The National Broadcasting Commission has sanctioned 45 broadcasting stations which allegedly breached its code in the 2nd quarter of 2019. The NBC Director General, Ishaq Kawu, made this known while addressing a news conference on Wednesday in Abuja. He said the contraventions included breaches of the rules on hate speech, abusive, and inflammatory broadcast. Kawu said the Commission’s Second Quarter Monitoring of Broadcast Stations Profile was from April to June 2019. “Coming shortly after the National and State Elections in the First Quarter of the year, the report indicates that though there is a drop in breaches related to hateful, abusive and inflammatory broadcast, which peaked during the elections,” he said. “Thus as many as 45 stations were fined, the 2nd Quarter indicates that the trend has continued among certain stations, especially in political programmes. “Therefore, 20 stations were fined in the 2nd Quarter, for breaching provisions of the Nigeria Broadcasting Code on Hate speech. “Other breaches were in the area of Obscene and Vulgar Lyrics – a total of 10 stations were fined for infractions related to use of Vulgar Lyrics and Obscene Content. “It is worth mentioning that the programme Big Brother Naija was cautioned against unwholesome content on its broadcast,” Kawu said. According to the NBC boss, the use of unsubstantiated and misleading claims by advertisers, especially Tradomedic advertising, also dropped significantly from the last quarter, but that a total of 30 stations were fined for infractions related to same. He added that ten broadcast stations were fined for breaches related to station announcers turning themselves to advertisers, hypers and promoters of product. “Obscenity: Kaduna Zone recorded highest with 36.53 per cent followed by Abuja Zone with 17.31 per cent and Uyo Zone came third with 15.38 per cent. “Hate Speech: Abuja Zone topped the chart with 19.21 per cent followed by Kaduna zone with 18.22 per cent and Maiduguri Zone came third with a record of 15.27 per cent while the least in hate speech was Ibadan zone with 6.89 per cent. “Unprofessionalism: Three zones topped the chart with the same percentages. Kaduna zone, Sokoto zone and Uyo topped the chart with 20.00 per cent each followed by Jos zone with 3.85 per cent while Ibadan and Benin recorded lowest with 2.95 per cent and 3.44 per cent respectively. “Unverifiable Claims: Ibadan zone recorded highest with 25.33 per cent followed by Abuja zone with 13.33 per cent while Jos zone and Kaduna zones came 3rd with 12.00 per cent each and Sokoto zone and Uyo recorded the lowest with 2.67 per cent each. “Advertisement: Abuja zone recorded highest with 24.43 per cent followed by Enugu zone with 16.40 per cent while Maiduguri zone recorded lowest with 1.53 per cent “For Technical Breach, Maiduguri zone recorded highest with 31.81 per cent followed by Benin zone and Sokoto zone recorded same scores 22.73 per cent each while Abuja zone, Enugu zone and Jos zone recorded the lowest with 4.54 per cent each. He cautioned stations across the country about a pattern of behaviours which are a threat to the country’s democracy and rule of law. He maintained that the Commission’s monitoring activities indicated that “some stations, especially African Independent Television are deliberately meddling in the cases before the election tribunal. “It is trite knowledge that the media cannot comment on or discuss the details of any matter in court. “The Broadcast Code in section 1.16.1(f) requires all broadcasters to comply with the law of contempt relating to matters pending before the law courts,” Kawu said. President Muhammadu Buhari and the All Progressives Congress (APC) on Thursday closed their defence in the petition filed at the Presidential Election Petition Tribunal by Peoples Democratic Party and its presidential candidate, Atiku Abubakar. The petitioners are challenging the victory of Buhari and his All Progressives Congress at the February 23, 2019 presidential poll. The five-man tribunal led by Justice Mohammed Garba had, on Monday, asked Buhari’s legal team to open their defence on Tuesday after the Independent National Electoral Commission said it would not call any witness in the case. President Muhammadu Buhari on Tuesday prayed the Presidential Election Petition Tribunal to dismiss petition filed by the Peoples Democratic Party (PDP) and its Presidential Candidate, Atiku Abubakar against his February 23 re-election. Buhari made the prayer through his Counsel, Chief Wole Olanipekun, SAN, in a motion adopted and argued on Tuesday before Justice Mohammed Garba-led five-man panel in Abuja. Olanipekun submitted that the