Changes in Real Estate Policies in India

The real estate sector is a global sector, visible in all countries of the world. In India, it has a bearing on the economy in a massive way – it is the 2nd largest employer after agriculture and it is expected to grow at a rate of 30 percent in the next 10 years.

With a positive change in the way real estate policies are being structured in India a strong movement is being seen in spacing.

INITIATIVES BY THE GOVERNMENT

To encourage development in this sector many initiatives have recently taken wing.

·         The Smart City project is one such exercise – a plan that envisages the building of 100 smart cities in the future. This is spurring a lot of interest  in the sector as a whole.

·         The Make in India project is expected to quicken commercial property leasing in the manufacturing segment. Office space has seen a big leap in the first half of this year.

·         Easier rules and regulations for real estate investment has been proposed by SEBI – some proposals are to relax the rules for foreign fund managers in relocating to India and to raise the cap of REIT investments in under- construction projects from the present cap of 10 percent to 20 percent.

·         The Real Estate Act, 2016 has been brought into force by the Government –  consumer interests are sought to be protected, while improving the real estate sector growth in the country.

·         MoUs’ have been signed by a state government to attract private investments in the arena of affordable housing. This is a major policy enhancement in the real estate sector.

·         FDI will be encouraged, with the norms in Foreign Direct Investment in the building and construction sector being relaxed in a substantial way.

All of you will agree, it is becoming increasingly difficult to look after our land and property, especially if it happens to be ancestral property – an inheritance handed over to us by our parents or grandparents.  Higher maintenance, high cost of land and construction costs only add to our troubles.

What is also becoming very rampant is the high incidence of fraudulent transactions that are happening these days – every day there is some news in the paper about a fraud that has occurred, or a scam that has done away with some land owner’s wealth. Many wake up only to find that their properties have been disposed off without their knowledge!

This can affect land or property owners either in the city or village, and either big or small. Owners who own multiple properties and who stay in different locations are unable to keep a steady check – this proves to be very costly in the long run. And then there are others who stay abroad, and hand over all the operating rights to their relatives – this too proves to be quite dangerous sometimes. Unless some strict monitoring is done and the owner receives a regular course of notifications it can lead to major fraud or forged transactions.
