After an 820, How Long Does It Require to Obtain An 801 Visa?

From the moment you get the 820 Visa, you usually have to wait about two years before you become eligible for an 801 Visa. However, you may be able to get the 820 and 801 visas at the same time if:

You and your spouse have been married or cohabiting for at least two years and have a kid together.

You and your spouse have been married or living together for a minimum of at least three years and do not have any children together.

Requirements for Subclass 801 Eligibility

You must still be together with your spouse in order to qualify for the 801 Visa (sponsor). You should still fulfill the prerequisites to become an Australian legal resident, such as:

Be a decent person.

Have compensated the Australian government for all debts.

Possess an active Subclass 820 Visa.

Requirements For 801 Partner Visa in Australia

You must provide the following documentation before receiving an 801 Visa:

Copied from a photocopy of your passport. Include the photo, expiration date, and personally identifiable information page.

Evidence that you and your spouse are still together.

A marriage certificate (for married spouses).

Evidence that you are living with each other and you are in a devoted, monogamous relationship.

Proof you and your partner have joint finances.  This can include electricity bills in both names, a shared bank account, a joint home or bank loan, etc.

Australian police clearance for you and any dependents who are older than 16 years old. only if you didn't submit it when you applied for the temporary visa.

Finished Report of changes in circumstances in the form 1022.

Additional records relevant to the modification (marriage certificate, adoption If you have a new or updated passport or changed your address.

Modification of address and/or passport information form 929

Your respective children's passports

A scanned copy of your partner's passport (which must bear their signature) or their driving license from Australia.

You Should Keep in Mind That:

You may have submitted many or all of these documents when you originally applied for the 820/801 Visa joint application. Only to demonstrate that you and your partner still satisfy the standards are you sending them again.
