okay so i’m not really wading in on this, primarily because i’m not well-informed enough - i haven’t read either series in question, and i haven’t read the legal documents in the suit. i am familiar with the history of controversy surrounding cassandra clare, and at one time, i was pretty well-informed about those earlier allegations (and found them pretty credible).
however, i became curious as to why the tumblr posts about this most recent issue were linking to documents hosted on courtney milan’s website, when she didn’t appear to be involved in the case at all. turns out, she’s a romance writer with a very cool twitter presence who is also a former intellectual property law professor. (all so cool!! like the one thing i’m taking away from this, aside from a headache about plagiarism and copyright and fandom and mythmaking, is that courtney milan seems like a really interesting person!)
but, anyways, courtney milan started tweeting about the case on feb 9. when she found the complaint, she tweeted out a link to the file, hosted on her blog, and to the exhibits (here and more here). she also discussed some of her thoughts on the case, which i found really edifying and valuable. when i first saw this post, my mind immediately went to, “here we go again.” i had no problem quickly assuming that clare was at fault. and she might be! but after reading milan’s tweets, this story had gotten more complex, more nuanced, for me. there are really vital questions here, for all of us who tell stories, whether we do it for pay or not.
i don’t have a super efficient way of sharing those with you, other than a screencap that’s out of order, which i’ll put below. but here’s what should be a stable link to the main chunk of thinking she tweeted out. and again, it’s pretty easy to scroll back to february 9 to see all of this on her twitter feed. i’m going to put the screencaps under a read more.

Whoosh, I’ve read a substantial number of the Dark Hunter novels and all I can say is Sherrilyn Kenyon is getting some VERY BAD legal advice.
Courtney Milan breaks it down pretty well, but I must add that the way the suit currently reads, you could apply it to nearly every urban fantasy/paranormal circulating post 2002. Much of what she’s claiming to be her original thoughts are much too vague to be realistically copyrighted.
In reference to the Shadow Hunter symbol simply being a simplified version of the Dark Hunter Symbol… I read maybe the first 17 books in the series as well as a few of the CoN books and the only symbols I remember were the two bows and an arrow for Artemis and the weird sun thing for Acheron. Did I miss something? Because I’m not seeing anything similar to the Shadow Hunter symbol on any of the old covers.
Read a few more details of the suit and it's just so... bad. Just as Courtney Milan stated, TMI actually predates many of the details Sherrilyn Kenyon alleges were lifted from some of her later Dark Hunter novels. The woman needs to fire her lawyers.
