First of all, was this alleged first-year a Slytherin? If so, I'm impressed - if Hermione was actually showing concern for a Slytherin, it might be enough to raise her very slightly in my HP character standings.
I refer to the first-year in question as "alleged" because Draco being "absolutely foul" to him/her/them was only mentioned, not shown. Granted, "tell, don't show" is pretty much Rowling's M.O., but we're actually shown both Hermione and Ron being pretty damn foul to younger students in the same book - Hermione using her newfound authority to nag and judge others worse than ever, and Ron using his to nick things from younger students. But, of course, it's okay if a Gryffindor does it! :P
