Page 02. ---- Hyman Caplan Acquitted on Charge of Assaulting Customer ---- Accompanied to court to-day by his counsel, Fred Singer, M.P.P., Human Caplan strode in to defend himself against a charge of assault, laid by Stanley Oschuk, and in his brief hag, his counsel carried a Polish word which was to play a prominent part in the defence.

‘I went to his clothing store,’ said the complainant, ‘with a friend who wanted to buy a suit for his son. After a while, Caplan ordered me out and on going out I was hit with the door.’

Mr. Singer asked: ‘Do you know how to swear in Polish?’

‘I didn’t say anything,’ was the reply.

The accused added that his visitors wanted to give $3 for a $14 suit.

‘He started to call me a bad name in Polish, so I ordered him out and he hit himself with the door,’ said the accused.

The case was dismissed.

An Erin Touch Of course St. Patrick’s day had to be celebrated in some way in the police court, and it was left for Magistrate Tinker to do it in real Irish fashion. There was a Scotsman before his worship for drunkenness. It was his first appearance. So the Englishman on the bench distinguished the day by rebuking a Scotsman for being in the dock for drunkenness on the Seventeenth of Ireland.

‘You ought to know better than that,’ concluded his worship.

Robert Bastian, guilty of a second offence of drunkenness, was fined $50 or one month.

Must Pay the Jehu The police reported that Hugh K. Toner, charged with vagrancy, ran up a taxi bill for $4 and couldn’t pay.

‘He said he was trying to sell Casa Lama,’ said a plainclothes officer.

On the accused promising to pay the taxi bill, Magistrate Tinker remanded till called on for sentence.

A Wet Day The police stated that when they called at the home of Richard O’Rourke, 31 St. Paul St., they found eight men drunk, O’Rourke being one of the eight.

‘I was jagged up and don’t know much about it,’ said O’Rourke, when charged with permitting drunkenness.

‘There was nothing in the room but a bed and stove,’ added the police.

‘Do you want to give your own evidence?’ asked Magistrate Browne.

‘What’s the use? I don’t know nothin’,’ replied the accused.

O’Rourke was fined $10 and costs or 30 days.

Fearless Wife The wife of Peter Horoskki came forward and said she would take all responsibility for the little drop of alcohol found by the police, after raking over a pile of ashes in the cellar of their home.

But Magistrate Browne was not prepared to accept the woman’s sacrifice.

‘But he knew nothing about it.’ insisted the woman.

‘There are seven children and he has just started work,’ said Interpreter Markowitz.
