Law and Punishment

In general, the California child pornography statutes provide that:

If any person distributes or possesses any obscene matter knowing that the matter depicts a person under the age of 18 years personally engaging in or personally simulating sexual conduct

For commercial purposes is guilty of a felony and shall be punished by imprisonment for up to 6 years, or by a fine not exceeding $100,000.

For commercial purposes is guilty of a felony and shall be punished by imprisonment for up to 6 years, or by a fine not exceeding $100,000.

For exchanging with another person above the age of 18, shall be punished by imprisonment in the county jail for up to 1 year, or by a fine not exceeding $2,000.

For exchanging with another person under the age of 18, is guilty of a felony.

A person is guilty of sexual exploitation of a child if he or she knowingly develops, duplicates, prints, or exchanges image that depicts a person under the age of 18 years engaged in an act of sexual conduct shall be punished by a fine of not more than $2,000 or by imprisonment in jail for up to 1 year, or by both. If any person produces an image of a minor engaged in sexual acts for commercial purposes is guilty of a felony and shall be punished by imprisonment for up to 6 years, or by a fine not exceeding $100,000. If a person produces an image of a minor engaged in sexual conduct, he or she is guilty of a felony. If found convicted under the child pornography statute a person will generally be required to register as a sex offender.

So I’ve followed what has been happening, and have heard about what has happened to koujackie.

As a note to koujackie personally: If something is detrimental to your mental well being, perhaps you should avoid it?

Tumblr is not a healthy place for you at the moment.

You have the choice of moving on with your life, or returning to tumblr.

If you return, you’ll have to face what happened and deal with it, which is going to be difficult and stressful.

Despite Jackie’s actions, I fully believe that she loved the DMMD community.

And yet, this is the same community that destroyed her.

That is really sad, no matter what side you’re on, no matter what you may think about her.

I cannot help but feel really bad for the people who looked up to her as well as for her friends.

Things like this, it makes myself feel scared as well. Will this community, all these people that follow me, all these people I love and feel a connection with, who make me feel so welcome and needed, and admired………will they turn on me and try to tear me down? Over something I wasn’t aware or consciously thinking was potentially harmful?

When is having fun and being playful and friendly considered too much? Too stuck up? Predatory?

And there is so much strength in numbers. And even if your cause is just, there are going to be people who will abuse a just cause and use it for their own personal gain.

Jackie is a friend, and I feel so bad for her. I also feel so bad for those who felt that they were victims.

What started all of this was this little incident that could have been easily avoided.  A few days ago, Koujackie went ahead and did something that would forever lose her favor from the Filipino community, and well, most of the DMMD community. rofl.

She thought it’d be absolutely hilarious that she would go joke around with the Filipino!Mizuki headcanon and told her fans to send offensive Tagalog slander to a couple Mizuki blogs, and one Sei blog - which btw, was POORLY constructed grammar wise, as confirmed by a friend when I asked her to translate some (cuz truth be told, my Tagalog is zero to none, rofl):

One of the original asks: 

Translation: “You’re stupid. You’re gonna die and stab your small dick into your mouth and swallow my cum! You’re a son of a (dunno wtf pokpok is), and get together with your bald dad!”

As you can tell, clearly Google Translated and pretty broken. LOL

Filipinos like Button, myself, and others are deeply peeved of what she’s done. First of all, she’s an ignorant white person who’s used our fucking language that she had no knowledge of in the first place, and used it to go around posting broken awful shit in our language and getting her fans onto this crap as well. (See: dryjuiceofficial’s blog. A lot of her fans asked by Jackie went ahead and sent a bunch of broken Tagalog over there). 

This is not funny,it’s stupid and racist and dumb. She basically abused our language and made herself look like a complete asshole.  Even after people called out on her problematic behavior, she refused to acknowledge it and refused to apologize publicly.

Like, Jackie, get some integrity man. Swallow your goddamn pride. An apology was all we ever fucking needed. We just wanted you to acknowledge your behavior and apologize. Shit wouldn’t have escalated as it has if you actually did.

What really grosses me out the most is how there are still some users on here defending Jackie and hiding behind the idea that “she never got the chance to apologize because she was bullied off of tumblr”.

Really… Have any of you seen her apologize for anything, ever? I was on a phone call with her when this shit started going down. Yeah, she was freaking out and I did my best to support her bc I was still wrapped around her finger. The only time she ever apologized was to me, in private, and I’m fairly certain it was purely because she wanted me to continue to support and believe her, even after the emotional abuse she’s put me and my friends through. She’s done the whole “I’ve never met to hurt you” shit, while simultaneously tried making some of my two closest friends out to be the bad guys. (Sadly, it worked for a little while…)

But that’s what she does. She says some nasty things and when she’s confronted about it, she’ll play it off like she didn’t mean it like that or it was just a joke. But she will never apologize. I know for a fact that she believes that her actions were not offensive and that the people she DID offend were full of shit. She’s even told me that “something has happened to Button” and they were mentally ill, being ableist and completely dismissing anything Button was saying.

