Yup, it's a failed product. 53 should admit it and offer refunds, but they won't. I use $12 stylus from Fry's. they last about 6 months.
I'm spoiled. I've used Wacom tablets for almost twenty years. The Bamboo smart stylus is very good, and the Maglus dumb stylus is my favorite of that type, but the Pencil -- when it works -- hits a brilliant sweet spot between intuitive operation & extended capabilities. Unfortunately, it doesn't matter how wonderfully designed a tool is if it consistently violates the Jobsian rule of, "It just works."
