there was trial by combat over land where people would go to court with some soil, touch weapons to the soil, and then hack at each other. loser gives up the land and pays a fine

I think the idea was that if God let you win clearly you were correct. Kind of a leftover from the old pagan days in some cases. This was often a practice at things (actual term for a meeting of the leaders of Germanic tribes).
