While driving through a dangerous curve in East Texas in 2016, James Fulton turned into oncoming traffic and killed 20-year-old dental hygienist Haile Beasley. Despite James crossing over two lanes of traffic, at the scene, the detective failed to take a blood draw of James, and he was subsequently let go. Although Texas leads the nation in traffic fatalities -- 3,721 people died on the state's highways and roadways in 2017 alone -- most car accidents are still considered accidents, with the drivers only facing civil liability as opposed to criminal. But, in Texas, for a driver to be charged with criminal negligence, the prosecutor must prove that the accused should have known his or her behavior was putting someone's life at risk. So, then, when does a fatal car accident become a violation of state law? And when can people be held criminally liable for traffic fatalities?

TYLER’S little red rooster name of “Chuck” is dead.
Many’ll recall having read here about this tiny fowl’s “daring” escape from a big chicken transport truck rumbling through Tyler nearly a year ago. [Ed: hopefully I’ll find this story in the collection at some point!]
Landing in front of a West Erwin Street service station, and taken in by Charles E. Alston, operator of the place, the little chicken, then an “infant”, grew to gain a measure of fame. Here he found an exciting world —- unlike the prosaic one he’d have discovered in the barnyard.
“Chuck” became a great pet with a very evident predilection for people. He was wont to strut around the station as though he were human, his “nonchicken” antics creating such wide acclaim that a Dallas newspaper also featured him.
“A smart aleck killed Chuck,” Alston said.
“It was Tuesday of last week. A feller went out of his way to run up on the curb where Chuck was ‘asleep’ and crushed out his life,” the sorrowing man explained.
“We buried Chuck back of the station here,” Alston added with profound feeling. “He was our beloved pet. We all miss him.” —ARTHUR BISHOP
