Can Patent Law be Agnostic to the Type of Technology at Issue? | Prof. Jay Kesan

The legal and statutory requirements to get a patent are the same regardless of the type of technology that is being patented.  In other words, the legal requirements to get a patent do not change depending on whether a pharmaceutical drug or a 5G wireless technology is being patented. Yet, the role that patent protection plays varies widely depending on the technological area that the patent pertains to.  We will explore and understand these differences by comparing the information technology (IT) sector with the pharmaceutical sector, as two distinctly different examples.
