One of the most important things I learned in my Language and the Law class is that law enforcement will intentionally misinterpret every type of statement asking for a lawyer as not asking for a lawyer. Even directly saying it like this âI will not speak to you without a lawyerâ can be taken as a simple statement of fact rather than a request for a lawyer. You literally have to state âI am now invoking my right to a lawyerâ and every time they try to proceed with an interrogation you have to answer every question with âI am invoking my right to have a lawyer presentâ. You canât just tell them you wonât talk without a lawyer or that you want a lawyer. You have to state that you are invoking your rights. Otherwise they could just say âwell they just said they wouldnât speak without a lawyer present. Thatâs not invoking their rights to a lawyer. Itâs just stating a fact.â even just stating your right to a lawyer doesnât count!
PLEASE share this addition. I am a lawyer who works in criminal defense, and this is one of the most avoidable things that people consistently get wrong about the Miranda rights.
Here are some more âambiguousâ phrases which courts have found DO NOT invoke your right to a lawyer:
âMaybe I should speak to my lawyer first.â
âI might like a lawyer.â
âI think I should have a lawyer present for this.â
âCould I speak to my lawyer first?â
âHow long until my lawyer gets here?â
And perhaps most egregiously â âGet me a lawyer, dawg â âcause this is not whatâs up.â
Here are the magic phrases which you need to know if you want to invoke your Miranda rights:
1) âAm I free to leave?â
Itâs worth asking this even if the answer is obvious. Even if the officer does not let you leave, by forcing them to admit that you are not free to leave, you are creating a record which your attorney can use to prove that you were in custody. Miranda rights only apply if the interrogation is custodial, meaning that police officers will frequently claim that their suspects were ânot in custodyâ to get around their Miranda rights.
2)Â âI am invoking my right to remain silent.â
Simply staying silent will not invoke your right to remain silent. As absurd as this is, you must explicitly say that you are invoking your right to remain silent in order to invoke that right.
3)Â âI am invoking my right to an attorney.â
As stated above, you must be not only clear and unambiguous, but clear and legally unambiguous. Donât get cute. Donât get sassy. And on the flip side, donât get intimidated and use verbal ticks to minimize your request. Say the line with those words exactly â say it clearly, and say it once, and then say nothing else.
Because even after youâve done all this, the police can still try to get you to talk. Theyâre not supposed to interrogate you, but theyâre allowed to make casual conversation, and if that conversation just happens to circle back around to the thing they wanted to question you about, well, thatâs really your fault for talking after you said you wouldnât, isnât it? Canât possibly fault the poor officers when you initiated â if you really wanted to have your rights respected, you wouldnât have talked to them in the first place.
The police know this, and they will mercilessly exploit this loophole. So, once youâve successfully invoked your Miranda rights, any and all conversation you have with police officers will put those rights back into jeopardy.Â
Putting it all together:
Ask: âAm I free to leave?â
If they say no, say:Â âI am invoking my right to remain silent and I am invoking my right to an attorney.â
And then shut up and do not say a single thing to them for any reason whatsoever until you have actually spoken to an attorney. Yes, even if it takes hours. Yes, even if they start talking to you about something else.
Finally, a very important disclaimer:
I may be a lawyer, but Iâm not your lawyer, and I cannot guarantee that what Iâve just laid out here will always work for every situation. We didnât get to this bizarre and absurd place overnight â we built this ridiculous system piecemeal, by deciding on a case-by-case basis that certain phrases were âtoo ambiguousâ or certain types of questioning werenât actually questioning at all. The law is still in flux, and is still fundamentally out to get you, and willing to bend plain meaning beyond all recognition to do it. Even if you invoke your rights perfectly, exactly as I have specified above, thereâs a chance that your invocation of rights will be disqualified on some new technicality that no oneâs even thought of yet â and thatâs precisely the problem.

