Eating the Slaughtered Meat of the People of the Book
His statement, ยซThe food of those given the book is unbound for youยป (Al-Mฤสฟidah 5:5), ูููููููู: ููุทูุนุงู ู ุงูููุฐูููู ุฃููุชููุง ุงููููุชุงุจู ุญูููู ููููู ู ุงูุทููุนูุงู ู: โFoodโ is the name for what is eaten and from it are the slaughtered animals. Most of the people of knowledge opined narrowing it down to the slaughtered animals. ุงุณูู ู ููู ูุง ููุคูููููุ ููู ููููู ุงูุฐููุจูุงุฆูุญูุ ููุฐูููุจู ุฃูููุซูุฑู ุฃููููู ุงููุนูููู ู ุฅูููู ุชูุฎูุตููุตููู ููููุง ุจูุงูุฐููุจูุงุฆูุญู. In this verse is an evidence for all the food of the People of the Book, without a difference between the meat and other than it, [being] lawful for Muslims, even if they did not mention Allฤhโs name upon their slaughtered animals and this verse being a restriction to the generality of His statement, ยซand do not eat from what Allฤhโs name was not mentioned uponยป (Al-Anสฟฤm 6:121). ููููู ููุฐููู ุงููุขููุฉู ุฏูููููู ุนูููู ุฃูููู ุฌูู ููุนู ุทูุนูุงู ู ุฃููููู ุงููููุชูุจู ู ููู ุบูููุฑู ููุฑููู ุจููููู ุงููููุญูู ู ููุบูููุฑููู ุญูููุงูู ููููู ูุณูููู ูููู ููุฅููู ููุงูููุง ููุง ููุฐูููุฑูููู ุนูููู ุฐูุจูุงุฆูุญูููู ู ุงุณูู ู ุงููููููุ ููุชูููููู ููุฐููู ุงููุขููุฉู ู ูุฎูุตููุตูุฉู ููุนูู ููู ู ูููููููู: ูููุง ุชูุฃููููููุง ู ูู ููุง ููู ู ููุฐูููุฑู ุงุณูู ู ุงูููููู ุนููููููู. The obvious [meaning] of this is that the slaughtered animals of the People of the Book is lawful, even if a Jew mentions the name of โUzair (Ezra) upon his slaughtered animal and a Christian mentions the name of the Messiah (Jesus) upon his slaughtered animal; this was opined by Abลซ al-Dardฤโ, โUbฤdah bin asโSฤmit, Ibn โAbbฤs, az-Zuhrฤซ, Rabฤซโah, ash-Shaโbฤซ, and Makยทhลซl. โAlฤซ, โAโishah, ููุธูุงููุฑู ููุฐูุง ุฃูููู ุฐูุจูุงุฆูุญู ุฃููููู ุงููููุชูุงุจู ุญูููุงููุ ููุฅููู ุฐูููุฑู ุงูููููููุฏูููู ุนูููู ุฐูุจููุญูุชููู ุงุณูู ู ุนูุฒูููุฑูุ ููุฐูููุฑู ุงููููุตูุฑูุงููููู ุนูููู ุฐูุจููุญูุชููู ุงุณูู ู ุงููู ูุณููุญู. ููุฅููููููู ุฐูููุจู ุฃูุจูู ุงูุฏููุฑูุฏูุงุกู ููุนูุจูุงุฏูุฉู ุจููู ุงูุตููุงู ูุชู ููุงุจููู ุนูุจููุงุณู ููุงูุฒููููุฑูููู ููุฑูุจููุนูุฉู ููุงูุดููุนูุจูููู ููู ูููุญูููู. ููููุงูู ุนูููููู ููุนูุงุฆูุดูุฉู And Ibn โUmar said, โIf you heard the kitฤbฤซ (i.e., the Jew or Christian) naming other than Allฤh, then do not eat.โ ููุงุจููู ุนูู ูุฑู: ุฅูุฐูุง ุณูู ูุนูุชู ุงููููุชูุงุจูููู ููุณูู ููู ุบูููุฑู ุงูููููู ููููุง ุชูุฃูููููุ And it is [also] the saying of Tฤwus and al-แธคasan, and they held to His statement, exalted is He ยซand do not eat from what Allฤhโs name was not mentioned uponยป (Al-Anสฟฤm 6:121). ูููููู ูููููู ุทูุงููุณู ููุงููุญูุณููู ููุชูู ูุณูููููุง ุจููููููููู ุชูุนูุงููู: ูููุง ุชูุฃููููููุง ู ูู ููุง ููู ู ููุฐูููุฑู ุงุณูู ู ุงูููููู ุนููููููู [ุงูุฃูุนุงู : 121] It is also indicated by His statement, ยซand what is offered [as sacrifice] to other than Allฤhยป (Al-Naแธฅl 16:115). ููููุฏูููู ุนููููููู ุฃูููุถูุง ูููููููู: ููู ุง ุฃูููููู ููุบูููุฑู ุงูููููู ุจููู Mฤlik said, โIt is surely detested, and not forbidden.