In closing, President Trump’s egotism has distorted US foreign policy into vanity theatre: he treats war less as a grave public responsibility than as a stage for proving his own toughness. His illegal unilateral war on Iran is proving to be strategic blunder of the highest order—reckless, futile, and almost certainly self-defeating—because it has inflamed the region, empowered the very forces he claims to weaken, and trapped the United States in another endless conflict with no credible exit. It has also exposed how isolated Washington has become from many of its allies, who are increasingly unwilling to follow the United States into lawless escalation. And the economic blast radius is enormous: oil prices, shipping, supply chains, and global markets are all taking hits, risking wider financial shock far beyond the Middle East. Domestically, immigration enforcement remains one of the most politically charged parts of the Trump era, with ICE repeatedly criticised for heavy-handed raids, family separations, and a broader culture of intimidation that treats vulnerable people as targets rather than human beings. That controversy was sharpened again by yesterday’s Supreme Court ruling, which rejected Trump’s attempt to deny birthright citizenship to immigrants’ children and reinforced the constitutional principle that executive power cannot simply erase settled rights by decree. America 250: isn’t this the moment to stop pretending and restore democratic accountability before the damage becomes irreversible and decline sets in? If not now, when?

He also publicly aligned himself with the Palestinian cause, and in recorded speeches consistently spoke forcefully about Gaza, liberating Palestine and Musjid AlAqsa and Iran’s resistance-oriented posture against Israel, while sharply disavowing normalisation as betrayal.9 10 11 These interventions should be read carefully as documented public positions, not overextended into claims beyond the available recordings.9 10 11 Even there, the same pattern is visible: a scholar connecting doctrine, moral principle, and contemporary Muslim political concerns without reducing any one to slogan.3 9 10 That is why Salman Nadwi ﵀ matters as more than a biographical figure.3 He represented a living Nadwi tradition: deeply rooted in the classical sciences, attentive to social peace, and committed to making scholarship publicly useful.6 7 His death closes a chapter, and while marking another great loss for the Ummah, the method he embodied — serious scholarship joined to ethical and communal purpose — remains part of the abiding legacy he leaves behind.

And perhaps the disproportionality now confronting protesters, lawyers, journalists, and solidarity activists is itself an argument for a written UK constitution — one that citizens can directly invoke, engage, and rely upon when the state turns prosecution into punishment and dissent into suspicion.41 If rights remain dependent on goodwill, interpretation, or political convenience, then they are not yet secure enough to resist abuse.41 In that sense, the crisis may finally be forcing the question Britain has long postponed: whether democracy can survive its own state without a written constitution — one that gives citizens enforceable rights they can invoke, defend, and rely on when officials overstep. Welfare not lawfare nor warfare. For resisting injustice, the best of us should never be treated as children of a lesser god.

Direct action is not a democratic anomaly. It is the engine for societies to gain labour rights, civil rights, anti-colonial independence, suffrage, and environmental justice by shaking free of undue influence and coercive state control.16 The question is not whether protest is comfortable, but whether power can still be challenged without being treated as criminal by default.17 The best of us should not be treated as children of a lesser god when they resist injustice. If they are, the law is no longer upholding or defending democracy; it is undermining and eroding it.18

On 22 June 2026, Mr Justice Johnson delivered a judgment that fundamentally redefines the boundaries of legal advocacy in the UK. [1], [2] The case against Rajiv Menon KC, a veteran human rights advocate, stems from his closing speech in the “Filton Six” trial, where activists were charged with damaging an Elbit Systems facility to prevent what they termed “genocide in Gaza.” [3] This ruling is not just a procedural update; it is a blueprint for how the State intends to manage “protest” cases by restricting what can be said within the four walls of a courtroom. [4], [5]

What activists should note: * If a judge excludes contextual material, challenge it procedurally and preserve the point for appeal. * Do not use closing speeches to smuggle back in arguments the court has ruled off-limits. * Do not invite the jury to apply “jury equity” or conscience-based nullification where the judge has prohibited it. * Keep political messaging separate from courtroom advocacy. * Remember that contempt risk can arise even where the courtroom strategy is framed as fearless or morally urgent.

Still, there is a route back. Labour could restore material credibility through action on living costs, housing, public services, and industrial resilience, alongside a clearer break from elite capture and policy drift. It would also need a more honest foreign policy that prioritises democratic accountability, energy security, and peace over reflexive alignment with outside powers. And after a decade of Brexit disillusionment, politics should stop selling grand narratives and start delivering visible competence, honest trade-offs, and practical improvements people can feel.

