Ontario Superior Court declares wife sole owner of Yorkshire Terrier in family law dispute
Recently, the Ontario Superior Court was tasked with resolving a unique issue involving the custody of a family pet, a Yorkshire Terrier named Meg. The applicant Emanuella Souza Franco filed a motion against her ex-husband to determine the rightful owner of the dog.
Background of the Case
The couple started cohabiting since May 2010 and were later married in June 2017. During their relationship, Richardo purchased Meg in April 2014 as a gift for Emanuella, which became a point of conflict after their separation in March 2023. Further, from October 12, 2023, to October 29, 2023, the respondent left Meg in the exclusive care of the wife, in order to travel and move residences. After returning from his trip on October 20, he did not recollect Meg until 9 days later, which does show negligence on his part. To add on to the conflict, on November 20, 2023, Richardo informed Emanuella of his intentions to never return Meg to her. Following this, the applicant made several attempts to resolve the matter of Meg’s custody amicable but met with failure consistently. This prompted the applicant to reach out to court.
Laws on Pet Ownership in Canada
In Canada, pets are legally recognized as personal property. However, over the years family lawyer has witnessed a broader approach. It must be noted that the relationship between a pet and an owner is more of an emotional one than transactional. Let’s delve into both traditional and expanded approaches used by courts to resolve pet ownership issues.
Traditional:Â This approach primarily focuses on who paid for the pet. It highlights transactional evidence, such as receipts or transfer documents.
Expanded:Â This approach recognizes the complexity of human-animal relationships. For example, what was the relationship of the person with the animal when it was first purchased. Any express or implied agreements regarding ownership made at the time the animal was acquired or thereafter. Factors like, who provided primary care for the animal and bore the financial responsibilities for food, healthcare, and general wellbeing.
Judicial Perspective: This approach considers both who paid for the dog and who provided ongoing care.
Application of Pet ownership laws on Franco V. Franco case
For this case the court adopted the expanded approach to deliver a fairer outcome. By the application of these principles, the court to came up with following examinations:
While Richardo initially purchased Meg, the broader factors favored Emanuella as the primary caretaker.
Emanuella’s consistent role in caring for Meg, supported by veterinary records and personal testimonies, painted a comprehensive picture of her involvement.
Testimonies and written agreements at the time of acquisition indicated that Meg was intended as a gift to Emanuella, which held weight in the court’s decision-making process.
Evidence and Application of the Law
The respondent urged the Ontario Superior Court to determine the rightful ownership of Meg under Section 10 of the Family Law Act (FLA). The application of Section 10 in this case focused strictly on establishing ownership based on evidence presented regarding the history and treatment of Meg as property.
Evidence of Ownership: Emanuella presented multiple documents supporting her claim as the rightful owner:
Purchase Agreement: The 2014 agreement with the breeder which listed Emanuella as Meg’s owner.
Microchip Registration: Original registration in Brazil also listing her as the owner.
Veterinary Records: Both in Brazil and Toronto, which frequently listed Emanuella as the primary contact and owner.
Communications and Affidavits: Emails and declarations reinforcing her active role in Meg’s care and ownership decisions.
Negligence by Richardo: Moreover, evidence showing periods where Richardo left Meg unattended, added to the fact that he was not a responsible owner.
What was the Final Decision of the Court?
As per the evidence displayed by the applicant and by involving the broader approach to resolve the conflict of pet ownership in this case, the court was compelled to rule in favor of Emanuella, affirming her as the sole owner of Meg. The respondent was ordered to immediately return possession of Meg, including any or all documents related to the dog. Further an amount of $5000, including HST was awarded to the applicant, which had to be paid by the applicant within 30 days as well.

Will Quebec’s latest move be a turning point for Canadian immigration?
Quebec has suspended two of its major immigration programs: the Quebec Experience Program and the Regular Skilled Workers Program. The suspension is effective till 30th June 2025, with the target of better management in integration and protection of the French language. The suspension will impact the provincial admissions strategy in the coming years ahead.
Immigration Minister Jean-Francios Roberge said that halting the immigration program was a necessary move. He supported the argument, stating that if the government had not taken this action, the number of permanent residents would have reached 70,000. The rapid flow of new immigrants was putting a strain on the economic resources of Canada. The increased number of immigrants is now facing housing shortages, plus the unemployment gap has also increased for Canadian nationals. Recently, in August, Quebec paused the Temporary Federal Worker application in Montreal for 6 months. Again, in October, the government put a limit on the international students in the province. The above measures have been taken to better manage and control the newcomers.
Quebec Experience Program and the Regular Skilled Workers
The suspension targets skilled workers and recent graduates to “better regulate” newcomers. QEP was for experienced workers in Quebec, wish to apply under Quebec Experience program, contributing to the economic development of the province. The QSWP was for skilled worker individuals who wanted to migrate to Quebec, Canada based on normal skilled worker stream. The reason these programs have been suspended is so that the Quebec government can revise and review their effectiveness with the economic goals of Quebec. By freezing the programs, the provincial government of Quebec will get an update on the requirements of Quebec’s society. This will enhance the focus on policies and sustainability, facilitating the integration of newcomers into society.
The prohibition on the programs, however, comes with positive planning for the future. It has been announced by the Canadian government that 67,000 immigrants will be welcomed in 2025. The figure indicates a positive comeback as compared to 52,800 in 2023 and 61,450 in 2024. When the program reopens in 2025, it is going to be an exceptional one. As targeted by Jean-François Roberge, in 2025, 80% of new applicants will know the French language. Therefore, to maximize your chances of immigrating to Canada in 2025, our immigration lawyers recommend learning French.
How will Potential Immigrants Benefit from the Suspension?
Create legally binding parenting plans in Mississauga with help from our family lawyers. Ensure fair time-sharing and child access under Ont
The suspension of Quebec’s immigration program will bring down the waiting period for applications. The time taken for the re-evaluation of programs will help to clear out the backlog of applications. It will also help the government officials to streamline the overall procedure, making it more transparent and efficient for applicants. The chance for errors and confusion will improve drastically, allowing the candidate to successfully submit their immigration application. As a result, 20205 applicants can expect better opportunities. Especially those who are highly skilled and are aligned with Canada’s in-demand jobs.