if you know youâre going to be exposed to tear gas make sure to:Â
wear a scarf or bandana to cover your nose and mouth (assuming you donât have access to a gas mask, dusk mask or other kinds of filtered masks). cover up identifying marks like tattoos.Â
tie up your hair and cover it as best as you can (tear gas can and will get into your hair and become tricky to wash out, you risk repeated exposure if you touch your hair and then your face etc).
wear goggles (swimming goggles or ski goggles work pretty well, sunglasses are not as good but they are better than nothing).
COVER YOUR SKIN (tear gas irritates the fuck out of your skin so cover up as best as you can. wear gloves. especially in warmer months sweat or other kinds of moisture on open skin eyes and lungs will react to tear gas and it will burn).
carry cold water with you to wash your face upon exposure, make sure itâs sealed so itâs not contaminated. hot water will open your pores and likely exacerbate the situation, so try to only use cold water.
prepare a separate spray bottle and fill it with a mixture of baking soda and water, this will help neutralize some of the effects of the gas. 3 tsp to every 250 ml seems to be a good rule of thumb. you will spray this into your eyes and mouth as needed.Â
do not wear makeup, sunscreen, creams, or contact lenses.Â
upon exposure:Â
try not to panic, running blindly will overexert your lungs and make things worse, and might make you hyperventilate faster. move quickly but safely to get away from the cloud. get to higher ground if you can. if youâre in a building that has been gassed, immediately exit the building.
if you do inhale it, DONâT PANIC. it feels horrible and kind of like you might die but for most people itâs not lethal. (if you have asthma or other respiratory conditions or youâre elderly itâs far more dangerous for you to be exposed. infants are at greater risk also.) donât rub your eyes or your face. you might vomit. your eyes and nose will stream like crazy. cough and spit as much as you can to get rid of the mucus build up. you might feel dizzy and disoriented. thatâs normal. use the spray bottle on your eyes, face and throat as quickly as possible and escape the area. the immediate effects will likely wear off in an hour or two but you might feel the burning/irritation for days afterwards.Â
take care of yourself first and help others after. remember that touching exposed individuals with bare hands will contaminate your skin also.Â
if a gas canister lands next to you DO NOT TOUCH IT UNLESS YOUâRE WEARING HEAVY DUTY GLOVES. you will get second degree burns. the traffic cone method that HK protesters have been using seems to be the safest option to neutralize the canisters, but unless youâre sufficiently prepared to do this your only priority should be to get away from them.Â
when you get home:Â
take off your shoes outside so you donât track particles into your house. wear gloves while handling contaminated items.Â
take off all of your clothes. everything, down to your underclothes will likely be soaked in gas. if youâre able to, hang them outside to air them out on a balcony or in a yard for a few days.
wash your face with cold water as many times as you can. do not stand over a sink and do this; kneeling down and tilting your head back to pour water over your face and into the inner corners your eyes is more effective. flush your eyes out one by one, try not to cross-contaminate particles from one eye into the other.
wash your glasses and goggles with soap and water.Â
take a cold shower with soap. do not take a bath. you will probably have to take multiple showers until the burning on your face and skin subsides.Â
wash your contaminated clothes separately â you will have to put them through multiple wash cycles or failing that, discard them. wear gloves while doing this.
gas particles can stay active for 4-5 days so do not wear the same clothes if you are heading back out. Â

Motivation comes from figuring out your WHY. Ask yourself why you want to do these things. It could be simply that you want to cross something off your to-do list, if itâs work, your motivation could be getting paid or if you are motivated from the feeling of productiveness then focus on that.
In these pandemic times, everyoneâs productivity and motivation have been affected so be kind to yourself and understand whatever you can get done is enough.
If your headspace is not feeling good enough to be productive, then take the focus off of productiveness and take a few days to focus on things that bring your joy. Make tomorrowâs only focus to do things that make you feel safe, happy, and comfortable. Itâs important to realise that good mental health positively impacts your productivity.Â
