Andrea Seabert-Olsen, the grievance officer on campus. Her job is to receive and read incident reports, undergo an investigation (if she feels it is necessary), and ultimately decide if the accused is guilty or not and what their punishment should be.
When I went to Andreaâs office for our scheduled meeting, I went as a victim as well as a concerned student doing a contract about sexual assault in which I was concerned with her protocol. I informed her that I was upset about the way she handled my own incident but I was more concerned with the way she handles cases like this overall. I told her that for my contract I would be writing a sexual assault policy as well as articles for the paper to raise awareness around the issue. What she said to me was unbelievable.
During this meeting she informed me that, for some reason, although the incident report I filled out with my R.A last year was on her computer system, she never received this complaint. If she did not handle the complaint then it meant my assumptions were confirmed: nobody did. Nobody read it, so of coarse nobody did anything about it! Andrea estimates that in the three years she was been working with the grievance office, she has probably handled 10 cases of sexual assault. Statistically, there should have been a lot more. However, many women do not file these incident reports, and when there is a huge lack of response from our school, whatâs the point of reporting?
According to Andrea Seabert, the point of her job âis not to take care of personal needs. It is not based on compassion, but on pragmatic evidence.â Although on her free time she chooses to work at a camp for girls who have been sexually assaulted, when it comes to her job, she just does not seem to care about these (mostly) women or what happens to the (mostly) men who are sexually assaulting them. Andrea describes her job like this: âI work much differently than the legal system. Our schoolâs policy is based on restorative justice. We believe in a continuum of responsibility. Many cases are not black and white. People are not always simply guilty or not guilty. Sexual assault is always one of those challenging situations. In cases I have dealt with, responsibility is on a continuum. Some people are absolute predators who seek vulnerable people and their acts are much more premeditated. In other cases I have seen, one person sought consent and the other party gave consent but because of drugs or alcohol they were not in a place to have given it.â What this sounds like to me could undoubtedly be described as victim blaming. It is no wonder to me now women do not report sexual assaults to our schoolâs grievance officer. Who wants to re-traumatize themselves by going through the details of the time they were raped only to be looked in the eye by another woman and have her tell them that they are responsible for what happened?
Other schools have implemented many sanctions that prevent sexual violence. From punishing rapists with expulsion to mandating a consent class so that all members of the community are well educated regarding what the schoolâs sexual assault policy is and what qualifies as effective consent. Since our school does not even have a sexual assault policy, I am not surprised that people get away with committing sexual assault frequently at Evergreen. Our student conduct code briefly touches upon the problem in one brief and unclear paragraph with lots of room for grey area. There is no mention of coercion, date rape, or any references to support services that are provided for survivors on campus or off. In fact, when the man who raped me admitted to Andrea that he had sexual intercourse with me that evening, the incident still did not break any rules in the student conduct code, despite the fact that I was unconscious at the time.
When a student brings about a complaint against another member of the community for a violent sexual offense, the school follows the same protocol as it does for all other offences. It seems like at Evergreen most first time offences are met with a slap on the wrist. I cannot fathom why they do not see a difference between raping somebody and smoking pot, but that is the way it appears. As Andrea put it, âit is not as simple as these people are guilty for marijuana. You have to look at who brought it, whose pipe it was, who actually smoked it, and who just passed it along to the next person.â By allowing these rapists off without any repercussions our school is, without a doubt, encouraging rape. It appears to me that there is a complete lack of consequence for committing such a violent crime. The slighter the punishment the more it seems to the accused (and everyone else) that there is really nothing wrong with what they did. It also appears to me that we value a manâs life (even one who is a sexual predator) more than the next woman that he might attack. In our meeting I decided to begin the process of re-filing this report. The first step in this process is typically a no-contact order, which states that the assailant and victim shall have no form of contact with one another and also must maintain a distance of 100 feet. I was surprised to find that this order goes both ways. In order to, I assume, discourage women from undergoing this process, they have made it so that it is an inconvenience for them. Now, if I need to print something off in the computer lab, and I see the man that raped me inside, I must exit the computer lab because he was there first. The next step in the process would be to suggest a punishment that I see fit. In this case, I believe that the punishment be the most extreme that our school offers. In cases of sexual assault, students can only be sentenced to a maximum one-year suspension and may return the following year assuming they have undergone all required steps for ârecoveryâ suggested during the psychosexual evaluation that is usually required when a student is suspended for such a crime. A one-year suspension seems pretty lenient to me. I think that it should at least be extended to serve for the duration that the victim attends the school. If the accused is found guilty of breaking a rule in the student conduct code, a punishment is suggested, the accused may take that settlement or undergo the appeals process in which a hearing occurs and a hearing board may choose to agree or disagree with the investigationâs findings and then decide to add or subtract any sanctions. Once the appeals process is over, the victim is finally informed of the findings of the investigation and the prescribed sanctions.
The investigation that occurs is based on a preponderance of evidence. This means that they need to be able to agree on whether or not it is more likely than not that this incident occurred. Andrea feels that, âtwo people can have different recollections of what happened based on the lens that they wear. Rather than âthis person is right, this person is wrongâ. Asking people to take responsibility for their part is significant.â Gee, Andrea, what do you mean, âlensâ? So since a man is raised in a patriarchal misogynistic society where rape is an accepted part of our culture, does that mean that men who were raised in America can commit rape against another and because they might have been raised to believe that it is okay, then they are not wrong when raping another student? Sure sounds like it. At the end of the investigation Andrea underwent regarding my complaint, she determined that he had not broken any rules on the student conduct code, since âhe thought that he was receiving consentâ. Upon leaving our final meeting I was told that I could not take the packet she allowed me to read, in which my perpetrator admits to having had sexual intercourse with me. When I asked her why I was not allowed to take it, she told me that it was because the accused has a right to his privacy. I then told her she would have to chase me because I was taking it anyways, at which point she threatened to call the police.
Andrea openly admitted that, âthere has never really been a situation in which the victim is really happy about the outcome.â If our school is not responding to these crimes appropriately, then when does it become our responsibility to do so? It is time for real change to come about; whether it be through the implementation of a sexual assault policy, or radical social justice.
