The 13 amendment took the power from the courts to enforce slavery as a state right... the emancipation proclamation was a war time act... it was only enforcible because of the presidents war time powers... ONCE THE CIVIL WAR ENDED THE COURTS WOULD NOT UPHOLD THE PROCLAMATION!!!