petition was fundamentally defective, adding that his client won the presidential “square and clear’’. He explained that the allegations advanced by the petitioners were mere theoretical assumptions that could not stand the test of critical legal debate. The tribunal also entertained the president’s motion that sought to effect amendment on the identities and addresses of counsel representing him. Another of Buhari’s application seeking to mandate the tribunal to entertain all interlocutory motions before the commencement of proper hearing of the main petition was also adopted and argued. Similarly, the Independent National Electoral Commission (INEC) asked the tribunal to dismiss the petition brought by PDP and Atiku against a “flawless” election that won by Buhari. Yunus Usman, SAN, Counsel for INEC said that the electoral commission would standby the declaration of the second respondent (Buhari) as winner of the February 23 presidential election. Usman said the petition challenging the outcome of the exercise was “misguided”, adding that the allegations of fraud made against the electoral body was “mischievous”. INEC’s application challenged the jurisdiction and competence of the tribunal to entertain the petition. Usman further urged the tribunal to dismiss the petition as the petitioners failed to include the vice president, Prof. Yemi Osinbajo, as a co-winner in the election. “The failure of the PDP and Atiku to include Osinbajo’s name as party should not be overlooked because whatever affects the president affects his running mate,” Usman said. NAN also reports that three other interlocutory motions filed by the All Progressives Congress were argued and dispensed with. Chief Lateef Fagbemi, SAN, Counsel for the APC had urged the tribunal to strike out 18 paragraphs of the petition, he claimed, have frivolous assumptions among other prayers. He submitted that the competence of the petition was questionable, adding that it would soon become a mere “lame duck”. Meanwhile, Levi Uzoukwu, SAN, Counsel for the petitioners prayed the tribunal to discountenance all the arguments canvassed by the respondents, describing INEC’s position in the matter as “unusual”. The Coalition 4 Change (C4C) and its Presidential Candidate in the February 23 presidential election on Monday withdrew their joint petition filed against the re-election of Muhammadu Buhari as president at the Presidential Election Petition Tribunal. The dismissal was sequel to an application for withdrawal of the petition filed by the party (C4C) and its presidential candidate, Geff Ojinika. In their petition, marked CA/PEPC/003/2019, they prayed for the cancellation of the election that produced Buhari as the winner on grounds of gross irregularities and violation of Electoral Act 2010, as amended. Justice Mohammed Garba granted the oral application filed by Obed Agu, Counsel for the petitioners that transmitted the intention of his clients. Garba, who replaced the former Presiding Justice of the tribunal, Zainab Bulkachuwa held that the petition remained withdrawn in the absence of any objections. Speaking to newsmen after the session, Agu said the remote reason for his clients’ withdrawal was not unconnected with the new position of the National Executive Committee (NEC) of the party to contribute positively to the growth of Democracy. The tribunal held another round of pre-hearing session where parties cross checked their processes preparatory to full commencement of proceedings. Garba, who was drafted from the Court of Appeal, Lagos Division insisted that the tribunal’s practice direction would be strictly followed. The judge, therefore, adjourned proceedings until June 11 for the hearing of some interlocutory motions. Three petitions against the re-election of Buhari are now before the panel of the Presidential Election and Petition Tribunal. They include the one filed by the Peoples Democratic Party (PDP) and its presidential Candidate, Alhaji Atiku Abubakar marked CA/PEPC/002/2019. Another of the pending petition is the one filed by Hope Democratic Party (HDP) and its National Chairman and presidential candidate, Chief Ambrose ‎Owuru. The other surviving petition is the one instituted by the Peoples Democratic Movement (PDM) and its presidential candidate, Pastor Aminchi Habu, marked CA/PEPC/004/2019. The petitioners had claimed the presidential election was marred by widespread malpractices, thereby failing to comply with statutory provisions of the 1999 Constitution and the Electoral Act. The petitioners have all also joined the Independent National Electoral Commission (INEC), Vice President Yemi Osinbajo, and the APC as respondents.