โ ููููุงูู ู ูุงูููู: ุฅูููููู ููููุฑููู ููููุง ููุญูุฑูู ู. This difference is if we knew that the People of the Book mentioned the name of other than Allฤh upon their slaughtered animals. As for with the lack of knowledge, then atโแนฌabarฤซ and Ibn Kathฤซr had related the concensus on its unbinding due to this verse, and due to what was mentioned in the Sunnah of his (i.e., the Prophetโs) eating the roast lamb that was given to him [as a gift] by the Jewish woman; it is also in the Sahฤซh, and likewise the bag of suet that some of the Companions took from Khaibar, and the Prophet, may Allฤh send salutations and peace upon him, knew of that; it is also in the Sahฤซh, and other than that. ููููุฐูุง ุงููุฎูููุงูู ุฅูุฐูุง ุนูููู ูููุง ุฃูููู ุฃููููู ุงููููุชูุงุจู ุฐูููุฑููุง ุนูููู ุฐูุจูุงุฆูุญูููู ู ุงุณูู ู ุบูููุฑู ุงููููููุ ููุฃูู ููุง ู ูุนู ุนูุฏูู ู ุงููุนูููู ู ููููุฏู ุญูููู ุงููููููุง ุงูุทููุจูุฑูููู ููุงุจููู ููุซููุฑู ุงููุฅูุฌูู ูุงุนู ุนูููู ุญููููููุง ููููุฐููู ุงููุขููุฉูุ ููููู ูุง ููุฑูุฏู ููู ุงูุณูููููุฉู ู ููู ุฃููููููู ุตููููู ุงูููููู ุนููู ููุณููููู ู ู ููู ุงูุดููุงุฉู ุงููู ูุตููููููุฉู ุงูููุชูู ุฃูููุฏูุชูููุง ุฅููููููู ุงูููููููุฏููููุฉูุ ูููููู ููู ุงูุตููุญููุญูุ ููููุฐููููู ุงููุฌูุฑูุงุจู ุงูุดููุญูู ู ุงูููุฐูู ุฃูุฎูุฐููู ุจูุนูุถู ุงูุตููุญูุงุจูุฉู ู ููู ุฎูููุจูุฑู ููุนูููู ู ุจุฐูู ุงููููุจูููู ุตููููู ุงูููููู ุนููููููู ููุณููููู ู ูููููู ููู ุงูุตููุญููุญู ุฃูููุถูุง ููุบูููุฑู ุฐููููู. The intent of the People of the Book here is the Jews and the Christians. As for the Magians, then the general collective opined that their slaughtered animals are not eaten, nor are their women married, because they are not the People of the Book according to the reknowned [view] with the people of knowledge. Abลซ Thawr differed in that and the jurists rebuked him for that, such that Aแธฅmad bin แธคanbal said, โAbลซ Thawr is like his name, โ i.e., in this issue (Abลซ Thawr means father of the ox). It was as if he clung to what is narrated from the Prophet, may Allฤh send salutations and peace upon him, in mursal form, that he said, ยซEstablish the tradition of the People of the Book with them, ยป and it is not established with this expression. On the assumption that it has an origin, then it has an addition [that] disproves what he (i.e,. Abลซ Thawr) said, and it is his statement, ยซnot those who eat their slaughtered animals, nor those who marry their women.