⚠️ What exactly is dangerous about the new Civil Code (https://itd.rada.gov.ua/billinfo/Bills/Card/69837) for LGBTQ people?

After a heated discussion about "marriage at 14", this item was removed from the new Civil Code and public attention to it almost disappeared.

It was even rewritten taking into account the recommendations of committees and NGOs and introduced as a new one. Taking into account the recommendations of everyone, except LGBTQ people.

On April 9, another "unique" draft of the new Civil Code of Ukraine (No. 15150) was registered. To be honest, I was hoping to see fundamental changes, because the lawmakers could not help but react to the outrage over the proposed versions of draft 14394 and its clones, but they were able to do it. Today I reviewed two key blocks that interested me and that my colleagues and I worked on – women's rights and LGBT rights. In short, there are no improvements, only a few norms that were already too outrageous were removed, such as lowering the marriage age.

😘On women's rights (it couldn't be simpler):

Divorce - the court will have to determine a mandatory period for reconciliation if the spouses have a minor child or a child with a disability (Article 1513).

Surname - after a divorce, the ex-husband may demand that you return his surname if he believes that you have behaved "indecently" or committed an "immoral act" (Article 1516).

Engagement – ​​you may be charged with moral damages if you refused to marry after the engagement (Article 1488).

Alimony – it becomes more convenient for debtors - alimony for the past time can now be collected for a maximum of 1 year (Art. 1631), and under an executive document — for a maximum of 3 years instead of the current 10 (Art. 1632).

Reproductive rights – assisted reproductive technologies only for medical reasons (Art. 305).

🏳️‍🌈 According to LGBT rights (you do not exist):

De facto family union - only the union of "woman and man" (Art. 1474). Accordingly, the same applies to international private law: if one of the partners is a citizen of Ukraine, the union is recognized only between a woman and a man (Art. 1875) even if the relationship is recognized abroad.

Do you want to adopt a child? It will not work, because adoptive parents cannot be persons of the same sex (Art. 1660).

It is also impossible to dispose of one's own reproductive biological material by granting the right to use it to one's partner, because this is provided for a person of the opposite sex (Article 1735).

In inheritance - the third line includes a partner "in a de facto family union" (Article 1759), but the de facto union is only heterosexual, and therefore there are no chances.

If your partner has changed sex - your marriage becomes invalid from the date of registration of the change of sex (Article 1495).

👀 And finally, as the cherry on the cake - the concept of "good manners", as "a set of moral norms and principles, standards of ethical behavior and generally recognized ideas about proper behavior, established in society" (Article 6) remains.

👼 What is "Common sense"? The new Civil Code explains it as follows:

Private relations are regulated taking into account common sense. Common sense is a set of moral norms and principles, standards of ethical behavior and generally accepted ideas about proper behavior, established in society.

If public relations contradict common sense, legal consequences arise, determined by this Code and/or another law, or agreement. This word occurs in the draft law 45 times! Forty-five times this blurred, like diopters of unsuitable, wording is inserted EVERYWHERE! For example, Article 317. The right to individuality …

A natural person has the right to form, preserve and change his individuality taking into account the peculiarities of biological, mental, psychological, social, cultural, national, religious, linguistic and other identity, as well as to freely choose the forms and methods of manifestation of his individuality, if this does not contradict the Constitution of Ukraine, this Code and/or other law, common sense. … The establishment of differences, restrictions, privileges or requirements in relations is not discrimination against a natural person on the grounds of individuality, if they are objectively justified, reasonable, have a legitimate goal, the methods of achieving which are appropriate and necessary, in particular: … 6) protection of common sense.
