The dispute involves the fact that when two candidates of the same name appear on a ballot, the elections process differentiates between them by placing a number before their names.

Councilman Baker, a retired aviator elected to the City Council in 2008, filed his nomination papers first, and when it became apparent there would be two Bob Bakers, he chose the number 1 to place before his name, expecting to be listed ahead of the other Baker on the ballot. Challenger Baker then chose the number 0, and as it turns out, 0 Robert “Bob” Baker is listed ahead of 1 Robert “Bob” Baker.

He suggested that the city clerk should have rejected the zero selection and required the candidate to “choose number 2 or any other positive integer besides 1.”

“But no,” Councilman Baker wrote, “instead, the clerk issued a statement that Robert ‘Bob’ Baker No. 0 will appear immediately before Robert ‘Bob’ Baker No. 1 on the ballot because zero is a lower number than one. Really?”

“However, the Registrar of Voters Office in Santa Ana agreed that zero is a number,” [Challenger Robert ‘Bob’ Baker No. 0] said.

The councilman said that “someone can be 1st in line, but no one can be 0st in line, can they? And do winners of races come in 1st place or 0th place?”

Councilman Baker said he has contacted Brad Hertz, a Los Angeles attorney who specializes in election law, with the possibility of seeking a court order to try to block the current ballot listing. “I’m thinking about it,” Councilman Baker said Friday. He said he was told that San Clemente’s legal counsel and county counsel had conferred about it and determined that the 0 was allowable as a lower number than 1.
