Per, Section 3 of the 14th Amendment to our United States Constitution
âNo person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.â
This isnât democracyâitâs selective amnesia dressed up as patriotism. Section 3 of the 14th Amendment wasnât written for decoration. It was written to stop exactly this.
They swore an oath. They broke it. They stormed the Capitol, incited violence, gave aid and comfort to those who did. And then they ran for office again.
Section 3 of the 14th Amendment says they shouldnât. It was forged in the aftermath of the Civil War to keep insurrectionists out of power. It barred Confederates from returning to Congress. It was clear, unapologetic, and necessary. But today?
We watched elected officials cheerlead a mob. We saw flags of rebellion waved inside the Capitol rotunda. We saw lawmakers vote to overturn a legitimate electionâafter the blood had dried.
And what happened next? They werenât disqualified. They were re-elected. Some were pardoned. Some were celebrated. And one of themâthe one who stood at the center of it allâwas allowed to run for president again.
The Supreme Court had a chance to enforce Section 3. Instead, they punted. They said it wasnât âself-executing.â They said Congress had to act. But Congress is full of the very people Section 3 was meant to restrain.
So here we are. Insurrection is no longer a disqualifier. Itâs a campaign strategy. The Constitution says âno personâ who engaged in rebellion shall hold office. But apparently, âno personâ doesnât mean this person. Or those people.
This isnât democracy. Itâs a loophole masquerading as law. Itâs a system that punishes the principled and rewards the defiant. Itâs a country that remembers the Constitution when itâs convenientâand forgets it when itâs urgent.
Until the day I die, I will never understand why he was even still allowed to run. And I will never stop saying: Section 3 still matters. Accountability still matters. Democracy still matters.
Every day is January 6.
January 6, 2024
ROBERT B. HUBBELL
Every day is January 6. American democracy prevailed on January 6 because good people made extraordinary sacrifices to protect the Constitution and the rule of law. Good people did their jobs. Good people honored their oaths. Good people put themselves in harmâs way. Good people spoke the truth. Good people stared down a violent mob.
The mob was repelled on January 6âbut has regrouped during the last three years. It assaults democracy anew each day with lies and threats of violence. It sees the Constitution as an obstacle to power. It sees honest politicians who honor their oaths as the enemy.
But take heart! There are more good people willing to defend the Constitution than members of the mob trying to bend it to their will. The good people who rallied to its defense on January 6 have prevailed in most political battles since January 6âand have every reason to believe they will do so in the future.
We must continue our resistance with the spirit of January 6 in our hearts and minds. Democracy is at stakeâit always is. The only thing that has changed is that opponents of democracy have emerged from the shadows, setting their shame aside because their leader is shameless. But those who seek to protect and preserve democracy have the good fortune of being led by a good and decent man.
On the third anniversary of January 6, that good manâJoe Bidenâspoke to the American people about the challenges we will face together as we defend democracy against the mob. He asked for our support. We should give it to him without reservation or doubt. Because in supporting him, we are supporting the Constitutionâand ourselves.
Joe Bidenâs speech at Valley Forge on the anniversary of January 6.
President Joe Biden spoke at a college near Valley Forge on the eve of the third anniversary of January 6. He spoke in plain and strong words to describe the threat to democracy posed by Donald Trump. Biden did not shy away from describing Trump's past crimes, his narcissism, lies, and dereliction of duty.
A video of the 30-minute speech is here, NBC News, Biden speaks at Valley Forge ahead of Jan. 6 anniversary, and key passages are here: Key quotes from US President Biden's Jan. 6 democracy speech.
Biden said, in part,
Today we're here to answer the most important of questions. Is democracy still America's sacred cause? This is not rhetorical, academic, or hypothetical. Whether democracy is still America's sacred cause is the most urgent question of our time. That's what the 2024 election is all about. These MAGA voices who know the truth about Trump on January 6 have abandoned the truth and abandoned democracy. They made their choice. Now the rest of us, Democrats, independents, mainstream Republicans, need to make our choice. Donald Trump's campaign is about him. Not America, not you. Donald Trump's campaign is obsessed with the past. Not the future. He's willing to sacrifice our democracy to put himself in power.

"The treacheries of these souls were denials of love (which is God) and of all human warmth. Only the remorseless dead center of the ice will serve to express their natures. As they denied God's love, so are they furthest removed from the light and warmth of His Sun. As they denied all human ties, so are they bound only by the unyielding ice."

FBIâS COMEY: OK TO VIOLATE 4TH AMENDMENT WHEN STOP-AND-FRISK USED RIGHT
From Reuters:
Federal Bureau of Investigation Director James Comey told a House of Representatives panel on Wednesday that the police tactic known as âstop and friskâ is an important tool when used right.
Comey told the panel that police who search citizens without stating the reason should explain after the encounter why they decided to do so.
The tactic has been struck down in some courts as a form of racial profiling, but Republican presidential candidate Donald Trump has called for its return.
In other words, according to this top law enforcement official who allows felons to escape justice, massive violations of the Fourth Amendment are permissible so long as the cops tell the victim after they search him they were looking for a gun or drugs.
So much for that oath he took.
Letâs review the amendment again:
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
Donaldâs with Comey.
âI think stop-and-frisk, in New York City, it was so incredible the way it worked. And, we had a very good mayor. But New York City was incredible the way that worked. So I think that would be one step you could do,â he told Fox News.
Itâs obvious we no longer live in a constitutional republic.
Stop-and-frisk is the hallmark of a police state.
