The verdict is here. The Federal Court refered the case back to the Higher Regional Court of Hamburg, meaning the case is still ongoing.
The reason: In 2002, copyright law was standardised in the European Union. But because the case started in 1997, there was a time where German laws applied (before 2002) and a time where EU laws apply (after 2002). Meaning, all the copies made before 2002 were legal but the ones made after 2002 were not. However it is unknown if any copies of the song were actually made after 2002, so now the Regional Court of Hamburg will have to decide that.