This case is not about whether unlawful conduct can be punished. It plainly can. It is not even really about whether government has a legitimate security interest. It plainly does. It is about something much more fundamental: whether the law still keeps a meaningful line between protest and terrorism. Once that line starts to blur, exceptional powers cease to be exceptional. They become part of ordinary governance, and that is exactly how democratic space gets narrowed without anyone ever formally announcing that it is being closed down.¹⁵ That is why this case matters so much. It is not just about Palestine Action. It is about whether citizens can still challenge power, oppose state policy, and engage in disruptive political action without being recast as enemies of the state. And a democracy should think very hard before letting the language of terrorism become the everyday language of dissent.¹⁶

That is the real issue Rosenberg’s article avoids. It assumes the conclusion it wants to prove: that state suppression equals public safety. But the legal and moral picture is more complicated than that. Bottom line If the law is to remain credible, it must be able to distinguish between protest, criminal damage, and terror. Rosenberg’s article blurs those lines. The law should not. If the law is to retain any credibility, it must stop confusing protest with terror and inconvenience with danger. Palestine Action may be controversial and unlawful, but that is not the same as terrorism. The real scandal is not that people are protesting Gaza too loudly; it is that the state is reaching for the most draconian label available to protect itself from accountability. That is not the rule of law. It is the rule of power. When a state calls dissent “terrorism” to protect its own complicity, the problem is no longer the protest movement — it is the political system itself.

In this case, the balance is lopsided. The state has imposed a total criminal ban that restricts peaceful political expression and association across the country to address a partial public-safety concern. This blanket approach fails to strike a fair balance, resulting in an unconstitutional restriction on democratic dissent. The Court of Appeal’s judgment represents a significant expansion of the state’s counter-terrorism machinery into the regulation of domestic political protest. By treating organized property damage as terrorism and granting excessive deference to the Executive, the Court of Appeal weakened the judicial protections established by the Human Rights Act 1998. The Appellant’s case provides a necessary correction. It re-establishes the distinction between criminal damage and terrorism, reasserts the court’s constitutional duty to conduct independent proportionality reviews, and protects the rights of peaceful political advocates. The Supreme Court should allow the appeal and restore the Divisional Court’s order quashing the proscription.

Reaffirming the Boundaries of Democratic Dissent The appeal in Ammori v SSHD gives the UK Supreme Court a vital opportunity to correct this imbalance in public law. If the Court of Appeal’s ruling stands, it establishes a dangerous precedent where the definition of terrorism can be expanded to protect corporate state interests from disruptive protest, while entities trading in illegally occupied land are granted state protection.[^2] [^6] The Supreme Court must rule that Articles 10 and 11 protect disruptive dissent short of physical violence to persons.[^4] It must reject this asymmetrical use of counter-terrorism powers and reaffirm that a fair, democratic society cannot maintain a two-tier system of justice. The UKSC must grapple decisively with the thorny issue of the carefully hidden but tragically real costs of false entitlement and their complete incompatibility with the rule of law, both domestically and internationally, for the sake of the credibility of the British judiciary. For the sake of that very judicial credibility, the Court must recognize that failing to do so subverts the equal application of the law, undermines public trust, and threatens to collapse the institutional frameworks, human rights, and civil liberties that form the core foundations of democratic accountability.

The Ultimate Test for the Supreme Court The appeal in Ammori v SSHD provides the UK Supreme Court with a vital opportunity to re-establish limits on executive power. If the Court of Appeal’s ruling stands, it establishes a precedent where the definition of terrorism can be expanded to protect corporate state interests from disruptive protest, while violent far-right movements are treated with relative leniency. The Supreme Court must rule that Articles 10 and 11 protect disruptive dissent short of violence to persons. It must reject this asymmetrical use of counter-terrorism powers and reaffirm that a fair, democratic society cannot maintain a two-tier system of justice. Failing to do so subverts the equal application of the rule of law, ultimately undermining democratic stability and risking structural collapse.

Deconstruct the “Secret Cell” Narrative: The Court of Appeal was clearly spooked by the group’s decentralized, horizontal structure. The defense must show that operating in decentralized groups is standard practice for modern social movements (like Extinction Rebellion or Just Stop Oil) to prevent heavy-handed, preemptive policing—not a sign of a clandestine terrorist syndicate. They must hammer home the fact that the state can and has successfully prosecuted these activists using ordinary criminal law. [^16] Leverage International Law: The Court of Appeal largely ignored warnings from the UN Special Rapporteur on Counter-Terrorism about the dangerous trend of Western states weaponizing national security laws against political dissenters. [^17] The Supreme Court must be reminded of European Court of Human Rights jurisprudence, which consistently rules that while states can punish property damage under domestic criminal law, upgrading non-violent protest to “terrorism” violates the democratic minimums of a free society. [^18] Target the Original Intent: Relying only on a human rights argument gives the Supreme Court an easy out to defer to the government on national security. Instead, the legal team needs to challenge the interpretation of the law itself. They must argue that when Parliament passed the Terrorism Act 2000, its intent for the phrase “serious damage to property” was aimed at high-consequence attacks on critical infrastructure (like blowing up the National Grid), not protestors throwing red paint on a corporate weapons facility.

Direct action is not a marginal or aberrant form of protest. It is a historically constitutive mechanism through which democratic rights have been won, expanded and defended. The Court of Appeal’s judgment, whilst acknowledging the “very significant interference” with Art 10 & 11 ECHR³, errs by placing organisational secrecy and property damage outside constitutional protection without sufficient regard for the democratic function direct action performs⁴. The Supreme Court must restore the balance. The judgment itself recognises that “many law-abiding citizens” support Palestine Action and that proscription creates a “chilling effect” on those wishing to support “the Palestinian cause”⁵. Yet it then minimises that chill⁶. This is constitutionally incoherent: a right cannot be both “very significant” and lightly dismissed.
