Tính đến Visa Bulletin tháng 6/2026, EB-5 Việt Nam đang ở trạng thái Current. Tuy nhiên, điều này không đồng nghĩa backlog sẽ không quay lại, nhất là khi số lượng hồ sơ tăng nhanh trước các mốc chính sách.

EB-5: Nhận RFE hoặc NOID từ USCIS có đồng nghĩa hồ sơ sắp bị từ chối?
Không hẳn. Trong quá trình xét duyệt EB-5, USCIS có thể yêu cầu nhà đầu tư bổ sung hồ sơ nếu bằng chứng ban đầu chưa đủ rõ để xác minh nguồn vốn, dòng tiền, khoản đầu tư hoặc thông tin cá nhân.
RFE là Request for Evidence – yêu cầu bổ sung chứng cứ. Đây thường là bước USCIS cần thêm tài liệu để làm rõ hồ sơ.
NOID là Notice of Intent to Deny – thông báo ý định từ chối. Mức độ nghiêm trọng hơn RFE, vì USCIS đã có căn cứ nghi ngờ và cho nhà đầu tư cơ hội giải trình cuối cùng.
Nhóm tài liệu thường bị yêu cầu bổ sung nhiều nhất trong hồ sơ EB-5 là source of funds và path of funds: hồ sơ thuế, sao kê ngân hàng, hợp đồng mua bán tài sản, hồ sơ doanh nghiệp, giấy tờ tặng cho, vay mượn hoặc chứng từ chuyển tiền vào dự án.
Điểm quan trọng là thời hạn phản hồi rất chặt: RFE thường khoảng 60–90 ngày, NOID thường khoảng 30 ngày và thường không thể xin gia hạn. Nếu phản hồi trễ hoặc trả lời không đúng trọng tâm, hồ sơ có thể bị từ chối.
Với EB-5, nộp nhiều giấy tờ chưa chắc tốt hơn. Điều USCIS cần là chứng cứ rõ, logic, có liên kết và giải trình đúng câu hỏi họ đặt ra.