With deportation numbers rising, Canada’s getting tough on immigration
While everybody seems to be focused on the United States ramping up deportations under the new Trump administration, it seems that Canada has been heading in that direction already. Figures indicate that Canada’s deportation numbers rose to their decade-highest in 2024, and this number might even go higher next year with more funds allocated for deportations in the budget for 2025. The majority of the deportees were rejected refugee status applicants, the Canadian border agency confirmed to Reuters.
The government’s actions were in response to the housing and infrastructure coming under extraordinary pressure following the rising number of immigrants in the last few years. The housing shortage seems to be worsening, prompting the Trudeau government to ramp up the deportations. The border agency clarified that they had witnessed an increase in people applying for asylum status since 2020, and they have been taking measures to implement the removal orders effectively.
The Reuters news agency obtained the figure for 2024 from the Canadian border agency, excluding those who left on their own as well as those asylum seekers who were turned back to the United States as part of the bilateral agreement. Excluding the above, the total number of deportees for the period from January 1 to November 19 comes to around 7300 in 2024. While this is not the full total, it is clear that annual deportation numbers reached the highest level since 2015 in 2024, and at least 79% of these deportees are failed refugee claimants. According to Reuters, refugee lawyers have reported that the applicants were being deported even when their cases were awaiting appeal.
The rising housing shortage has pushed public opinion against immigration, prompting the Trudeau administration to take a tougher stance. Already, the pending refugee claims have reached record levels. The figure at the end of January 2025 stands at 278,457 and will only go higher. As things stand, one should expect a proportional increase in the number of deportations this year.
If you are facing deportation or removal orders, reach out to our legal team for a free consultation. Our experienced immigration lawyers can help you with the appeal process and improve your chances of success.

Divorce in Mississauga: How It Can Impact Your BusinessÂ
When most people think of divorce, they think about property, custody, or spousal support. But for entrepreneurs and business owners in Mississauga, divorce presents a unique set of challenges—especially if your business is your main source of income or a major asset. The business you built with years of hard work could suddenly become part of your equalization of net family property, even if your spouse wasn’t directly involved in running it.Â
That's why it’s crucial to consult the best family lawyer near me to fully understand the financial risks and protection strategies available under Ontario family law.Â
Can Your Spouse Claim Part of the Business?Â
In Ontario, businesses are not automatically excluded from division during divorce. If you started or significantly grew your business during the marriage, the increase in its value can be considered a divisible matrimonial asset. That means your spouse may have a claim to a portion of its worth—even if they weren’t involved operationally.Â
Factors courts consider include:Â
When the business was startedÂ
Its value at the beginning and end of the marriageÂ
Whether it contributed to family income or lifestyleÂ
Your spouse’s non-financial contributions (e.g., childcare or admin support)Â
Business Valuation During Divorce ProceedingsÂ
A professional valuation is often necessary to assess the business's market value. This can include analyzing income statements, cash flow, growth potential, and industry comparisons. In high-conflict divorces, spouses may even hire separate experts, leading to disputes over value.Â
This is why working with a divorce lawyer near me who has handled business-related divorces in Mississauga is so important. They will coordinate with accountants and business appraisers to present a defensible and fair value.Â
Protective Measures for Business OwnersÂ
Here’s how a seasoned lawyer family law near me can help protect your business:Â
Drafting or enforcing marriage contracts or shareholder agreementsÂ
Structuring a buyout agreement for your spouse’s shareÂ
Preventing liquidation or forced saleÂ
Negotiating equitable property settlements that protect operationsÂ
If you’re already separated, a lawyer can also seek an order for exclusive control of the business and its records while proceedings are ongoing.Â
Mississauga-Specific ConsiderationsÂ
Mississauga family courts handle business division cases regularly, particularly in areas like Clarkson, Port Credit, and downtown. A local lawyer familiar with Peel Region courts will understand the nuances of these cases and how to align your legal strategy accordingly.Â
Own a business and facing divorce? Don’t put your life's work at risk. Consult the best family lawyer near me in Mississauga today to safeguard your business, your finances, and your future.Â