ยป A group from those who have no experience in the science of แธฅadฤซth from the exegetes and the jurists; the origin is not established, nor is the addition. Rather, what is established in the Sahฤซh is that the Prophet, may Allฤh send salutations and peace upon him, took the jizyah from the Magians of Hajar. As for the sons of Taฤกlib, then โAlฤซ bin Abฤซ แนฌฤlib used to prohibit from their slaughtered animals because they were Arab and he used to say, โSurely, they do not hold to anything from Christianity other than the drinking of wine.โ And likewise the rest of the Christianized Arabs like Tanลซkh, Judhฤm, Lakhm, โรmilah, and whoever resembled them. Ibn Kathฤซr said it is the saying of several from the Predecessors and the successors. ููุงููู ูุฑูุงุฏู ุจูุฃููููู ุงููููุชูุงุจู ููููุง ุงูููููููุฏู ููุงููููุตูุงุฑูู. ููุฃูู ููุง ุงููู ูุฌููุณูุ ููุฐูููุจู ุงููุฌูู ููููุฑู ุฅูููู ุฃููููููุง ููุง ุชูุคููููู ุฐูุจูุงุฆูุญูููู ู ููููุง ุชูููููุญู ููุณูุงุคูููู ู ููุฃููููููู ู ููููุณููุง ุจูุฃููููู ููุชูุงุจู ุนูููู ุงููู ูุดููููุฑู ุนูููุฏู ุฃููููู ุงููุนูููู ูุ ููุฎูุงูููู ููู ุฐููููู ุฃูุจูู ุซูููุฑูุ ููุฃูููููุฑู ุนููููููู ุงููููููููุงุกู ุฐููููู ุญูุชููู ููุงูู ุฃูุญูู ูุฏู ุจููู ุญูููุจููู: ุฃูุจูู ุซูููุฑู ููุงุณูู ูููุ ููุนูููู ููู ููุฐููู ุงููู ูุณูุฃูููุฉูุ ููููุฃูููููู ุชูู ูุณูููู ุจูู ูุง ููุฑูููู ุนููู ุงููููุจูููู ุตููููู ุงูููููู ุนููููููู ููุณููููู ู ู ูุฑูุณูููุง ุฃูููููู ููุงูู ููู ุงููู ูุฌููุณู: ยซุณูููููุง ุจูููู ู ุณููููุฉู ุฃููููู ุงููููุชูุงุจูยป ููููู ู ููุซูุจูุชู ุจูููุฐูุง ุงููููููุธูุ ููุนูููู ููุฑูุถู ุฃูููู ูููู ุฃูุตูููุง ููููููู ุฒูููุงุฏูุฉู ุชูุฏูููุนู ู ูุง ููุงููููุ ูููููู ูููููููู: ยซุบูููุฑู ุขููููู ุฐูุจูุงุฆูุญูููู ู ููููุง ููุงููุญูู ููุณูุงุฆูููู ูยป. ููููุฏู ุฑูููุงูู ุจูููุฐููู ุงูุฒููููุงุฏูุฉู ุฌูู ูุงุนูุฉู ู ูู ูููู ููุง ุฎูุจูุฑูุฉู ูููู ุจูููููู ุงููุญูุฏููุซู ู ููู ุงููู ูููุณููุฑูููู ููุงููููููููุงุกูุ ููููู ู ููุซูุจูุชู ุงููุฃูุตููู ููููุง ุงูุฒููููุงุฏูุฉูุ ุจููู ุงูููุฐูู ุซูุจูุชู ููู ุงูุตููุญููุญู ุฃูููู ุงููููุจูููู ุตููููู ุงูููููู ุนููู ููุณููููู ู ุฃูุฎูุฐู ุงููุฌูุฒูููุฉู ู ููู ู ูุฌููุณู ููุฌูุฑูุ ููุฃูู ููุง ุจูููู ุชูุบูููุจู ููููุงูู ุนูููููู ุจููู ุฃูุจูู ุทูุงููุจู ููููููู ุนููู ุฐูุจูุงุฆูุญูููู ู ููุฃููููููู ู ุนูุฑูุจูุ ููููุงูู ููููููู: ุฅููููููู ู ููู ู ููุชูู ูุณูููููุง ุจูุดูููุกู ู ููู ุงููููุตูุฑูุงูููููุฉู ุฅููููุง ุจูุดูุฑูุจู ุงููุฎูู ูุฑูุ ููููููุฐูุง ุณูุงุฆูุฑู ุงููุนูุฑูุจู ุงููู ูุชูููุตููุฑูุฉู ููุชููููุฎู ููุฌูุฐูุงู ู ููููุฎูู ู ููุนูุงู ูููุฉู ููู ููู ุฃูุดูุจูููููู ู. ููุงูู ุงุจููู ููุซููุฑู: ูููููู ูููููู ุบูููุฑู ููุงุญูุฏู ู ููู ุงูุณูููููู ููุงููุฎููููู. It was narrated from Saโฤซd b. al-Musayyab and al-แธคasan al-Basrฤซ that they both did not see any harm in the slaughtered animals of the Christians of the sons of Taฤกlib. al-Qurแนญubฤซ said the general collective of the [Muslim] nation said surely the slaughtered animal of every Christian is lawful, whether he was from the sons of Taฤกlib or from other than them. Likewise the Jew.