She’s told me she’s just gonna keep quiet until everything blew over, again… only apologizing to me, and never taking the apology to tumblr. She just expects people to defend her. Every time drama starts that involves her, she goes quiet and lets her supporters white-knight her.

It’s kinda fucked up.

Before I start, buddens has stated that they consider themself harassed and preyed upon, but if you do not agree with buddens opinion, LEAVE HIM BE. he has said that he wants to move on from this entire thing

This entire thing could have been handled better, but this is tumblr, and tumblr tends to have a very black/white way of thinking, putting one person on a pedestal, and refuses to acknowledge that they might have been in the wrong to.

I’ll be using the visuals that have been provided. I’m a bit on the fence about using anons experiences, as there is the possibility that one person has submitted fake experiences or is pretending to be multiple people, but I will be thinking of them as I write.

The entire koujackie uproar first started when she got an influx of messages in various languages. For some reason, this annoyed people. The entire thing got worse when they started telling her how to insult people in those languages. Then even more so when insulting Tagalog messages were sent to dryjuiceofficial, and were interpreted as personal attacks against the mun, character, and language.

they were also considered offensive as Tagalog is not a language koujackie knows how to speak and neither is she Filipino. People felt that using a language you don’t know to insult people was, well, insulting. Whether it is or isn’t is your own opinion, but do take into account the feelings of those who have it as a first language.

Then this post was made accusing koujackie of being racist, transphobic, and a pedophile.

So, naturally, it went viral and people doxxed her by submitting  her personal info to blogs and ran her off the internet, giving her and her follower hate and calling her a cis mayo bitch.

Don’t insult some one for things they cant help being born as. Being cis is not a bad thing, and being born white is not a bad thing. You cannot choose your race, or the fact that you identify as the sex you were born as.

reminder that spreading someones personal info with out their permission, is, in fact, illegal. That means even if they posted it on a social media site, you can be arrested as you don’t have their express permission.

Racist:

What riled up people the most was this post on her facebook

because she wore her Mink cosplay wig in public. The reason people got angry about this is because a) the wig has dreads and b) she’s white, and they feel that you cannot have dreads unless you are classified as a person of color. (Something which I personally dont completely understand, as dreads are not specific to a one region and can be in native cultures on all inhabited continents. If you would like to explain, feel free to message me.)

Transphobic:

first about this headcanon

which people feel is transphobic. If you read the second to last highlighted section, she means that that her opinion is if somebody loves you and wants to share lit. everything with you, telling them youre dfab or dmab is a good idea so they don’t feel as if you cant trust them with everything.

it should also be known that she feels some people are transmen because they actually want to get away from feminine stereotypes. And, while this is true for some, it isn’t true for everyone

next is her misgendering of people. She has. She should apologize for that and try not to do it again. It’s rude.

reminder that it can sometimes take a while for someone to get used to using your preferred pronouns to the point where they don’t have to consciously remind themself to use a different pronoun.

And lastly, the big one. pedophilia

the medical/ legal definition of pedophilia is

B. A persistent or a predominant preference for sexual activity with a prepubescent child or children. C. The person is at least 16 years old and at least five years older than the child or children in B.

the cut off date for prepubescence is age 13.

koujackie fits over the age of sixteen and at least five years older than buddens who was at the time, 17, now 18.

The legal age of consent in the US is 16 or 17 depending on the state.

with only these things facts provided, the worst she can be accused of is flirting.

as this is the only example provided, it cant exactly be called repeated harassment. also note that its to post the answer to the ask, not the ask itself

buddens did provide the picture, and they’re response is to joke about koujackies reaction

saying ‘hurry up and be legal’ is admittedly creepy from an outside pov but does imply that she doesn’t want to engage in some sort of activity until they’re legally an adult

do notice that buddens responds to this reply. by giving how long until they are legal

again ‘hurry up and be legal’ is kinda creepy. try not to say it. The ‘so I can flirt with you” is a bit late as they are both already flirting with each other. Notice buddens is flirting back, and in fact says ‘# pls flirt with me”, which most people will take as an ok to flirt. Also notice that they say with the amount of un birthdays they’ve had, they probably wont ever be considered legal. Its most likely a joke, but could be an attempt at a refusalunfortunately, for buddens case, an example of a concrete “no” hasn’t been provided so we’ll have take his word on that

and then there’s the uncomfortable opinion and possibility that buddens is only saying or suddenly feeling they were harassed because they are angry about the Tagalog,

personally, I think this is very unlikely. It puts only them in a bad light and refuses to take into account that koujackie is in the wrong also

I think both parties are in the wrong here. Buddens for not indicating they were uncomfortable, which most likely would have stopped it.  And koujackie for misgendering and wearing the wig in public

If you are uncomfortable, say so, and if they continue, you can block the person, report them, or, if its an anon, turn of anonymous asks

If some one indicates they are offended by something you did, apologize, ask the reason why, and try not to do it again
