In case you were wondering, action movie cliches are probably public domain. We now know this because a lawsuit alleging that Sylvester Stallone plagiarized a script called The Cordoba Caper for The Expendables has been rejected by federal judge Jed Rakoff, essentially on those grounds.

Sylvester Stallone sued over The Expendables
It has been reported that The Expendables writer, director and actor, Sylvester Stallone is being sued by a man, claiming that the actor stole his idea. The man suing the action star is one Marcus Webb, who penned the screenplay The Cordoba Caper and a short story of the same name.
Mr Webb claims that The Expendables is very similar to his story in certain places and that in some parts of the movie, it is identical to his work. So far there has been no response from Sylvester Stallone or anyone else involved with the 2010 movie The Expendables.
 Marcus Webb made his screenplay available for consideration between 2006 and 2009 but has never been acknowledged by Sylvester Stallone and claims he has been deprived of potential earnings from the screenplay. The Expendables 2 is currently being filmed and is expected to be released on August 17, 2012.
