Mesa – Police officers working with photo radar vendor have answered over the phone that American Traffic Solutions refused to shut off their cameras after the Brnovich ruling, but the city has opted to stop processing the tickets. The city is also not pursuing ticketed drivers within the three weeks prior to the AG’s ruling

Chandler – The city of Chandler and their Police Department have refused to give an answer about their photo radar program

El Mirage – The city of El Mirage and their Police Department have refused to give an answer about their photo radar program

Star Valley – City employees are hanging up on calls related to their photo enforcement program

Local news in the Phoenix area, where the vast majority of the SCAMeras remaining are located, has been slow to report on the subject, with the exception of the local Fox affiliate.

The cities have very little choice in the matter especially when the issue reaches the courts.

Arizona Attorney General Mark  Brnovich issued a decision today that all Photo Radar Systems have effectively been operating illegally in Arizona since their inception.

The question that led up to this ruling was posed by Arizona Campaign for Liberty leadership during hearings in the Arizona House of Representatives in February and March of this year.

However, this is not new information. There is evidence in the form of a legislative memo from April 2009 which proves that both American Traffic Solutions (ATS) and Redflex Traffic Systems knew that they had been operating illegally since that time.

A.G. Brnovich’s ruling covers the following:

Photo Radar and Red Light Camera vendors are not exempted from the requirement to obtain Private Investigator Licenses in Arizona

This requirement is meant to protect the public from having their personal data handled by third parties who are not law enforcement officers

A previous opinion issued on this topic is overturned by Brnovich’s

In light of these developments, Arizona Campaign for Liberty is requesting the following:

An immediate halt to all photo radar and red light camera systems, including the fixed camera sites and mobile vans. The A.G.’s decision means that Redflex and ATS camera systems are illegally collecting evidence. Neither company currently holds PI licenses

Refunds for all paid citations going back at least as far as April 7th, 2009, which is when the legislative memo suggesting that Redflex (and ATS) were operating outside the law was issued

All the cameras must be completely shut off and powered down to ensure that private data of every driver passing by them is no longer being illegally collected and stored

Arizona Campaign for Liberty has been the main opposition to the use of these systems in Arizona and throughout the country due to the civil rights violations (4th, 5th, 6th, 7th and 14th Amendments) that each individual camera system is facilitating on a daily basis.

This year, HB 2540 would have banned all Photo Radar and Red Light Cameras in Arizona was voted down in the AZ House by two votes.

In 2015, SB 1167, which held the same language as HB 2540 was voted down in the AZ Senate by two votes.

American Traffic Solutions is having a rough start to 2016. Multiple bills filed across the country in states like Arizona, Illinois and Maryland would ban their red light camera systems. In Florida, a damning study by the Florida Department of Highway Safety and Motor Vehicles is showing big increases in accidents in red light camera intersections, across the board. [link]

For that reason and the Yellow Light Shaving scandal that broke in 2013, a red light camera ban has also been filed in Florida.

If ATS was looking for any good news in this report, they’re not going to find it. Here are some of the low-lights for red light camera intersections:

30% increase in collisions resulting in a serious injury

15% overall increase in accidents

50% increase in accidents in Tampa

47% increase in accidents in Tallahassee

20% increase in accidents in Miami

71% increase in accidents in Orlando

114% increase in accidents in Palm Beach County

0% improvement in right angle crashes

As American Traffic Solutions and their lobbyists attempt to defend themselves during legislative committee hearings, they bring up safety statistics and the fact that they are NOT Redflex. Redflex may have had convicted white collar criminals running their corporate and Chicago operations, but ATS has certainly been losing court battles over the last year.

If you’ve made it this far and watched the video, chances are that your credit card (or company card) was automatically charged by American Traffic Solutions for a “violation” that they are simply accusing you of while driving a rental car.

If you’re scoring at home, that’s 5 Constitutional rights, including 4 from the Bill of Rights, that you were just robbed of in a single action. (4th, 5th, 6th, 7th and 14th Amendments)

You may be wondering how this could have happened. So are the folks who have left their complaints at this [link]. Without knowing it, your car rental agreement compels you to waive 5 basic protections guaranteed in this country’s founding document.

Of course there’s no justice in any of it. There’s simply a profit to be made on the backs of people who are traveling and have no time to fight a frivolous ticket a few states away.

One possible recourse could be to demand rental car companies stop doing business this way. After all, they are letting a third party act as police, judge, jury and collection agent, while gladly handing over all your personal information and your credit card number!

Another would be to demand your home city or town stop working with companies like American Traffic Solutions or Redflex, their competitor. It may not prevent you from getting one of these extrajudicial fines charged to your card when you travel but it will at least keep you safe at home from their thievery.

After the email that was sent out by Arizona Campaign for Liberty (AZC4L), Thorpe’s office sent out a press release defending the bill, but saying it was being “withdrawn.” The reasons given were effectively that once people read the bill, they realized how terrible it is. A source from AZC4L says that they were told by a number of legislators that Bob Thorpe and many of the cosponsors never read the legislation. But they signed their name on it anyway. Pause and let that sink in.

So instead of dropping the issue, like every other politician attached to that bill, Thorpe decides to lash out at AZC4L, in a blog, for pointing out what the bill actually did and then defend the bill in the phoenix media:

“Thorpe said they (schools) could work with photo radar companies and come up with a proceed-sharing system that would have the companies install and operate the cameras”

In the very same week that the Redflex bribery trial results in a 20 count conviction, Bob Thorpe is suggesting that Arizona schools should go in to debt with white collar criminals? Bob.....

