BRIEF HISTORICAL BACKGROUND ON CHLORPYRIFOS

Major studies from the Mount Sinai School of Medicine, UC-Davis, and Columbia University have found strong evidence that low dose exposure to chlorpyrifos in the womb or after birth inhibits children’s brain development. The effects can be devastating, ranging from lower IQ to higher rates of autism.

In 2015, an EPA review concluded that exposure to chlorpyrifos, an organophosphate insecticide that is similar to sarin, posed an unacceptable risk to human health, both from residues on food and in drinking water. The EPA, led by Obama-appointed Administrator Gina McCarthy, proposed to revoke all food residue tolerances for chlorpyrifos with a final decision to follow a public comment period, by March 31, 2017.

In December 2016, Dow, manufacturer of chlorpyrifos, made a $1 million donation to the incoming administration’s presidential inaugural campaign. Soon after in 2017, Trump-appointed Scott Pruitt, the new EPA Administrator replacing Gina McCarthy, announced EPA’s reversal of the proposed chlorpyrifos ban 20 days after meeting with Dow CEO Andrew Liveris.

In July 2018, Scott Pruitt was forced to resign due to overwhelming charges of corruption and frivolous government spending ($43,000 on a soundproof phone booth, which violated federal spending laws, was only one of Pruitt’s many scandals). The pollution industry lobbyist, Andrew Wheeler, was then appointed to replace Pruitt.

In August 2018, a federal appeals court ruled that the Trump administration endangered public health by keeping this widely used pesticide on the market despite extensive scientific evidence that even tiny levels of exposure can harm babies’ brains. The U.S. Court of Appeals for the Ninth Circuit ordered the EPA to remove chlorpyrifos from sale in the U.S. within 60 days, and instructed the Agency to either revoke or modify the tolerance level for food.

Administrator Wheeler ignored the court order and did nothing, prioritizing corporate profits over children's health.

After EPA’s brazen disregard of the court order and federal inaction, Hawaii, California and New York passed state-level bans on chlorpyrifos. And in January 2020, the European Union banned chlorpyrifos, citing that there is no safe level of exposure.

2021… a new administration…

In August 2021, Biden’s EPA revoked all tolerances for chlorpyrifos on food, establishing the amount of the insecticide allowed at zero, effectively banning it in food and animal feed.

But a GMO growers association sued the EPA and in 2023, the U.S. Court of Appeals for the Eighth Circuit ruled in favor of the lobbying organization. Despite being based on sound science, the Eighth Circuit judge concluded that the EPA's August 2021 revocation of all food tolerances for chlorpyrifos was arbitrary and capricious and remanded the matter back to EPA for further review.

After that lawsuit, Biden’s EPA decided to not fight the pesticide industry, choosing to limit the scope of the ban to appease the pesticide industry and the chemical farmers.

This neurotoxic pesticide is used on alfalfa, almonds, apples, asparagus, broccoli, cauliflower, cherries, citrus fruits, corn, grapes, onions, peaches, pistachios, soybeans, sugar beets, strawberries, tomatoes, walnuts, and wheat, among other crops.

In December 2024, Biden's EPA issued a new proposed rule to revoke all tolerances for residues of chlorpyrifos, except for those associated with the use of chlorpyrifos on the following crops: alfalfa, apple, asparagus, tart cherry, citrus fruits, cotton, peach, soybean, strawberry, sugar beet, and spring and winter wheat.

Yes, you are allowed to laugh out loud. Any proposed ban should and must be protective of babies’ and children’s health. Yet this new proposed rule allows the pesticide to be in all of the foods that babies and children eat.

2025… a new administration… is your head spinning yet? The new EPA administration will be taking public comments on the last administration’s proposal. This is a real opportunity for the EPA to begin fulfilling Trump's promise to Make America Healthy Again.

A pesticide that causes neurological, developmental, and autoimmune disorders, has no place in our food and puts America’s health at risk, especially babies and children. The science is clear. Chlorpyrifos should have been banned years ago. And it should be fully banned now.

In 2001, the Clinton administration finalized a lengthy rulemaking process to protect roadless areas in America’s national forests from road-building and associated development. About 58 million acres of wildlands were covered under the Roadless Area Conservation Rule, which have mostly been kept free of road construction, logging, and other types of development.

In late August, however, Trump’s Agriculture Department, which oversees the Forest Service, announced that it would rescind the Roadless Rule, and it initiated the rescission process with an unusually short 21-day comment period.

National forest roadless areas in Idaho and Colorado received overall lesser protections via separate state-based rules and are not part of this current repeal attempt; however, 44.7 million acres of roadless areas on national forests could be opened to logging, mining, road-building, and development as part of the Trump administration’s efforts.

