Sorry if this sounds dumb but I'm so confused about the federal trial dates. Why would Garnett say it starts in November and January, but mainstream media reported that it will start in January next year. when does it start? 😭
Don't worry, Garnett's order is a bit confusing. As of now, the official start date for voir dire is Oct 13 and for opening statements - Nov 4. However, this schedule is just a formality until Garnett receives defense's ex-parte letter with info about what's going on in the state trial. The federal trial is going to be adjourned until January, 2027, because Garnett said the federal trial schedule will be adjusted based on what's happening in the state trial in order to ensure that Luigi receives a fair trial. And that cannot happen if both trials run at the same time. Mainstream media is reporting on January, 2027 dates prematurely. Garnett may change up those days based on what defense tells her in the ex-parte letter.
The Oct/Nov federal trial dates are based on the info on the record that Garnett had at the time (i.e. defense's motion, prosecution's response, and what was said during the hearing), the state trial had not been adjourned then. So, she needs defense to record this fact in their ex-parte letter, so that she can adjourn the federal trial. As everything needs to be on the record. And she is probably at least a bit annoyed by how Carro adjourned the state right after the federal hearing - making the federal hearing a waste of time (Judges do not like to have their time wasted).
Would the backpack from Central Park and the monopoly money be suppressed?
No, those items do not have Forth Amendment protections and therefore, they are not suppressible, because they are considered to have been voluntarily abandoned. In general, evidence can only be suppressed if it has been obtained unlawfully or in cases of forced abandonment (e.g. when a defendant throws away evidence in response to an illegal police pursuit).
As per Prosecution's March 11, 2025 Automatic Discovery Form:
Is this trial the actual court proceeding we see where evidence is given etc like the diddy one and the one where he said if the glove doesn’t fit we can’t equip - ok Simpson
If by "we see" you mean we have a video recording, then we will on some days. Not all of them, unless the judge changes his mind. Diddy's latest trial was not televised, though. So, not sure if that is what you meant.
The evidence is going to be presented, yes. That is how all trials work. The public and media attending the trial hearings in person will be able to see it in the courtroom. Usually, evidence presented in the open court is a public record and regular citizens/media companies can request copies of it afterwards (e.g. just like how media obtained McDonald's body cam footage). However, sometimes the evidence is not permitted to be shared outside the courtroom. This can happen when defendant's right to a fair trial might be violated by having the evidence published publicly. E.g. if 2 or more defendants are tried for the same offense or when 2 or more cases share the same evidence and their trials are at different dates. Then the evidence shown at the first (defendant's) trial might be withheld because releasing it publicly before the second (defendant-s) trial could prejudice the second defendant.
Given that Luigi has a second/federal trial, defense may ask that most of the evidence is not shared publicly as to not violate Luigi's right to a fair trial in his federal case.
wait.... what about the PA case? How are they supposed to do the nyc or federal cases without having that one sorted, doesn't it have like, 90% of the evidence?
All the evidence has been transferred to New York state and federal prosecutors. PA prosecutors allowed NY prosecutors to take all the evidence and proceed first because the NY case involves more serious charges (murder charges in NY vs. forgery/gun possession charges in PA). The feds then took Luigi into federal custody. PA case could have proceeded first, but Luigi wanted to appear in person for the PA hearings (as is his right). Feds would not allow him to be transported there, so the PA case has been delayed until the NY and federal cases are concluded.
