Here's one that I just found in english dub.

For one since the protocol exist when cybertron body still exist and still can repair and if they can't like be rusty and all the failsafe will not working. Also if the body suddenly destroys the spark inside human will go too.

Second, the failsafe only working with organic that look like them aka people , like human or organic humanoid. The failsafe will not working on animals except the animal 'like' human like monkey (any animal that can walking with two legs and have legs)

Third, depending on their body demage or coma that cybertron can choose human host. I meant like if bumblebee doing failsafe and only sam and miles that close bumblebee can choose between sam or miles.

But they can choose as long they not in coma, and when in coma they only can entering someone that really close (physically) or human that touching them.

yeah like its a temporary highly specific

I imagine for it to be viable between the pairs both processor and brain have to be intact, if either is compromised it makes the other more vulnerable, poorly physically damage preventing the body from moving and starting repair systems automatically
