Hello, my name is Joel Williams, I'm a products liability attorney in Kennesaw, Georgia, and today I want to talk to you a little bit about products liability claims in Georgia law. In Georgia, products liability claims are generally classified as either manufacturing defect claims, design defect claims, failure to warn claims, sometimes breach of implied or express warranty claims. If you've been injured by a defective product, the type of claim you need to bring really depends on where the negligence was. For example, if a product is negligently designed so that it's inherently dangerous and defective for its intended purpose, you probably have a design defect claim. And if a product is negligently manufactured, whereas maybe one or two or a few of that particular product is dangerous as compared to the whole lot, then you may have a manufacturing defect claim. Some products are dangerous and some products have inherent risk involved with them to begin with, for example a jet ski or an ATV or a sharp tool, there comes risk with using that product but if those risks aren't obvious the manufacturer of the product has a duty to warn. If they don't warn and let you know about those inherent risks and dangers then you may have a failure to warn claim. One of the most deadly defective products can be a motor vehicle, and if you're in a wreck and a motor vehicle and your seat belt doesn't work or your airbag fails or your roof crushes in too far or your accelerator sticks or your gas tank catches on fire because it's in the wrong place, those consequences and those results can be deadly and can cause catastrophic injuries. Perhaps one of the most tragic products liability cases that I've handled involves a defective child's toy. Cribs, strollers, small toys with magnets, LED pain in them can have devastating consequences on children and the manufacturers of those products should be held liable when their products injure someone. Other examples of products liability cases involve prescription drugs, food that's not edible, it looks edible but it causes you to get sick, those type things or products that we consume into our bodies that can injure us but also results on our products liability claim. If you've been injured by a defective product, you can look on the Consumer Product Safety Commission's website which is shown with a computer screen behind me and find out whether the product that injured you has been subject to a recall. If it has, then there's a known danger with that product. Product liability cases are extremely complex, they're expensive, they're difficult and you're going to go up against some of the best lawyers in the world.