Roadless areas on national forests provide secure habitat for wildlife, and offer excellent recreation opportunities for camping, hiking, hunting, and more. Because many roadless areas abut designated Wildernesses, they also protect and enhance the value of those Wildernesses by keeping road-building and development farther away from Wilderness. And in the future, Congress may look to roadless areas for possible future wilderness designations.

Unfortunately, the 2001 Roadless Rule is not nearly protective enough. It contains numerous loopholes that allow some road-building, logging, and development under certain circumstances. Rather than repeal the 2001 Roadless Rule, it should be strengthened and these loopholes eliminated.

Scoping, the first step in the process, closes Friday, September 19. It’s important that as many people as possible submit comments opposing the proposed rescission from the outset. Use any or all of the following talking points, but please also speak in your own words about the importance of roadless areas.

Feel free to use the following points in your comment:

• I oppose rescinding the Roadless Area Conservation Rule. It has helped protect roadless areas, and adjacent Wilderness lands, on national forests for nearly a quarter-century.

• If anything is done with the Roadless Area Conservation Rule, it should be strengthened to eliminate the loopholes and provide better protection.

• Roads fragment wildlife habitat. Existing roadless areas provide habitat for many threatened and endangered species. Roadless areas also provide important migration corridors.

• Roads threaten high-quality streams and rivers in these areas. Dirt and sediment that runs off roads impairs habitat for fish and aquatic wildlife. Roads built in steep, rugged country are at increased risk of landslides that suffocate streams and rivers with mounds of mud.

The MAGA majority is hanging on by a thread, and we have a unique opportunity to deliver a blow that could send their entire operation into disarray. With each race becoming more critical, the special election we’re facing in Florida is one of the most pivotal we’ve seen in a long time.

The numbers are razor-thin, and every vote will count. This is a make-or-break moment, and the outcome of this race could have a ripple effect far beyond our district.

A victory here would shake up the Republican establishment and show that the people are not going to allow a few billionaires and special interests to take control of our government. It would be a monumental setback for Trump and his cronies.

This is not just about one seat; it’s about the future of our democracy. Winning this race could send shockwaves throughout the Republican party and stop Trump’s extremist agenda in its tracks. But to do that, we need your help.

VETO SB144, Georgia's Monsanto Protection Act

On March 22, Reuters reported that a Georgia jury ordered Bayer-Monsanto to pay $2.1 billion to a plaintiff who developed cancer from his use of Roundup herbicide, which the corporation still claims is safe despite the overwhelming scientific evidence.

But justice would not have been served if a recently passed Georgia state legislature bill had been the law. Georgians: Speak up for your rights today.

Bayer-Monsanto notched its first victory in a nationwide effort to shield itself from pesticide-harm lawsuits in mid-March. On March 13, the Georgia House of Representatives passed SB144 (101 Yea/58 Nay), a bill that would shield pesticide companies from legal accountability when their products cause cancer, Parkinson’s disease and other health harms. The bill passed the Georgia Senate (42 Yea/12 Nay) on March 4. Both were passed largely along party lines.

Bayer and the pesticide industry have been heavily lobbying state legislatures and the U.S. EPA since last year, but Georgia’s bill was the first to pass.

SB144 doesn’t just benefit Bayer, it gives ALL pesticide manufacturers and agricultural chemical producers legal immunity from any harm caused by their products. In addition to over 175,000 Roundup-cancer lawsuits against Bayer-Monsanto, there are over 5,800 filed against ChemChina-Syngenta by individuals who developed Parkinson’s disease after exposure to the company’s paraquat herbicide.

SB144 is now on Governor Brian Kemp’s desk. He can either veto it or sign it into law.

Earlier today, the first votes for Wisconsin’s next Supreme Court Justice were cast.

Voting started today, and will continue until April 1. This is our first electoral test of 2025.

Elon Musk has dumped more than $10 million into this race to elect a MAGA Republican who will rubber-stamp Trump’s agenda at a state level. That means more pollution, fewer rights, and more gun violence. It means women who need abortions and LGBTQIA+ youth won’t be safe in Wisconsin.

This week, House Republicans passed a continuing resolution that cedes congressional power to Trump and Musk as part of their plan to fund the government. The continuing resolution allows extreme funding cuts that will deepen the harm and chaos that Trump and Musk have already created as people across the country lose jobs, contracts are cancelled, and critical services and protections are gutted.

Now the Trump Slush Fund bill has moved to the Senate, and the vote could happen at any moment. Senators need to hear from YOU. Sign your name and urge your Senators to reject this extreme partisan funding bill that President Trump and Elon Musk will treat as a slush fund to enable and entrench their harmful agenda.
