FUCKIN’ RECORD REVIEWS endorses BERNIE SANDERS FOR PRESIDENT. To be honest, we’re voting for the candidate who will nominate the most progressive judges for the United States Federal Court System. (Of course our ultimate choice would be U.S. Senator Elizabeth Warren, but that’s obviously not an option at the moment.) At this point in the election cycle, it’s Bernie Sanders. 

This may seem like a narrow issue on which to base our vote, but on the contrary, it ain’t. The judges who decide fairness and constitutionality for workers are the most decisive factors in achieving egalitarian outcomes, including Affordable Childcare & Early Childhood Education for All, Paid Family Leave, Sick Leave and Vacation, Addressing Economic Exploitation of Workers, Addressing Income and Wealth Inequality and Establishing A Living Wage. 

According to http://www.uscourts.gov/,  “Article III of the Constitution invests the judicial power of the United States in the federal court system. Article III, Section 1 specifically creates the U.S. Supreme Court and gives Congress the authority to create the lower federal courts...The Constitution states that federal judges are to be nominated by the President and confirmed by the Senate.”

There is yet another opportunity for capital to empower itself over those without it that is currently before SCOTUS: Friedrichs v. California Teachers Association, No. 14-915. As reported in the New York Times on 1/18/16 in Case Could Widen Free-Speech Gap Between Unions and Corporations, Adam Liptak wrote, “But last week’s arguments, in a major challenge to public unions, illuminated a gap in the Supreme Court’s treatment of capital and labor. The court has long allowed workers to refuse to finance unions’ political activities. But shareholders have no comparable right to refuse to pay for corporate political speech.” 

That is, workers can refuse to finance unions’ political activity, but shareholders and employees have no right to refuse to pay for corporation’s political activity.  The current case can increase that gap even further, if the five conservative judges achieve a majority opinion, those being Scalia (nominated by Reagan), Kennedy (Reagan), Thomas (G.H.W. Bush), Roberts (G.W. Bush) and Alito (G.W. Bush). Ginsburg and Breyer were nominated by Clinton and Sotomayor and Kagan were nominated by Obama.
