Just FYI. If you live in germany, the landlord cannot forbid you to keep cats. Dogs yes, but cats are always allowable!!

The law cannot tell a proprietor who they can or cannot choose as a tenant. If they own the property, they can choose whoever they want and if they make it clear to you that someone without cats will be chosen over you if you have one, then there's bugger all any law can do about it. There are plenty of apartments where they state, No pets. How does the dog/cat thing fall in that scenario?

The cats do not apply to this, only dogs. For some reason I cannot remember exactly (it was something like the cats being an extension of the human personality or something other weird like that) that cats do not count as pets in that sense. We had this problem when our landlord changed (the old one died and someone else bought the house). He suddenly said he doesn't want our cats to stay, so I hunted around a little and found court decision which I faxed to him. The next day I got a new draft of the contract which stated dogs specifically, not pets. @ajohnson: Yeah, I realised this too late. I thought she strictly meant that the landlord forbade them to keep cats, which is against the law. But if she wants to keep on good terms, that's also nice (but unusual for germany )

That sounds weird. Are you sure they can't disallow cats? Cats can do a lot of damage to a place given the chance. I always thought the 'no pets' thing just didn't extend to 'small' animals. Things that live in cages and aquariums that can't do much damage or cause much of a racket.

In my contract it says "Keine Haustiere, ausgenommen Kleintiere". Perhaps cats are Kleintiere?

I think Kleintiere is limited to animals that are kept in cages. Rabbits, hamsters, gerbils, Belgians and the like.

When we got our cats we called the hausverwaltung and they said that cats were kleintiere and they couldn't do anything about us having them (and they are real sticklers about lots of things).

Why not just ask your Landlord and/or hausverwaltung before you get a pet that might be a problem. Different hausverwaltung have different rules so you can judge all of them by the rules that one makes for its bldgs.

I only know from personal experience and that our landlord actually changed our contract from explicit mention of "keine haustiere" to "keine hunde". I just checked some court decisions on the subject and they are a bit contradicting (who woulda guessed?). In the end it comes does to what is called "freie Entfaltung der Persönlichkeit" and cats are considered an allowable part of this.  Another part is that it is considered that cats cannot damage a flat in such a way that it cannot be easily repaired, whereas dogs could. @ Mosh Like you say the information floating around on the www can be quite contradictory. @ all As I mentioned before, I think that if you sign an agreement which states explicitly "no pets" than there's nothing you can do. If you've signed a standard agreement without an explicit no-pets-paragraph, than you're allowed small mammals incl. cats. But please do clarify this point with your landlord or with the people managing the property.