Rep. Thorpe didn’t think the $200 penalties for camera tickets were enough, so his bill bumped some of them up to $750!

Yes, $750.

Oh it gets worse. Thorpe’s bill continues by doing the following:

*Vehicle owners, not the person driving, would be held liable for photo tickets in Arizona even if they never received the citation or weren’t behind the wheel *Ticket recipients would be “presumed to have committed a violation” simply because they own the vehicle *Unpaid tickets tagged to a vehicle will take away your right to renew the annual registration, the owner’s drivers license or sell the vehicle *Potentially 5,000 more cameras could be added in Arizona by luring school districts into attaching them to school buses (After all, it’s all about the money children, right?

This is a mailer that went out all across Arizona this past week after a bill was filed to widely expand Photo Radar in Arizona. Anyone who says this is a dead issue in the Grand Canyon State is not paying attention:

You know it’s January in Arizona when the political class starts cooking up more ways to steal your money through photo ticketing SCAMeras.

Rep. Bob Thorpe (Flagstaff) and Rep. Kelly Townsend (Mesa) have teamed up again - just like they did in 2015 - to help Redflex Traffic Systems and American Traffic Solutions (ATS) get filthy rich off the backs of Arizona motorists and visitors.

Regarding the unconstitutional photo radar cameras, Rep. Townsend was specifically quoted as saying, “I know my constituents don't want them.”

Redflex, whose Arizona-based CEO has already been found guilty of bribing public officials, is pulling out all the stops now that at least one of their executives is headed to prison.

It seems their lobbyists sat down with Thorpe and Townsend to get one last wish list of law changes that would possibly save their company from the tailspin they’ve gone into since the bribery allegations surfaced in 2013.

H.B. 2366 could just help them stay in business a bit longer by shamelessly robbing Arizonans in ways that we haven’t seen before.

While Redflex is currently on trial for bribery and fraud in Chicago, their lobbyist puppeteers are working overtime in Arizona on these sponsors and cosponsors:

This is what H.B. 2366 - the Arizona Photo Radar Betrayal bill - would foist upon motorists in this state:                      

5,000-plus additional cameras could be hitting the streets in Arizona in 2016 and beyond, as school districts are lured into equipping all their busses with SCAMeras.

$700 fines for some photo tickets, which must be paid in order to register the vehicle.

The vehicle owner is now liable for other people who are ticketed while driving their car.

Photo tickets turn into game of he-said, she-said when it comes to liability of the fines.

Businesses in Arizona with commercial vehicles would be forced to file court claims against their own employees.

Alleged unpaid tickets will take away your right to renew vehicle registration, drivers license or sell your vehicle.

A ticket effectively becomes a lien on the photographed vehicle.

Get ready for an explosion in unfairly seized vehicles when these new photo radar codes are enforced.

Even worse - certain legislators who pledged to oppose photo ticketing have signed on to this bill, including one who agreed to introduce legislation to ban the practice entirely in Arizona.

Rep. Mark Finchem (Oro Valley) said he opposed unmanned traffic enforcement devices (photo ticketing) and would sponsor legislation to ban it.

Rep. Kelly Townsend, Rep. Vince Leach, and Rep. Brenda Barton all answered that they opposed unmanned traffic enforcement devices being used in Arizona.

.Yet all 4 of them have cosponsored H.B. 2366, the Photo Radar Betrayal bill. This is inexcusable.

Scanning the license plates of every driver passing by and keeping them in a foreign-owned database (Redflex - Australia).

Throwing their support behind a system run by a private company whose CEO is headed to prison for bribery and corruption - tactics she admitted using in order to win contracts for Redflex.

Putting your life and property at risk so they and their buddies can fund their campaigns through "clean" elections. (10% of every ticket goes to this fund.)

The hazard of shortened yellow light times, which SCAMera companies like Redflex and ATS demand in order to drive up revenues. Motorists then slam on their brakes to avoid a ticket, which causes more accidents.

Handing over law enforcement to politically connected, crony capitalist companies.

Sadly these so-called “representatives” are taking a big step backwards in the fight to uphold the Constitution and get rid of photo ticketing SCAMeras.

Just hours after an article about the election results in Tucson, which was a 65%-35% rousing victory, was released, the city has done an about face.

The city and American Traffic Solutions had been planning to run their photo ticketing system and issue citations for two more weeks. That plan just went out the door.

Tucson’s city manager has announced that they have shut off all the cameras and no more new citations will be issued.

That decision came just hours after an article was posted on Epic Times, demanding the cameras be turned off.

Coincidence? We think not.

Prop 201 in Tucson, if passed by a public vote, would ban red light camera and photo ticketing scams in the city of Tucson. Things are not looking up for Tucson’s vendor, American Traffic Solutions. Nor is it looking good for their supporters and apologists. Let’s review:

A study, just released by an independent source revealed that the presence of red light cameras in Tucson can not be associated with any significant drop in accidents in those intersections. The study is available at PhotoTicketing.com.

Over a hundred signs, purchased by Tucson Traffic Justice in support of the camera ban, have come up missing or been found in a vandalized state. For example, the sophisticated perps have spray painted “NO” over the “YES,” which looks like a clever grade school hatchet job. (see photo below)

The election board couldn’t even get their voter information pamphlets, which describes Prop 201 and the others on the ballot, in time to meet their own deadline. ATS attorneys are salivating at the prospect of billing for yet another election challenge.

The election is still two weeks away, so there’s plenty of time for more shenanigans and armies of paid apologists to march all over the Old Pueblo spewing out ATS’s corporate spin. For the sake of basic human decency, let’s hope the early returns serve as the writing on the wall for Tucson’s failed red light camera internment.
