I think the answer to this question is actually quite complex and not easy to explain but I will try!

Where see lines scattered throughout the series where Luffy more or less says the hat belongs to Shanks. perhaps the most obvious one is during the Summit War where where Luffy and Whitebeard meet. (if I’m not mistaken) Whitebeard says “I recognize that hat” and Luffy replies “yeah, I’m just hanging onto it for Shanks.” there’s a similar Oda-approved line in Film Red where Uta asks Luffy, “why do you have Shanks’ hat?” and Luffy replies “he let me borrow it.” The scene where Luffy meets Gaban is the latest example:

I think to Luffy the hat as an object belongs to Shanks, but it’s his (Luffy’s) in the sense that it’s a symbol of the promise he and Shanks share. That’s why Luffy refers to the hat as his ‘treasure’—not so much the hat itself, but that Shanks gave it to him under the condition that Luffy return it to him someday, and all that promise implies. Film Z lays this out quite nicely:

I think Luffy refers to the hat as his own here not because he sees the hat as belonging to him, but in the sense that he can’t be King of the Pirates if he lets anyone break the promise he made to Shanks. That promise and all its implications is what Luffy is referring to as his ‘guide’—his way of living (to be a man Shanks can be proud of sacrificing for) the kind of pirate he is (one who is free and frees others, as opposed to living with regret and oppressing others) valuing his crew (instead of using them as pawns) and striving to achieve his (true) dream no matter if he dies in attempt. The hat as a mere object belongs to Shanks. The enchantment of it belongs to Luffy just as much as it does to Shanks, and it is both Luffy’s and Luffy’s ‘treasure’ in that sense.

I ADORE this ofc, and I think about how Luffy calls the straw hat his treasure, which makes Shanks (and their bond and promise) by extension his treasure. on the other side of this however: Luffy’s epithet implies that the hat belongs to him, but Luffy often says the hat belongs to Shanks, and that he (Luffy) is just holding on to it. we saw this quite (relatively) recently when Gaban was introduced:

to me, this all is important because this particular of their promise—what the hat means to them both because of the implications of Shanks giving Luffy the hat, which then turn the hat into a symbol—that only they and those closest to them understand (Gaban for example, in the above scene).

“The straw hat once again belonged to Shanks.” Overlapping with Luffy’s epithet—to the world beyond them (and their respective families), this is the case, will be the case, when they meet again, But to Luffy, the hat doesn’t belong to him at all. It’s because Shanks gave it to him that makes Luffy belong to (or with) Shanks.

I believe it’s original! Here is the image I got it from. It looks like it was from a magazine page…the style and pen strokes make me think it was indeed by Oda, but if anyone else out there knows more then please comment!
