Former TV3 newscaster files to evict restaurateur
KUALA LUMPUR, Aug 7, 2014:
A businesswoman, Azrinaz Mazhar Hakim Mazhar, has filed an application for an eviction order against a restaurateur and for him to return the premises leased to him back to her.
Azrinaz, 35, filed the originating summons through the legal firm of Messrs Firuz Jaffril, Aidil & Zarina at the High Court registry last July 21.
She named Syed Abuthahir Abdul Sithik, 37, the owner of Restoran RBJ Curry House, as defendant.
Members of the media obtained copies of the documents today when the case came up for mention before judge Datuk John Louis O’hara in chambers.
Present were lawyers Mohd Firuz Jaffril and C. Paul Ai Su, representing Azrinaz and Syed Abuthahir respectively.
Mohd Firuz told reporters that the court had set Sept 2 to hear the application.
Azrinaz, the owner of a shoplot, No. 8, Block 4, Jalan Jalil Jaya, Jalil Link, Bukit Jalil, filed the application to obtain an order for Syed Abuthahir, the lessee of the premises since June 1, 2012, to evict the building for allegedly breaching the terms of an agreement signed on July 11, 2012.
The former TV3 newscaster is also seeking the return of the premises as well as other costs and relief deemed fit by the court.
In a supporting affidavit, filed together with the originating summons, Azrinaz’ father, Hakim Mazhar Mohd Johar, 66, claimed that the defendant had failed to pay the lease of RM6,500 a month on time, as had been agreed in the agreement.
Hakim Mazhar, who handled the lease of the premises on behalf of Azrinaz, claimed that the defendant also failed to pay the electricity and water bills.
He said a notice to revoke the agreement was served on the defendant on March 14 this year seeking that he vacate the premises.
However, until now, he had refused to vacate the premises, he added.
